A regular meeting of the Liquor Licensing Authority was held on December 16, 2013 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Aimee Jensen, Deputy City Clerk Mark Clitnovici, Liquor Enforcement Officer Show Cause Hearing for IVP, Inc., dba The Aggie Theatre 204 South College Avenue Stipulation Agreement Approved Zach Wilson, attorney representing IVP, Inc., stated he was ready to proceed Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 50 days suspension, 20 days actually served, 30 days held in abeyance for 1 year for violating C.R.S., 12-47-901(a.5)(I), for permitting the sale or service of alcohol beverages to a person under the age of 21, Regulation 47-900 for improper conduct of establishment, and City Code, Chapter 3, Article III, Section 3-81(a) for failure to report disturbances to Police Services. Zach Wilson stated his client understands the stipulation agreement and the penalty assessed. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for IVP, Inc., dba The Aggie Theatre, 204 South College Avenue. Registration of Pamela Evans as Manager of The Lodge at MacKenzie Place, 4751 Pleasant Oak Drive, Approved Pamela Evans, manager applicant, briefly- described her background. She stated she any employee found in violation of the liquor code is retrained, if the violation is intentional, the employee is immediately terminated. Ms. Evans detailed the training she requires her employees to complete. She stated this location is a retirement facility and that liquor is a small part of their overall sales. Judge Lane Lane approved the registration of Pamela Evans as Manager of The Lodge at MacKenzie Place, 4751 Pleasant Oak Drive. December 16, 2013 Registration of Cassie Barrett as Manager of Beau Jo's Pizza, 205 North College Avenue, Approved Dan Carr, attorney representing Beau Jo's Pizza, stated they have encountered significant construction problems and that Ms. Barrett will complete training prior to opening. Ms. Barrett stated they card any patron that orders an alcoholic beverage that appears to be under the age of 40. She briefly described the training Bcau Jo's requires employees to complete prior to serving. Judge Lane approved the registration of Cassie Barrett as manager ofBeau jo's Pizza, 205 North College Avenue. Hearing on a New Application from Red Robin Express, LLC, for a hotel -restaurant liquor license at Red Robin's Burger Works, 120 West Stuart Street, #A-1, Approved Michael Toll, attorney representing Red Robin Express, LLC, stated they were ready to proceed. Nathan Brodback, regional operations manager, was sworn. Mr. Brodback briefly described his background and the type of restaurant Red Robin Express is in comparison to the Red Robin located on Harmony Road. Mr. Brodback stated at this point they will only be serving bottle beer. He confirmed that the floor plan on file is correct. Mr. Brodback stated that they do not have table service for alcohol, that the patron must directly interact with staff at the counter to order beer. He stated they do not accept'vertical' drivers licenses, or expired licenses with the renewal paperwork. Mr. Brodback stated 5% of their gross sales comes from the sale of alcohol. He stated any violation of the liquor code by an employee leads to immediate termination. Susan Duffy Schwal, representative for Liquor Petioning Professionals, LLC, was sworn. She briefly- described how the petitioning was conducted. Ms. Schwal stated the neighborhood shows strong support for this application. Judge Lane adopted Resolution 2013-30 approving an application from Red Robin Express, LLC, for a hotel -restaurant lqiuor license at Red Robin's Burger Works, 120 West Stuart Street, #A-1 Hearing on a New Application from Blue Agave Grill, LLC, for a hotel -restaurant liquor license at Blue Agave Grill, 201 South College Avenue, Suite 100, Continued to January 15, 2014 Richard and Brenda Lucio, representatives for Blue Agave Grill, LLC, were sworn. In response to questions from the Authority, Mr. Lucio described the proposed premises. He stated there may be some changes to the premises and if there is, they will provide an updated diagram to the City Clerk's Office. Mr. Lucio stated they will register a manager before opening in March, 2014. Ms. Lucio stated that any patron ordering an alcohol beverage that appears to be under the age of 40 must provide valid identification. She stated they intend to have a current copy of the liquor code on premise. Ms. Lucio stated that any employee found in violation of the liquor code would be immediately terminated. Judge Lane continued the hearing to January 15, 2014 to allow changes to the patio to be completed and to revise the application. 2 December 16, 2013 Hearing on a New Application from Ovations Food Service, LP, for a beer and wine license at Ovations at Bob Davis Banquet Hall, 951 West Plum Street, Approved Karla Lewis, representative for Ovations Food Service, LP, was sworn. She stated this venue is for internal events only. Ms. Lewis stated the patio will not be included in the licensed premises. She stated that any violation of the liquor code will likely be terminated. Ms. Lewis stated they have long-term employees that are experienced with the sale and service of alcohol. Ellyn Just, representative for Aggie Agency, LLC, was sworn. She briefly described the results of the petitioning and that there were a few individuals were against more alcohol service on CSU's campus. In response to a question from the Authority, Ms. Just stated she was aware of the limited nature of this location and shared this information with petitionees. Adiournmcnt n. Municipal Judge
