Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held November 5, 2015 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Matt Hahn, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Registration of Jessenia Madrid as Manager of Red Robin's Burger Works, 120 West Stuart Street, Approved Jessenia Madrid, manager applicant, stated she currently supervises approximately 10 employees. She stated that she is responsible for the training and that she is on premise 50 hours/week. Ms. Madrid stated that training involves identifying visibly intoxicated patrons. She stated any employee found in violation of the liquor code is automatic termination if in violation of the liquor code. Judge Lane approved the registration of Jessenia Madrid as manager of Red Robin's Burger Works, 120 West Stuart Street. Registration of Ian Groo as Manager of HuHot Mongolian Grill, 249 South College Avenue, Approved Ian Groo, manager applicant, briefly described his background and the training required of all servers. Mr. Groo stated the head waiter is responsible for training all the servers and that approximately 14 of the 45 employees on premise are involved in the sale and service of alcohol. He stated he and his staff are experienced with dealing with visibly intoxicated patrons. Mr. Groo stated any employee found in violation of the liquor code is immediately terminated. He stated he has a current copy of the liquor code on premmse. Judge Lane approved the registration of Ian Groo as manager of HuHot Mongolian Grill, 249 South College Avenue. November 5, 2015 Registration of Bryan Hackenberg as Manager of CB & Potts at Collindale Golf Course, 1441 East Horsetooth Road, Approved Brian Hackenberg, manager applicant, briefly described his background and that all employees are ServSafe certified. He stated they re -certify all staff annually. Mr. Hackenberg stated that of the 35 employees, approximately 20 are involved in the sale and service of alcohol. He stated any patron that orders an alcoholic beverage must provide a valid id. Mr. Hackenberg stated that any any employee found in violation of the liquor code is immediately terminated. He stated they have a current liquor code on premise. Judge Lane approved the registration of Bryan Hackenberg as manager of CB & Potts at Collindale Golf Course, 1441 East Horsetooth Road. Registration of Julie McCain as Manager of The Lodge Sasquatch, 151 North College Avenue, Approved Julie McCain, manager applicant, briefly described her background. She stated she supervises 45 employees of which 20 are involved with the sale and service of alcohol. Ms. McCain stated she is on premise 60-65 hours a week. She stated any patron ordering alcohol is required to provide a valid id and that on the weekends they have someone at the door after 9:00 p.m. to keep patrons that are under the age of 21. Ms. McCain stated servers are required to be TIPS trained. She stated she has a current copy of the liquor code on premise. Judge Lane approved the registration of Julie McCain as manager of The Lodge Sasquatch Kitchen, 151 North College Avenue. Transfer of Ownership of Suehiro Japanese Restaurant, 4.431 Corbett Drive, #100, from Suehiro of Fort Collins South, LLC to Jeskis, Inc., Approved Davonne Smith and Scott Smith, representative for Jeskis, Inc., briefly described their background. Ms. Smith stated they have worked closely with the previous owners over the last year in preparation of this transfer. She stated they are only making minor cosmetic changes and that the menu has remained the same. Ms. Smith stated any patron that appears to be under 40 are required to provide a valid id. She stated servers are trained to identify visibly intoxicated patrons and that any employee found in violation of the liquor code is immediately terminated. Ms. Smith stated they have a current copy of the liquor code on premise. Judge Lane approved the transfer of ownership of Suehiro Japanese Restaurant, 4431 Corbett Drive, #100 from Suehiro of Fort Collins South, LLC, to Jeskis, Inc. November 5, 2015 Transfer of Ownership of The Lodge at MacKenzie Place, 4751 Pleasant Oak Drive and MacKenzie Place, AND 4750 Pleasant Oak Drive, from LB-MH Oakridge, LLC to MacKenzie Place Fort Collins, LLC, Approved Dan Carr, attorney representing MacKenzie Place Fort Collins, LLC, stated this is a transfer of ownership where there are no new principles. He stated the premises and the staff have remained the same and that this transfer is purely for tax purposes. Judge Lane approved the transfer of ownership of The Lodge at MacKenzie Place, 4751 Pleasant Oak Drive and MacKenzie Place, 4750 Pleasant Oak Drive, from LB-MH Oakridge, LLC, to MacKenzie Place Fort Collins, LLC. Transfer of Ownership of Cottonwood Liquors, 3645 South College Avenue, from Cottonwood Liquors, LLC, to KWS Liquors, Inc., Approved Keith Smalley, representative for KWS Liquors, Inc., stated the previous owner is still involved with training him on a daily basis. He stated there are four employees and that he has made a few cosmetic changes. Mr. Smalley stated he is on premise daily and that all patrons are required to provide valid identification. He stated any employee found in violation of the liquor code is immediately terminated. Judge Lane approved the transfer of ownership of Cottonwood Liquors, 3645 South College Avenue from Cottonwood Liquors, LLC, to KWS Liquors, Inc. Hearing on a New Application from The Welsh Rabbit Cheese Shop, Ltd., for a beer and wine license at The Welsh Rabbit Cheese Shop, 226 Pine Street, Approved Hal Dean, representative for The Welsh Rabbit Cheese Shop, Ltd., was swom and briefly described this new concept. He stated this will primarily be an event venue to host their wine and beer and cheese pairings. Mr. Dean stated this will be open only when there are private events and not open to the public. He stated these events will be staffed from existing employees and that they will have food served with the beer and wine. Mr. Dean stated he is in the process of securing an encroachment permit for the patio; stating the patio depicted on the drawing is what the City Engineer has tentatively approved. He described the proposed premises and stated their maximum occupancy is 30. Mr. Dean stated any employee found in violation will be immediately suspended, however, they do not wish to immediately terminated that employee if there is a chance to improve. He stated that they have a current copy of the liquor code on premise. Mr. Dean briefly described the petitioning process. He stated that there was a miscommunication with respect to the size of the designated neighborhood, however, that was corrected. 3 November 5, 2015 Judge Lane adopted Resolution 2015-034 approving a beer and wine license application from The Welsh Rabbit Cheese Shop, Ltd., The Welsh Rabbit Cheese Shop at 226 Pine Street. Hearing on a New Application from Carmike Concessions, LLC a beer and wine license at Carmike 10, 3636 Manhattan Avenue, Approved Brian Proffitt, attorney representing Carmike Concessions, LLC, introduced his witnesses. Scott Dunaway district manager, was sworn and stated that he has been the District, Manager for Carmike Concessions, LLC for 10 years. He briefly described his background and that in his capacity as a District Manager he is responsible for one other liquor licerised premise. Mr. Dunaway stated that their patrons have frequently asked for alcohol service. He detailed the premises, focusing on where the alcohol will be served from and stored. Mr. Dunaway described the process for which the server must follow when an alcoholic beverage is ordered by a patron. He stated patrons that are eligible for alcohol service will have a wrist band affixed to their wrist showing their eligibility. Mr. Dunaway stated alcoholic beverages will be served in clear cups to differentiate from other beverages. He described what employees are required to do if they find a patron is consuming an alcoholic beverage without a wrist band. Mr., Dunaway stated all employees will be required to successfully complete TIPS training prior to implementing alcohol service. He stated any employee found in violation of the liquor code is immediately terminated and that Carmike Concessions, LLC has not had a liquor code violation. Kelly Pietrs, representative for Esquire Petitioning, LLC, was sworn. She detailed how the petition was conducted and that the results of this survey indicates strong support for this beer and wine license application. Judge Lane adopted Resolution 2015-035 approving a beer and wine license application from Carmike Concessions, LLC, dba Carmike 10, 3636 Manhattan Avenue. p.m. Adjournment Municipal Judge 4
