Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney David Lindsay, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Show Cause Hearing for Sonii Hospitality, LLC, dba 1501 RestauBar, 1501 West Elizabeth Street, License Surrendered Mamta Kapoor, representative for Sonii Hospitality, LLC, briefly explained the series of events that led to this hearing. She stated she would surrender the hotel -restaurant liquor license. Judge Lane accepted the surrender of the hotel -restaurant liquor license for Sonii Hospitality, LLC, dba 1501 RestauBar, 1501 West Elizabeth Street. Show Cause Hearing for Son Tran and Kathy Doan, dba Creekside Liquors, 1005 West Stuart Street, Continued Tom Dunn, attorney representing Son Tran and Kathy Doan, stated they have had an opportunity to review the stipulation agreement. January 4, 2018 Assistant City Attorney Scurlock, summarized the stipulation agreement. She stated the Licensee has agreed to a 10-day suspension, 4 days served, ($1000 fine paid in lieu of suspension), with 6 days held in abeyance for 1 year for violating the terms of a prior Stipulation Agreement. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Son Tran and Kathy Doan, dba Creekside Liquors, 1005 West Stuart Street. Show Cause Hearing for Rachel Chappell/7-Eleven, Inc., dba 7-Eleven Store #32276A, 6600 South College Avenue, Stipulation Agreement Approved Rachel Chappell, representative for Rachel Chappell/7-Eleven, Inc., stated she has had an opportunity to review the stipulation agreement. Assistant City Attorney Scurlock, summarized the stipulation agreement. She stated the Licensee has agreed to a 15-day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for 1 year. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Rachel Chappell/7-Eleven, Inc., dba 7-Eleven Store #32276A, 6600 South College Avenue. Show Cause Hearing for Square Beverage, LLC, dba Square Beverage, 3500 South College Avenue, Unit 116, Stipulation Agreement Approved James Hosmeier, representative for Square Beverage, LLC, stated he has had an opportunity to review the stipulation agreement. Assistant City Attorney Scurlock, summarized the stipulation agreement. She stated the Licensee has agreed to a 15-day suspension, 5 served ($1401.97 fine paid in lieu of suspension), with 10 days held in abeyance for 1 year. Judge. Assistant City Attorney Scurlock, summarized the stipulation agreement. She stated the Licensee has agreed to a 15-day suspension, 5 served, ($5000 fine paid in lieu of suspension), with 10 days held in abeyance for 1 year. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Square Beverage, LLC, dba Square Beverage, 3500 South College Avenue, Unit 116. Show Cause Hearing for 2Watches, LLC, dba Pappy's Corner Pub,1027 West Horsetooth Road, #111, Stipulation Agreement Approved Jeff Miller, representative for 2Watches, LLC, stated he has had an opportunity to review the stipulation agreement. Assistant City Attorney Scurlock, summarized the stipulation agreement. She stated the Licensee has agreed to a 10-day suspension, Qanuary 22, 2018 —January 31, 2018) and 5 served ($1436.23 fine paid in lieu of suspension). Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for 2Watches, LLC, dba Pappy's Corner Pub, 1027 West Horsetooth Road, #111. 31Page January 4, 2018 Manager Registration Application from Tokyo, Inc., dba Tokyo Joe's, 2519 South Shields Street, Suite C. Approved Danielle Valentine, manager registration, stated she is responsible for training the employees that serve alcohol. She stated any patron ordering an alcoholic beverage must provide valid identification. Ms. Valentine stated their primary business is the sale of food. Judge Lane approved the manager registration of Danielle Valentine as manager of Tokyo Joe's, 2519 South Shields Street, Suite C. Manager Registration Application from Apple Colorado, LLC, dba Applebee's Neighborhood Grill & Bar, 4306 South College Avenue, Approved Kelli Robbin Green, manager applicant, stated they require all employees involved with the sale and service of alcohol. She stated she has been in the restaurant business for 10+ years. Judge Lane approved the manager registration of Kelli Robbin Green as manager of Applebee's Neighborhood Grill & Bar, 4306 South College Avenue. Manager Registration Application from MacKenzie Place Fort Collins, LLC, dba The Lodge at MacKenzie Place, 4751 Pleasant Oak Drive, Approved Erica Cheadle, manager applicant, stated this location is only used for special events. She stated all employees are required to complete training before being allowed to serve alcohol. Ms. Cheadle stated their clientele are generally senior citizens. Judge Lane approved the manager registration of Erica Cheadle as manager of The Lodge at MacKenzie Place, 4751 Pleasant Oak Drive. 4 1 Page January 4, 2018 Manager Registration Application from MacKenzie Place Fort Collins, LLC, dba MacKenzie Place, 4750 Pleasant Oak Drive, Approved Troy Erickson, manager applicant, stated they only serve alcohol in their dining room. He stated their clientele were 55+ years of age. Mr. Erickson stated all employees are required to complete TIPs training prior to serving alcohol. Judge Lane approved the manager registration of Troy Erickson as manager of MacKenzie Place, 4750 Pleasant Oak Drive. Manager Registration Application from The Kitchen Cafe, LLC dba The Kitchen, 100 North College Avenue, Approved James Bucci, manager applicant, stated he has been at this location for a couple of years and only recently became the general manager. He stated any employee found in violation of the liquor code is immediately terminated. Judge Lane approved the manager registration of James Bucci as manager of The Kitchen, 100 North College Avenue. Temporary Modification of Premise Application from Tap and Handle Partners, LLC, dba Tap and Handle, 307 South College Avenue, Approved Katie Davis, representative for Tap and Handle Partners, LLC, detailed the proposed event. She stated she will be on premise throughout the event. Ms. Davis stated all employees are TIPs trained. Judge Lane approved the temporary modification of premise application from Tap and Handle Partners, LLC, dba Tap and Handle, 307 South College Avenue for an event to be held May 12, 2018. 51Page January 4, 2018 Change in Location Application from The Fox and The Crow, LLC, dba The Fox and The Crow, to move a beer and wine license, from 2601 South Lemay Avenue, #21 to 2601 South Lemay Avenue, #9, Approved Tina Mooney, representative for The Fox and The Crow, LLC, was swom. She stated she will be adding three staff members to accommodate the larger premises. In response to questions from the Authority, Ms. Mooney described the premises. Ms. Mooney stated that patrons must come up to the counter to order either beer or wine to gauge level of intoxication. Judge Lane adopted Resolution 2018-001 approving a change in location application from The Fox and The Crow to move a beer and wine license from 2601 South Lemay Avenue, #21 and to 2601 South Lemay Avenue, #9. Transfer of Ownership of Sammy's Breakfast Bar, 4613 South Mason Street, Approved Chance Becksted, representative for CJ Becksted, Inc., stated all the employees have been TIPs trained. He stated alcohol sales are a very small percentage of their total sales. Mr. Becksted stated that any employee found in violation of the liquor code will either be suspended or fired. Judge Lane approved the transfer of ownership of Sammy's Breakfast Bar, 4613 South Mason Street, from Snozilles, Inc., to CJ Becksted, Inc. 6 1 Page - - January 4, 2018 Transfer of Ownership of Bondi Beach Bar and Grill, 11 Old Town Square, Approved Nicholas Gottsacher, representative for GottiWebs, LLC, stated they have not made any changes to the premises and that patrons will not be aware that a transfer of ownership has occurred. He stated he has been the general manager for several years. Judge Lane approved the transfer of ownership of Bondi Beach Bar and Grill, 11 Old Town Square, Suite 120, from Zydeco Grillo, Inc., to GottiWebs, LLC. Hearing on a New Application from Making Mad Dough Fort Collins, LLC, dba Urban Bricks Pizza Bar, 2860 East Harmony Road, Suite 110 for a Hotel -Restaurant Liquor License, Approved Jason Wolf, representative for Making Mad Dough Fort Collins, LLC, was sworn. He stated this will primarily be a pizza restaurant. Mr. Wolf stated any patron ordering an alcoholic beverage will be required to provide valid identification. He stated any employee found in violation of the liquor code will be immediately terminated. Ellyn Just, representative for Aggie Agency, LLC was sworn. She briefly described the petitioning process stating this survey indicates support for this application. In response to questions from the Authority, Mr. Sommars briefly described each of the premises, stated alcohol sales is a small part of their gross sales. He stated they will not be adding a bar, only coolers that are behind the cashier. Mr. Sommars stated any patron ordering an alcoholic beverage must provide valid identification. He stated a manager is always involved with the sale of alcohol. Mr. Sommars stated all three managers have received ServSafe training. He stated the three managers registering have been managers for several years. Carol Johnson, representative for Esquire Petitioning, LLC, was sworn. She detailed the petitioning process, stating this survey indicates strong support for these three liquor license applications. Judge Lane adopted Resolution 2017 — 028 approving a hotel -restaurant liquor license from Qdoba Restaurant Corporation, dba Qdoba Mexican Eats 2053, 1104 West Elizabeth Street and approved the registration of Zachery Van Nevel as manager of Qdoba Mexican Eats 2053. Judge Lane adopted Resolution 2017 — 030 approving a hotel -restaurant liquor license from Qdoba Restaurant Corporation, dba Qdoba Mexican Eats Store 2307, 2513 South Shields Street and approved the registration of Nicholas Veggian as manager.
