EXECUTIVE SUMMARY The purpose of this item is to seek Council authorization to execute the updated adoption agreement of the 401(a) Service Directors’ and Council Employees’ Plan. Updates are necessary to correctly reflect the City’s contribution to the City Attorney’s 401(a) account. Council is asked to consider and approve the updated adoption agreement prepared by Nationwide Retirement Solutions, Inc. on behalf of the City. STAFF RECOMMENDATION Staff recommends adoption of the Resolution. BACKGROUND / DISCUSSION A resolution to update the 401(a) adoption agreement for Service Area Directors and Council -Appointed Employees was recently approved by Council on October 5, 2021. The update was to ensure employees who participate in the Service Area Directors and Council-Appointed Employees 401(a) plan receive up to a 13% City contribution of their base salary into their City-sponsored 401(a) retirement plan. The positions eligible to participate in this plan are Deputy City Manager, Assistant City Manager, Service Area Director, Service Unit Director, City Manager, City Attorney, and Chief Municipal Judge. Effective December 1, 2021, Human Resources staff is seeking to amend the 401(a) adoption agreement to accurately reflect the percentage of the City’s contribution amount for City Attorney Carrie Daggett. The change to the adoption agreement will correctly reflect the City Attorney is entitled to a City contribution up to an amount equal to ten percent (10%) of the City Attorney’s base salary into the 401(a) retirement plan on her behalf and that the City will further make a matching contribution equal to 100% of the City Attorney’s elective deferrals that do not exceed 4.5% of her annual base salary. Since the inception of her employment with the City, the terms of Ms. Daggett’s employment have included a City contribution to her 457 account equal to 4.5% of her annual base salary. The City Attorney has received a matching contribution from the City to her 457 account equivalent to this amount since six months after she was hired on July 10, 1995, and when she was appointed as City Attorney in April of 2015, there was an error in her employment agreement. Effective October 1, 2021, the City is no longer contributing to the City Attorney’s 457 account. This adoption agreement update will result in no change to the amount of the City’s contributions to retirement plans for the other participating employees and there is no additional cost to the City to update the 401(a) plan adopti on agreement as reflected in the attachment to the resolution. The adoption agreement for the 401(a) plan is identified as Adoption Agreement for Nationwide Financial Services, Inc. Governmental Volume Submitter Money Purchase Plan. -1- RESOLUTION 2021-115 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING EXECUTION OF ADOPTION AGREEMENT TO UPDATE THE SERVICE DIRECTORS’ AND COUNCIL EMPLOYEES’ 401(A) PLAN WHEREAS, with Resolution 2020-077, the City of Fort Collins (City) previously established a qualified 401(a) money purchase pension for City service area and unit directors and employees appointed by the City Council and a 457(b) deferred compensation plan (the “Plans”); and WHEREAS, the City entered into various administrative, adoption and trust agreements with Nationwide Retirement Solutions, Inc., along with its affiliates and subsidiaries (collectively “Nationwide”) with respect to administrative, recordkeeping and custodial services for the Plans; and WHEREAS, with Resolution 2021-090, the City approved changes to the adoption agreements for the 401(a) retirement plan for City service area and unit directors and employees appointed by the City Council (the “Employees”) and the Fort Collins 457(b) Deferred Compensation Plan to allow for a change in the City contributions so that the City’s contributions are to the 401(a) retirement plan for the Employees; and WHEREAS, since the inception of her eligibility for retirement benefits upon City employment in 1995, City Attorney Carrie Daggett has received a 4.5% matching contribution from the City equal to 100% of her elective deferrals; and WHEREAS,, since her appointment to the City Attorney position in 2015, Carrie Daggett has received a 4.5% matching contribution from the City equal to 100% of Ms. Daggett’s elective deferrals from the City beyond the 10% provided to all the Employees; and WHEREAS, the revised 401(a) adoption agreement authorized for execution with Resolution 2020-077 did not correctly describe the City’s matching contribution to Ms. Daggett’s elective deferrals that do not exceed 4.5% of her annual base salary; and WHEREAS, the City, as the employer sponsoring the 401(a) plan, with Nationwide’s assistance, developed amendments to the adoption agreement for the 401(a) Services Directors’ and Council Employees’ Plan to correctly reflect the City’s matching contribution equal to 100% of Ms. Daggett’s elective deferrals that do not exceed 4.5% of her annual base salary; and WHEREAS, City staff recommends approval and authorization to execute the amended adoption agreement prepared by Nationwide, which accurately reflects the City’s contributions to the City Attorney’s 401(a) retirement account; and -2- WHEREAS, this Resolution comes before City Council to aut horize execution of Adoption Agreement for Nationwide Financial Services, Inc. Governmental Volume Submitter Money Purchase Plan in the form shown on Exhibit “A.” NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby makes any and all determinations and findings contained in the recitals set forth above. Section 2. Governmental Volume Submitter Money Purchase Plan and Governmental Defined Contribution Volume Submitter Basic Plan Document Adoption Agreement Sec. 12. Eligible Employees. An Eligible Employee for Plan Purposes shall mean any person employed in the following Eligible Groups: Deputy City Manager Assistant City Manager Service Area Director Service Unit Director Chief of Police City Manager City Attorney Municipal Judge Basic Plan Document Article I (Definitions), Sec. 1.8 “Beneficiary” means the person (or entity) to whom all or a portion of a deceased Participant's interest in the Plan is payable, subject to the restrictions of Sections 6.2 and 6.6. Upon death, the Participant’s surviving spouse is the Beneficiary unless he or she consents to the Participant’s naming another Beneficiary. EXHIBIT A
