EXECUTIVE SUMMARY The purpose of this item is to determine substantial compliance and initiate annexation proceedings for the Timber Lark Annexation. The Applicant has submitted a written petition requesting the annexation. The Timber Lark Annexation totals 35.17-acres, which establishes 1/6 perimeter boundary contiguity with the existing municipal boundaries to the west, north, and east, is located approximately 600 feet northwest of the intersection of South Timberline Road and East Trilby Road. The requested zoning for this annexation is Low Density Mixed -Use Neighborhood (L-M-N) in compliance with the City of Fort Collins Structure Plan and the Fossil Creek Reservoir Area Plan. Notice to parcels abutting platted streets was provided pursuant to § 31-12-105, C.R.S. No project development plan proposal was submitted in conjunction with the annexation application. This annexation request is in conformance with the State of Colorado Revised Statutes as they relate to annexations, the City of Fort Collins Comprehensive Plan, and the Larimer County and City of Fort Collins Intergovernmental Agreement Regarding Growth Management. STAFF RECOMMENDATION Staff recommends adoption of the Resolution. BACKGROUND / DISCUSSION The proposed Resolution makes a finding that the petition substantially complies with the Municipal Annexation Act, determines that a hearing should be established regarding the annexation, and directs that notice be given of the hearing. The hearing will be held at the time of First Re ading of the annexation and zoning ordinances. The proposed zoning of a property to be annexed is not a requirement under § 31 -12- 107, C.R.S., and discussion of zoning issues should be reserved for the zoning review that will occur concurrent to the first reading for the annexation. Not less than thirty days of prior notice is required by state law. The property is located within the Fort Collins Growth Management Area. According to policies and agreements between the City of Fort Collins and Larimer Count y contained in the Intergovernmental Agreement for the Fort Collins Growth Management Area, the City agrees to consider annexation of property in the GMA when the property is eligible for annexation according to State law. Agenda Item 19 Item # 19 Page 2 The 35.17- acre Timber Lark Annexation has a total contiguous perimeter (3,417.55 feet) of 54%, which satisfies the one-sixth (1/6) area required. Contiguity is gained from the Union Pacific South 4th Annexation, Keating Annexation No. 2, and the Westchase Annexation No. 1. CITY FINANCIAL IMPACTS The annexation and zoning will not result in any initial direct significant financial/economic impacts. Electric service will be transferred from Poudre Valley REA to Fort Collins Light and Power. Future development will also trigger the transition of law enforcement from Larimer County Sheriff to Fort Collins Police Services. Water utility services will continue to be provided by the Fort Collins Loveland Water District, and wastewater utility service by the South Fort Collins Sanitation District. BOARD / COMMISSION RECOMMENDATION The Planning and Zoning Commission will conduct a public hearing on the annexation and zoning request on December 16, 2021. The Commission’s recommendation will be forwarded to Council as part of the First Reading of the annexation and zoning ordinances on January 18, 2022. PUBLIC OUTREACH There was no public outreach for this initiating Resolution, as this Resolution simply accepts the Annexation Petition and provides a schedule for upcoming Council hearings, with a schedule and notification requirements that comply with State Statutes. ATTACHMENT “D” TIMBER LARK RESIDENTIAL ANNEXATION NARRATIVE 4(g) A statement as to why it is necessary and desirable for the City of Fort Collins to annex the area. The property is located approximately 600 feet northwest of the Timberline Road and Trilby Road intersection. The property is adjacent to the Linden Park subdivision to the north, the Union Pacific Railway to the west, large estate lots to the south, and Timberline Road and another large estate lot to the east. The entire north and west boundaries of the property, as well as the portion of the east property boundary that is adjacent to Timberline Road, are contiguous with the boundaries of the City of Fort Collins. The owner of the property described in the Timber Lark Residential Annexation requests to be annexed into the City of Fort Collins in order to develop their property. The historical use of the property has been rural and undeveloped, but now that other recent developments have occurred in the vicinity, the owner recognizes that the development of this property, consistent with Low Density Residential is the best use of the land. The property is located within the City’s Growth Management Area (GMA) and therefore, is subject to the Intergovernmental Agreement (IGA) between the City of Fort Collins and Larimer County. The IGA requires that before urban development of the property can occur it must be annexed into the City. The boundary of the GMA, together with the IGA, verifies that the City and County agree that the property should be annexed prior to development. The applicant agrees that this is both appropriate and desirable. 4(h) A description of the zoning classification being requested and any condition requested for that zone district classification. The Applicant is requesting a zone district classification of Low-Density Mixed Use (LMN), in accordance with the Structure Plan. There are no conditions requested at this time. 4(i) A statement of consistency of the requested zoning to the Structure Plan. The Structure Plan identifies the Timber Lark property as a Mixed Neighborhood place type. Characteristics of a Mixed Neighborhood includes a variety of housing types such as single-family detached homes, duplexes, triplexes, and townhomes with a density between five and 20 dwelling units per acre. The supported housing types and density proposed in the Structure Plan is indicative of a Low Density Mixed-Use (LMN) zoning designation, where the purpose statement suggests that the main purpose of the District is to meet a wide range of needs of everyday living in neighborhoods that include a variety of housing choices, that invite walking to gathering places, services and conveniences, and that are fully integrated into the larger community by the pattern of streets, blocks, and other linkages. The LMN district requires a minimum average density of three (3) dwelling units per net acre for properties over 20 acres and a maximum density of nine (9) dwelling units per gross acre, which is consistent with the requirements of the Structure Plan. That the City Council hereby finds and determines that the annexation petition for the Timber Lark Annexation is in substantial compliance with the Municipal Annexation Act in that the annexation petition contains the following: -2- (1) An allegation that it is desirable and necessary that such area be annexed to the municipality; (2) An allegation that the requirements of C.R.S. Sections 31-12-104 and 31-12-105 exist or have been met; (3) An allegation that the signers of the petition comprise more than fifty percent of the landowners in the area and own more than fifty percent of the area proposed to be annexed, excluding public streets and alleys and any land owned by the annexing municipality; (4) The signatures of such landowners; (5) A request that the annexing municipality approve the annexation of the area proposed to be annexed; (6) The mailing address of each such signer; (7) The legal description of the land owned by such signer; (8) The date of signing of each signature; and (9) The affidavit of the circulator of such petition that each signature therein is the signature of the person whose name it purports to be. Section 4. That the City Council hereby finds and determines that the annexation map, four copies total, accompanying the annexation petition for the Timber Lark Annexation is in substantial compliance with the Municipal Annexation Act in that the map contains the following: (1) A written legal description of the boundaries of the area proposed to be annexed; (2) A map showing the boundary of the area proposed to be annexed; (3) Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks; and (4) Next to the boundary of the area proposed to be annexed, a drawing of the contiguous boundary of the annexing municipality and the contiguous boundary of any other municipality abutting the area proposed to be annexed. Section 5. That the Notice attached hereto as Exhibit “A” is hereby adopted as a part of this Resolution. Said Notice establishes the date, time and place when a public hearing will be held regarding the passage of annexation and zoning ordinances pertaining to the above- described property.
