Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney I Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from the July 17, 2019 meeting.  Tastings Permit Application from Campus West Liquors, Inc., dba Campus West Liquor Depot, 1107 City Park Avenue. Show Cause Hearing for Son Tran and Kathy Doan, dba Creekside Liquors, 1005 West Stuart #A3, Stipulation Agreement Approved Tom Dunn, attorney representing Son Tran and Kathy Doan, stating the licensee has agreed to the fact that the violation occurred, however, Mr. Dunn stated he and Assistant City Attorney Scurlock have not been able to agree on the penalty. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement as offered by the City Attorney’s Office. She stated the licensee has been offered an 18 day suspension, 6 days served ($1993.32 fine paid in lieu of suspension for 4 days, 2 days closed), 12 days held in abeyance for 1 year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Mr. Dunn stated that a closure of 1 day would be sufficient enough penalty. Liquor Enforcement Officer Ripsam spoke in favor of the penalty offered by Assistant City Attorney Scurlock. Show Cause Hearing for Mini Mart, Inc., dba Loaf ‘N Jug, 1801 North College Avenue, Stipulation Agreement Approved Erika Sanchez, representative for Mini Mart, Inc., stated she has agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Mini Mart, Inc., dba Loaf ‘N Jug, 1801 North College Avenue. Show Cause Hearing for Tamra Real Estate Agency USA, Inc., dba Pho Duy, 902 West Drake Road, #D1, Stipulation Agreement Approved Young Guk Kim, representative for Tamra Real Estate Agency USA, Inc., stated the employee that sold to the underage operative was fired and that all the other servers were retrained. Assistant City Attorney Scurlock reviewed the terms of the stipulation, noting the Licensee agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Tamra Real Estate Agency USA, Inc., dba Pho Duy, 902 West Drake Road. Show Cause Hearing for Valero, Inc., dba Valero, Inc., 1660 North College Avenue, Stipulation Agreement Approved Mahabir Singh, representative for Valero, Inc., stated he has reviewed stipulation agreement and is in agreement. He stated he suspended employee for one month, after which he was retrained. Show Case Hearing for Green Screens, LLC, dba X Golf, 351 East Foothills Parkway, Stipulation Agreement Approved Michael Ruvolo, representative for Green Screens, LLC, stated he had an opportunity to review the stipulation agreement and is in agreement. He stated the employee left business and that they have posted more signs, that they card everyone and have become a member of Responsible Alcohol Retailers. Assistant City Attorney Scurlock reviewed the terms of the stipulation, noting the Licensee agreed to a 15 day suspension, 5 days served ($290.30 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Green Screens, LLC, dba X Golf, 351 East Foothills Parkway. Manager Registration Application from Bowl Fort Collins, LLC, dba Chipper’s Lanes, 830 North College Avenue, Approved Sarah Slaton, manager applicant, briefly described her background and that her TIPs certification was recently renewed. She stated that all employees involved in the sale and service of alcohol is TIPs certified. Ms. Slaton stated any employee found in violation of the liquor code is immediately terminated. Judge Lane approved the registration of Sarah Slaton as manager of Bowl Fort Collins, LLC, dba Chipper’s Lanes, 830 North College Avenue. He stated he previously managed the Boulder restaurant and that he has never had a violation. Mr. Gianopoulos stated each server has two weeks of training, of which16 hours is specifically spent on alcohol service. He stated any employee found in violation of the liquor code is immediately terminated. Judge Lane approved the registration of George Gianopoulos as manager of The Kitchen Café, LLC, dba Next Door American Eatery, 100 North College Avenue. Temporary Modification of Premise Application from Black Bottle Brewery, LLC, dba Black Bottle Brewery, 1611 South College Avenue, Approved Sean Nook, representative for Black Bottle Brewery, LLC, stated this is their third year of doing this event and that this year will be run the same way as the past. He stated he has not received any objections to this application and that he will update the City Clerk’s office with times as each game time is set. Judge Lane approved the temporary modification of premise from Black Bottle Brewery, LLC dba Black Bottle Brewery, 1611 South College Avenue. Transfer of Ownership Application from Uddhab, Inc., dba Sherpa Grill 2, 1501 West Elizabeth Street, #5, Approved Prakash Sitaula, representative for Uddhab, Inc., stated they are in the process of hiring more people. He stated he will be responsible for training employees and that he recently received his TIPs training certification recently. Mr. Sitaula stated they are open 7 days a week, 11:00 a.m. to -10:00 p.m., that while they have a full bar they are primarily a restaurant. He stated either owner is on premise and that the other owner is also TIPs trained. Mr. Sitaula stated employees are required to card any patron ordering an alcoholic beverage that appears to be under the age of 50. He stated any employee found in violation of the liquor code is immediately terminated. Mr. Sitaula stated he has not had a liquor code violations. Judge Lane approved the transfer of ownership of Sherpa Grill 2, 1501 West Elizabeth Street to Uddhab, Inc. Patrick White stated he is operations manager and chef and briefly described the restaurant. He stated they have 17 employees, two managers which are both TIPs trained. Mr. White stated the rest of staff will be TIPs trained shortly and that they have never had a liquor code violation. He stated they do not accept vertical ids and that they do not allow visibly intoxicated patrons to remain on premise. Mr. White stated any employees found in violation of the liquor code is immediately terminated. Judge Lane approved the transfer of ownership of Uno Mas Taqueria, 120 West Olive Street, Suite 102, to Uno Mas 3, LLC. Other Business Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  August 20, 2019, visiting 10 liquor licensed establishments of which 2 served minors, thereby failing. She stated the failure rate was 20%.  July 16, 2019, visiting 17 liquor licensed establishments of which 2 served minors, thereby failing. She stated the failure rate was 12%.  July 17, 2019, visiting 13 liquor licensed establishments, of which 3 served minors, thereby failing. She stated the failure rate was 23%.
