SUBJECT
Second Reading of Ordinance No. 029, 2021, Appropriating Unanticipated Philanthropic Revenue in the
General Fund Received by City Give for Transfer to the Parks Department for Upgrades to Water’s Way Park.
EXECUTIVE SUMMARY
This Ordinance, unanimously adopted on First Reading on February 16, 2021, appropriates $6,105 in
philanthropic revenue in the General Fund and authorizes a transfer to the Parks Department for amenity
upgrades to Water’s Way Park as designated by the donors, friends and family of Willy Mergenthaler.
STAFF RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.

First Reading of Ordinance No. 029, 2021, Appropriating Unanticipated Philanthropic Revenue in the
General Fund Received by City Give for Transfer to the Parks Department for Upgrades to Water’s Way
Park.
EXECUTIVE SUMMARY
The purpose of this item is to appropriate $6,105 in philanthropic revenue in the General Fund and authorizing
a transfer to the Parks Department for amenity upgrades to Water’s Way Park as designated by the donors,
friends and family of Willy Mergenthaler.
STAFF RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
BACKGROUND / DISCUSSION
The purpose of this item is to appropriate $6,105 in the General Fund City Give Reserves account to be used,
as designated by the donors, to enrich existing park amenities in Water’s Way Park, 715 Fairbourne Way, in
south central Fort Collins, including expanded seating and enhanced landscaping. The charitable gift, awarded
to the City, is the accumulative generosity of community fundraising facilitated by friends and family of Willy
Mergenthaler.
The City Manager recommends the appropriation described herein and determined that this appropriation is
available and previously unappropriated from the General Fund and will not cause the total amount appropriated
in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in the
General Fund during this fiscal year. He is also recommending the transfer described herein and has determined
that the purpose for which the transferred funds are to be expended remains unchanged.
CITY FINANCIAL IMPACTS
This Ordinance will appropriate $6,105 of philanthropic revenue. The park enhancements will not exceed the
philanthropic revenue, and therefore do not trigger the requirement to appropriate one percent for Art in Public
Places.
The revenue is being appropriated from the General Fund City Give Reserves account for transfer to the Parks
Department in the General Fund. The funds have been received and accepted per City Give Administrative and
Financial Policy.
PUBLIC OUTREACH
The total philanthropic revenue is the product of 112 generous charitable contributions made by residents of Fort
Collins and non-residents, all friends and family of William Mergenthaler.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED PHILANTHROPIC REVENUE IN
THE GENERAL FUND RECEIVED BY CITY GIVE FOR TRANSFER TO THE
PARKS DEPARTMENT FOR UPGRADES TO WATER’S WAY PARK
WHEREAS, the City is the owner of property located at 715 Fairbourne Way in south
central Fort Collins known as Water’s Way Park (the “Park”); and
WHEREAS, the friends and family of Willy Mergenthaler, who passed away in October
2020 at the age of 20, have raised funds to be spent on enhancing the amenities at the Park, which
was a favorite hangout of Willy’s; and
WHEREAS, Park improvements are expected to include expanded seating and enhanced
landscaping; and
WHEREAS, these improvements will not exceed the philanthropic revenue of $6,105, and
therefore do not trigger the requirement to appropriate one percent for Art in Public Places; and
WHEREAS, this appropriation benefits public health, safety and welfare of the citizens of
Fort Collins and serves the public purpose of improving a public park for the benefit of the
community; and
WHEREAS, Article V, Section 9, of the City Charter permits the City Council to make
supplemental appropriations by ordinance at any time during the fiscal year, provided that the total
amount of such supplemental appropriations, in combination with all previous appropriations for
that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be
received during the fiscal year; and
WHEREAS, the City Manager has recommended the appropriation described herein and
determined that these appropriations are available and previously unappropriated from the General
Fund and will not cause the total amount appropriated General Fund to exceed the current estimate
of actual and anticipated revenues to be received in these funds during this fiscal year; and
WHEREAS, Article V, Section 10, of the City Charter authorizes the City Council to
transfer by ordinance any unexpended and unencumbered appropriated amount or portion thereof
from one fund or capital project account to another fund or capital project account, provided that
the purpose for which the transferred funds are to be expended remains unchanged; and
WHEREAS, the City Manager has recommended the transfer described herein and
determined that the purpose for which the transferred funds are to be expended remains unchanged.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:

Section 1. That the City Council hereby makes and adopts the determinations and
findings contained in the recitals set forth above.
Section 2. That there is hereby appropriated from unanticipated philanthropic revenue
in the General Fund City Give Reserves the sum of SIX THOUSAND ONE HUNDRED AND
FIVE DOLLARS ($6,105) for transfer to the Parks Department in the General Fund and
appropriated therein for Water’s Way Park.
Introduced, considered favorably on first reading, and ordered published this 16th day of
February, A.D. 2021, and to be presented for final passage on the 2nd day of March, A.D. 2021.
