Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held May 3, 2018 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane. presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Aimee Jensen, Deputy City Clerk Show Cause Hearing for GottiWebs, LLC, dba Bondi Beach Bar, Grill, 11 Old Town Square, Suite 120, Stipulation Agreement Accepted Nicholas Gottsacker, representative for GottiWebs, LLC, stated he has had a chance to review the stipulation agreement. He stated any patron ordering an alcoholic beverage is required to provide valid identification. Assistant City Attorney Scurlock briefly the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($2426.72 fine paid in lieu of suspension), with 10 days held in abeyance for one year for 1 year for violating Colorado Liquor Code Section 12-47-901(1)(a.5) prohibiting the service of an alcohol beverage to a person under the age of twenty-one years. The City received payment at the hearing. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for GottiWebs, LLC, dba Bondi Beach Bar and Grill, 11 Old Town Square. Show Cause Hearing for Kung-Food Kitchen, Inc., dba Simply Thai, 2531 South Shields Street, #2M Stipulation Agreement Approved Ekawat Sund, representative for Kung-Food Kitchen, Inc., stated he has had a chance to review the stipulation agreement. He stated they are carding every patron that orders an alcoholic beverage and that he understands he will need to receive formal training. Assistant City Attorney Scurlock briefly the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for one year for 1 year for violating Colorado Liquor Code Section 12-47-901(1)(a.5) May3, 2018 prohibiting the service of an alcohol beverage to a person under the age of twenty-one years. Show Cause Hearing for Tamra Real Estate Agency USA, Inc., dba Pho Duy, 902 West Drake Road, #D1, Stipulation Agreement Approved Young Kim, representative for Tamra Real Estate Agency USA, Inc., through an interpreter stated he has had the chance to review the stipulation agreement. Assistant City Attorney Scurlock briefly the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for one year for 1 year for violating Colorado Liquor Code Section 12-47-901(1)(a.5) prohibiting the service of an alcohol beverage to a person under the age of twenty-one years. Manager Registration Application from MBR, LLC dba Rare Italian, 101 South College Avenue, Approved .Ross Hamilton, manager applicant, stated he has been a manager for 3 years and that only recently has become the general manager. He stated that there is at least one manager on duty while they are open. Mr. Hamilton stated he is on premise 50+ hours per week. He stated any patron that orders an alcoholic beverage and appears to be under the age of 35 must provide valid identification. Mr. Hamilton stated any employee found in violation of the liquor code is immediately terminated. Judge Lane approved the registration of Ross Hamilton as manager of Rare Italian, 101 South College Avenue. Manager Registration Application from Brinker Restaurant Corporation, dba Chili's Hamburger Grill and Bar, 3524 South College Avenue, Approved Brock Bayes, manager applicant, stated he was the registered manager at the Longmont location and that he has been with Chili's for 16 years. He stated every patron that orders an alcohol beverage that appears to be under the age of 40 must provide valid identification. Mr. Bayes stated they do the Bars Program and that any employee found in violation of the liquor code is immediately terminated. Judge Lane approved the registration of Brock Bayes as manager of Chili's Hamburger Grill and Bar, 3524 South College Avenue. 2 May3, 2018 Transfer of Ownership of Lulu Asian Bistro, from Lu, Inc., to Xiu Jing, Inc., 117 South College Avenue, Approved Carl Ream, attorney representing Xiu Jing, Inc, stated they are ready to proceed. Ms. Lu, through an interpreter, described the training she has received and how long she has been operating this license. She stated every employee is over 21. Ms. Lu stated she is familiar with how a visibly intoxicated person looks like. She stated there are no changes to the licensed premises and that any employee found in violation of the liquor code will be immediately terminated. Judge Lane approved the transfer of ownership of Lulu Asian Bistro, from Lu, Inc., to Xiu Jing, Inc., 117 South College Avenue. The meeting adjourned at 2:00 p.m. Adjournment Municipal Judge 3
