Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held April 13, 2016 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Robin Cochran, Assistant City Attorney David Lindsay, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Show Cause Hearing for J.J. Linden Street, LLC, dba The Blind Pig Pub, 214 Linden Street, Stipulation Agreement Approved James Wells, representative for J.J. Linden Street, LLC, stated he has had an opportunity to review the stipulation agreement. Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($3221.90 fine paid in lieu of suspension), with 10 days held in abeyance for 1 year for violating Colorado Liquor Rules, 1 CCR 2503-2, Section 47-9100, for failing to conduct their premises in a decent, orderly and respectable manner and for violating Regulation 47- 918(a) which prohibits the removal of alcoholic beverages from the premises. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Napoletani Co., Inc., dba Pulcinella Pizza, 1119 West Drake Road. Registration of Drew Tilton as Manager of Old Chicago, 147 South College Avenue Approved Drew Tilton, manager applicant, stated he has been with this company for over 10 years. He described the training all employees are required to complete. Mr. Tilton stated any employee found in violation of the liquor code is immediately terminated. He stated any patron ordering an alcoholic beverage is required to provide valid identification. Judge Lane approved the registration of Drew Tilton as manager of Old Chicago, 147 South College Avenue. April 13, 2016 Request from Zydeco Grille, Inc., dba Bondi Beach Bar and Grille to Change, Alter, or Modify the Licensed Premises at 11 Old Town Square, Approved Dan Kerig, representative for Zydeco Grille, Inc., stated they are only adding 54 square feet to their patio as well as increase the height of the patio fence. He stated this will give them a few more seats to accommodate patrons during the busy summer months. Judge Lane approved the request from Zydeco Grille, Inc., dba Bondi Beach Bar and Grille to change, alter, or modify the licensed premises at 11 Old Town Square. Request from Rio Grande Mexican Restaurants, Inc., dba Rio Grande Mexican Restaurant to temporarily change, alter, or modify the licensed premises at 143 West Mountain Avenue on June 18, 2016, Approved Pat McGaughren, representative for Rio Grande Mexican Restaurant, Inc., briefly described the proposed changes. He stated he has had extensive discussions with the City regarding the street closure. Mr. McGaughren described how they will monitor the patrons in attendance for this event. He stated they will have approximately 14 private security staff. Judge Lane approved the temporary modification of premise application from Rio Grande Mexican Restaurant, Inc., to temporarily change, alter, or modify the licensed premises at 143 West Mountain Avenue on June 18, 2016. Transfer of Ownership of HuHot Express, 2720 Council Tree Avenue, Suite 184, from Hot Grills, Inc., to Himalayan Bistro, Inc., and Trade Name Change to Himalayan Bistro, Approved Dawa Sherpa, representative, stated this is their second location. He stated any patron ordering an alcoholic beverage will be required to provide valid identification. In response to questions from the Authority, Mr. Sherpa described the premises and that Poudre Fire Authority will be inspecting the location in the near future. He stated they will be open 11:00 a.m. to 10:00 p.m. everyday. Mr. Sherpa stated any employee found in violation will be required to attend additional training, however, if the employee intentionally violates the liquor code, they will be immediately terminated. Judge Lane approved the transfer of ownership of HuHot Express, 2720 Council Tree Avenue, Suite 184, from Hot Grills, Inc., to Himalayan Bistro, Inc., and trade name change to Himalayan Bistro. N1 April 13, 2016 Transfer of Ownership of Hilton Garden Inn, 2821 East Harmony Road from Summit Hotel TRS 032, LLC to ARC Hospitality SWN TRS, LLC, Approved Brian Proffitt, attorney representing ARC Hospitality SWN TRS, LLC, stated while this is a transfer of ownership, however, the management company will remain the same and that the previous general manager, Billy Dye, will remain on this premise. In response to a question from the Authority, Mr. Dye stated that customers will not see any changes. Judge Lane approved the transfer of ownership of Hilton Garden Inn, 2821 East Harmony Road from Summit Hotel TRS 032, LLC to ARC Hospitality SWN TRS, LLC. Hearing on a New Application from Fish Six Restaurant Corp, dba The Melt, for a beer and wine license at 185 East Foothills Parkway, Suite 110, Approved Michael Laszlo, attorney representing Fish Six Restaurant Corp, stated the address has changed, however, the physical premise has not changed. Mary Trepeda, district manager for Fish Six Restaurant Corp, stated this location will open approximately in June. She briefly described the alcohol policy and the training employees are required to attend alcohol training. Ms. Trepeda stated any employee found in violation of the liquor code will likely be terminated. In response to questions from Mr. Laszlo, Ms. Trepeda described the premises, stating that the entire front of the restaurant is windows. She stated the south patio will not be licensed as they will not be serving alcohol. Max Scott, representative for Oedipus, Inc., was sworn. He briefly described the petitioning process and that the results of this survey shows strong support for the needs and desires of the neighborhood. Judge Lane adopted Resolution 2016-007 approving a beer and wine license from Fish Six Restaurant Corp, dba The Melt, at 185 East Foothills Parkway, Suite 110. Hearing on a New Application. from Virtual Links, Inc., for a tavern liquor license at Virtual Links, 925 South Taft Hill Road, Approved Scott Smith, representative for Virtual Links, Inc., was sworn. He stated this application is in response to requests' from their patrons. In response to questions from the Authority, Mr. Smith stated they ID any patron ordering an alcoholic beverage and that they serve one drink per patron at a. dine. He stated he does not expect business to change and that all employees are TIP's trained. Mr. Smith stated he has a current copy of the liquor code on premise. He stated that the patio entrance is incorrectly depicted and that he will amend the diagram. In response to questions from the Authority, Mr. Smith stated he 3 +r S April 13, 2016 informed people that they are applying for a full liquor license and did not specify that it was a hotel - restaurant liquor license versus a tavern liquor license. He stated they received positive comments in support of this application. Judge Lane adopted Resolution 2016-014 approving a tavern liquor license from Virtual Links, Inc., dba Virtual Links at 925 South Taft Hill Road. Hearing on a New Application for a hotel -restaurant liquor license from Success Foods Management Group, LLC, dba Torchy's Tacos, Approved Tom Dunn, attorney representing Success Foods Management Group, LLC, stated this is their second application in Colorado. He briefly described the concept of this establishment and that all employees will be required to complete training prior to being allowed to served the public. Mr. Dunn stated that any patron ordering an alcoholic drink that appears to be under the age of 30 will be required to provide valid identification. He stated they will have a current copy of the liquor code on premise and that they will serve only one drink per patron. Mr. Dunn stated any employee found in violation of the liquor code will be immediately terminated. Jay Wald, representative for Success Foods Management Group, LLC, was sworn. In response to questions from the Authority, Mr. Wald described the premises. Mr. Wald stated they do have staff monitoring patrons._ Max Scott, representative for Oedipus, Inc., was sworn. Mr. Scott briefly described his background as well as the petition circulated for this application. He stated this survey results indicate strong support for this hotel -restaurant liquor license. Judge Lane adopted Resolution 16-002 approving a hotel -restaurant liquor license from Success Foods Management Group, LLC, dba Torchy's Tacos, 3280 South College Avenue, Suite 130. Hearing on a New Application from BD of Colorado, LLC for a hotel -restaurant liquor license at Bad Daddy's Burger Bar, 347 East Foothills Parkway, #110, and Registration of Haakon Currie as Manager, Approved Lauren Brown, attorney representative for BD of Colorado, LLC, stated he wishes to call his first witness. Max Scott, representative for Oedipus, Inc., was sworn. He briefly described his background, stating that he has been in business for 48 years and that they have conducted in excess of 6000 petitions. Mr. Scott described the petitioning process and that they informed the people they petitioned that this location will have a roof top patio. Andrea Wilshire, liquor license coordinator for BD of Colorado, LLC, was sworn. She briefly described the premises, type of food offered and that they are a family friendly establishment. Ms. Wilshire stated 4 April 13, 2016 that their food sales is 80% of their gross sales with alcohol the remaining 20%. She stated that the two floors will be connected via a dumb waiter and that patrons will be not allowed to transport alcohol between the floors. Ms. Wilshire stated that BD of Colorado, LLC has never had a liquor code violation and that they will train all their own employees. She stated that when a higher alcohol beer is brought in, they retrain all employees and that they ID any patron ordering an alcoholic beverage. Haakon Currie, manager applicant, briefly described his background. He stated he previously managed the Crown Pub and that he is not had a liquor code violation. Judge Lane adopted Resolution 2016 - 005 approving a new application from BD of Colorado, LLC, for a hotel -restaurant liquor license at Bad Daddy's Burger Bar, 347 East Foothills Parkway, #110 and registration of Haakon Currie as manager.
