ITEMS NEEDING INDIVIDUAL CONSIDERATION
12. Guardian Self-Storage Project Development Plan Appeal.
A. Motion to deny the allegation that the Planning and Zoning
Commission failed to properly interpret and apply South
College Corridor Plan Policy LU 1.4 because LU 1.4 is not a
provision of City Code, Land Use Code, or the Charter
eligible to be appealed as a failure to interpret and apply
pursuant to City Code Section 2-48(b)(1).
B. Motion to uphold the Planning and Zoning Commission
decision because it properly interpreted and applied the
South College Corridor Plan Policy LU 1.4 and Land Use
Code § 3.10.2(A) because an appeal is limited to an
assertion of a failure to interpret and apply relevant
provisions of the Code and Charter, and the Corridor Plan is
neither part of the Code nor Charter, and it is within the
power of the Planning and Zoning Board to grant a
modification to Land Use Code § 3.10.2(A). Further motion
that, except as so stated, based on the evidence in the
record and presented at this hearing, any remaining issues
raised in the appeal are hereby found to be without merit and
are denied.
