EXECUTIVE SUMMARY The purpose of this item is to request an appropriation of $10,000 of unanticipated revenue received by the Transportation Services Fund from Skinny Labs, Inc., d/b/a SPIN (“SPIN”) in accordance with terms of the Services Agreement between the City and SPIN, the City’s e-bike/e-scooter share vendor. The funds will be used for promotion of and education about the e-bike/e-scooter program. STAFF RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. BACKGROUND / DISCUSSION The City entered into a Services Agreement with Spin on July 23, 2021, to administer a dock-less Micro Mobility Share Program across the City. The Services Agreement is a one-year contract that may be extended, at the option of the City, in one-year increments for up to an additional four years. In accordance with the City’s Services Agreement, SPIN shall pay the City $10,000 annually for program promotion at the City’s sole discretion. On September 1, 2021, the City received the first annual payment of $10,000 from SPIN to support the execution and delivery of an outreach plan for the SPIN Micro Mobility Share Program. With this funding, the City plans to contract with a vendor to perform services such as training on SPIN micro mobility devices, including on how they operate, and education about City regulations concerning operation and parking of the mobility devices. The vendor also will collaborate with the City and SPIN on other activities intended to promote the program, such as staffing booths or tables at community events to promote awareness of the SPIN micro mobility share devices, encourage trial and adoption, distribute SPIN/City-provided literature/handouts, offer demos of the devices at the event, and provide instruction and education on how to rent the devices, as well as safety tips and instruction. The vendor may be required to support other similar tasks and initiatives to promote SPIN’s e-bike/e-scooter program. It is anticipated the vendor also will help promote and execute SPIN’s Adaptive Bike Program demonstration events. SPIN’s Adaptive Bike program is intended to serve Fort Collins’ disabled and older adult community members and involves the delivery of adaptive non-electric bikes to the homes of qualifying participants who can rent the devices at no cost for extended periods. Agenda Item 7 Item # 7 Page 2 CITY FINANCIAL IMPACTS This Ordinance will appropriate $10,000 of unanticipated revenue received by the Transportation Services Fund to support promotional and educational activities for the SPIN Micro Mobility Share Program. This appropriation of funds does not require matching funds to be provided by the City. PUBLIC OUTREACH Significant stakeholder engagement has been and continues to be implemented to ensure that a broad range of community members have input on the development and ongoing progress of the SPIN Micro Mobility Share Program. Partners include but are not limited to: • Downtown Development Authority • Visit Fort Collins • Several not-for-profit agencies serving low-income, elderly, and disabled community members accessed through the City’s not-for-profit liaison • Several large employers • City Disability Advisory Board • City Senior Advisory Board • City Bicycle Advisory Committee • City Transportation Board • City Adaptive Recreation Office • City Land Conservation and Stewardship Board • CSU Student Disability Center -1- ORDINANCE NO. 133, 2021 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING SUPPLEMENTAL APPROPRIATIONS FOR PROMOTION AND EDUCATION REGARDING THE SPIN E-BIKE / E-SCOOTER MICRO MOBILITY SHARE PROGRAM WHEREAS, FC Moves is a department housed in the City’s Planning, Development, and Transportation division existing to advance mobility solutions to increase walking, bicycling, transit use, shared, and environmentally sustainable modes of transportation; and WHEREAS, FC Moves has partnered with Skinny Labs, Inc, d/b/a SPIN (“SPIN”) to provide sustainable, fun, and convenient transportation options for the Fort Collins Community using e-scooters and e-bikes; and WHEREAS, the City entered into a Services Agreement with SPIN for a Micro Mobility Share Program (the “Program”) on July 23, 2021; and WHEREAS, pursuant to the Services Agreement, SPIN is required to make a minimum annual payment of $10,000 to the City for the term of the contract to support promotion of the Program; and WHEREAS, on September 1, 2021, the City received the initial annual payment of $10,000 from SPIN to promote the Program; and WHEREAS, FC Moves plans to use the $10,000 received from SPIN to hire a vendor to assist with promotion of the Program and to perform educational and training services to the public on use of SPIN mobility devices; and WHEREAS, this appropriation benefits the public health, safety, and welfare of the residents of Fort Collins and serves the public purpose of promoting environmentally sustainable mobility solutions; and WHEREAS, Article V, Section 9, of the City Charter permits the City Council, upon recommendation of the City Manager, to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues and all other funds to be received during the fiscal year; and WHEREAS, the Interim City Manager has recommended the appropriation described herein and determined that this appropriation is available and previously unappropriated from the Transportation Services Fund and will not cause the total amount appropriated in the Transportation Services Fund to exceed the current estimate of actual and anticipated revenues and all other funds to be received in that fund during any fiscal year. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: -2- Section 1. That the City Council hereby makes and adopts the determinations and findings contained in the recitals set forth above. Section 2. That there is hereby appropriated from unanticipated revenue in the Transportation Services Fund the sum of TEN THOUSAND DOLLARS ($10,000) for expenditure in the Transportation Services Fund for promotion and education concerning the SPIN e-bike/e-scooter program.
