Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney II David Lindsay, Liquor Enforcement Jason Epling, Liquor Enforcement Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from the January 16, 2019 meeting  Modification of Premises Application from Dillon Companies, LLC dba King Soopers #97, 2602 South Timberline Road.  Modification of Premises Application from Tivine, LLC, dba Island Grill, 2601 South Lemay Avenue.  Modification of Premises Application from Snack Attack Specialty Sandwiches & Brews, LLC, dba Snack Attack Specialty Sandwiches & Brews, 120 West Stuart Street, Unit A. Show Cause Hearing for Youngsun, LLC, dba Bison Liquors, 1015 West Horsetooth Road, #101 Stipulation Agreement Approved Anda Lincoln Stephenson, attorney representing Youngsun, LLC, stated she had reviewed the proposed stipulation with Mr. Lee, and agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation, noting the Licensee agreed to a 13 day suspension, 3 days served ($1446.17 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Show Cause Hearing for Mongolian Grill Restaurant Operating Company, LLC, dba HuHot Mongolian Grill, 249 South College Avenue Stipulation Agreement Approved Jeff Martin, representative for Mongolian Grill Restaurant Operating Company, LLC, stated he had reviewed the proposed stipulation and agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation, noting the Licensee agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Mongolian Grill Restaurant Operating Company, LLC, dba HuHot Mongolian Grill, 249 South College Avenue. Show Cause Hearing for Ciao Vino, LLC, dba Comet Chicken, 126 West Mountain, Stipulation Agreement Approved Alan Jantzen, manager, stated he had reviewed the proposed stipulation and agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation, noting the Licensee agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Ciao Vino, LLC dba Comet Chicken, 126 West Mountain Avenue. Show Cause Hearing for Cabana, LLC dba Rally 5, 2310 East Harmony Road, Suite 101 Stipulation Agreement Approved Chris Joseph, operations manager, state he had reviewed the stipulation and agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation, noting the Licensee agreed to a 14 day suspension, 4 days served ($450.94 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Show Cause Hearing for Liquor Kabinet, Ltd., dba Liquor Kabinet, 3035 West Prospect Road Stipulation Agreement Approved Woodrow Saunders, representative for Liquor Kabinet, Ltd., stated he has had an opportunity to review the stipulation agreement and agrees with the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation, noting the Licensee agreed to a 15 day suspension, 5 days served ($5000 fine paid in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Liquor Kabinet, Ltd., dba Liquor Kabinet, 3035 West Prospect Road. Transfer of Ownership Application from Locality Fort Collins, LLC, dba Locality Kitchen and Bar, 2350 East Harmony Road, Suite 101, Approved Jeffrey Noffsinger, representative for Locality Fort Collins, LLC, stated he has been in the restaurant business for several years and that he has not had a liquor code violation. He stated any employee found in violation of the liquor code will be immediately terminated. Judge Lane approved the transfer of ownership application from Locality Fort Collins, LLC, dba Locality Kitchen and Bar, 2350 East Harmony Road, Suite 101. Transfer of Ownership Application from Matthew Magley, dba City Park Nine Golf Course, 411 Bryan, Approved Mathew Magley stated he is the new concessionaire at City Park Nine Golf Course and that he is making some changes to how alcohol service is done. Mr. Magley stated alcohol sales are a low percentage of overall sales. Judge Lane approved the transfer of ownership application from Matthew Magley, dba City Park Nine Golf Course, 411 Bryan. Change of Location Application from Our Life Behind Bars, LLC dba Brave New Wheel from 105 East Myrtle Street to 111 West Olive Street, Approved John Daggett, representative for Our Life Behind Bars, LLC, stated this change of location will not change how they do business; that they will be open the same days and hours. He stated they do not have a patio and that alcohol sales are less than 1% of their total sales. He stated he received support from the designated neighborhood. Judge Lane approved the change of location application from Our Life Behind Bars, LLC, dba Brave New Wheel from 105 East Myrtle Street to 111 West Olive Street. New Application from Whole Foods Market Rocky Mountain/Southwest LP, dba Collins Tap Room (Whole Foods Market), 2201 South College Avenue, Approved Kevin Coates, attorney representing Whole Foods Market Rocky Mountain/Southwest LP, stated he has two witnesses and that they are ready to proceed. Brian Lahey, manager, was sworn. He stated they will begin construction in a week and that they anticipate opening April 17. Mr. Lahey stated the Taproom will be available as long as the grocery store is open but will only have beer sales from 11 – 9 pm. He stated any employee found in violation of the liquor code will be immediately terminated. Tina Scott, representative for Oedipus, Inc., was sworn. She briefly described the petitioning process and that these petitions indicate strong support for this Fermented Malt Beverages application. Judge Lane adopted Resolution 2019-006 approving a new application for fermented malt beverage from Whole Foods Market Rocky Mountain/Southwest LP, dba Collins Tap Room (Whole Foods Market), 2201 South College Avenue.
