EXECUTIVE SUMMARY The purpose of this item is for Council to consider making an interim appointment to the Platte River Power Authority Board until such time as the newly-elected Council makes its new board, committee and liaison appointments. STAFF RECOMMENDATION Staff recommends adoption of the Resolution. BACKGROUND / DISCUSSION Pursuant to an intergovernmental agreement establishing the Platte River Power Authority (PRPA), the City is entitled to representation on the eight-member Board of Directors of PRPA by its Mayor and a second appointee to be designated by City Council. Currently, Mayor Wade Troxell and Mayor Pro Tem Cunniff are the appointed City representatives serving on the PRPA Board. On April 6, 2021, the City held a regular municipal election, at which voters elected a new Mayor and Councilmembers to represent Districts 1, 3, 4, and 5. With the swearing in of newly -elected Mayor Jeni Arndt and Councilmembers Gutowsky, Canonico, Peel, and Ohlsen on April 27, 2021, the terms o f office for Mayor Troxell and Mayor Pro Tem Cunniff will end and, according to Resolution 2019 -065, the PRPA Board appointments will pass on to the new Mayor and successor Councilmember unless Council takes other action. This item gives Council the opportunity to appoint City Manager Darin Atteberry to the Board on an interim basis, to provide continuity for the Board position until such time as Council determines its new, updated appointments to outside boards and commissions. If the Resolution is approv ed, the City Manager will serve in an interim appointment, along with Mayor Arndt in her ongoing appointment, to represent the City on the PRPA Board. -1- RESOLUTION 2021-050 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING AN INTERIM APPOINTMENT TO THE PLATTE RIVER POWER AUTHORITY BOARD WHEREAS, pursuant to the intergovernmental agreement establishing the Platte River Power Authority (“PRPA”), the City is entitled to representation on the eight-member Board of Directors of PRPA by its mayor and a second appointee, to be designated by the City Council; and WHEREAS, on April 6, 2021, the City held a regular municipal election, at which voters elected a new Mayor and Councilmembers to represent Districts 1, 3, 4, and 5; and WHEREAS, the City Council previously designated then Mayor Pro Tem Ross Cunniff to serve as the City’s appointed representative to the PRPA Board; and WHEREAS, with the swearing in of the new Mayor and Councilmembers on April 27, 2021, the terms of office for Mayor Troxell and Mayor Pro Tem Cunniff have ended; and WHEREAS, pursuant to Resolution 2019-065 making Council appointments (including Councilmember appointments to the PRPA Board), “[i]n the event any individual appointee leaves office before Council acts to make a new appointment, the new incumbent in that individual Council seat shall be deemed to have assumed his or her predecessor’s appointments”; and WHEREAS, until such time as Council considers and adopts new, updated appointments to outside boards and commissions, the Council has determined that the interim appointment of City Manager Darin Atteberry to serve on the Board along with newly-elected Mayor Jeni Arndt will provide beneficial continuity; and WHEREAS, in light of the foregoing, the Council has determined to make the interim appointment set forth below, effective immediately, until such time as the Council takes new action to appoint a City representative to the PRPA Board to serve along with newly-elected Mayor Jeni Arndt. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. That the City Council hereby makes and adopts the determinations and findings contained in the recitals set forth above. Section 2. That Darin Atteberry, Fort Collins City Manager, is hereby appointed to serve on an interim basis as the City’s representative on the Platte River Power Authority Board, (in addition to Mayor Jeni Arndt, who succeeds Mayor Wade Troxell), effective immediately, until such time as the Council acts to modify this appointment. -2- Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 27th day of April, A.D. 2021. _________________________________ Mayor ATTEST: _____________________________ City Clerk
