Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held May 7, 2015 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Josh Golden, Liquor Enforcement Officer Matt Hahn, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Approval of Minutes Judge Lane approved the minutes from March 5, 2015. Show Cause Hearing for B & B's Pickle Barrel, Inc., dba B & B's Pickle Barrel,122-124 West Laurel Street, Stipulation Agreement Approved Brenda Smith, representative for B & B's Pickle Barrel, Inc., stated she has had an opportunity to review the stipulation agreement. Ms. Smith stated she fired the bartender that sold to the underage patron. Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($521.86 fine paid in lieu of suspension), with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a.5)(I), permitting the sale of service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for B & B's Pickle Barrel, Inc., dba B & B's Pickle Barrel, 122-124 West Laurel Street. Show Cause Hearing for Uncle Vito's Too 2, LLC, dba Uncle Vito's,1015 South Taft Hill Road, Stipulation Agreement Approved Rick Cchoa, representative for Uncle Vito's Too 2, LLC, stated she has had an opportunity to review the stipulation agreement. Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for 1 May 7, 2015 year for violating C.R.S. 12-47-901(1)(a.5)(1), permitting the sale of alcohol beverages to a person under the age of 21 years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Uncle Vito's Too 2, LLC, dba Uncle Vito's, 1015 South Taft Hill Road. Registration of Robert Donald Braddy as Manager of Ramen Master, 144 South Mason Street, Approved Don Braddy, manager applicant, briefly described his background. He stated he has been in the restaurant business for many years. Mr. Braddy stated he completed the online training recently and that he is responsible for training the staff. He stated their alcohol sales is small and that he has approximately 12 employees he supervises. Mr. Braddy stated he has not had a liquor violation. on premise 45 Judge Lane approved the registration of Ronald Donald Braddy as manager of Ramen Master, 144 South Mason Street. Registration of Timothy Downey as Manager of Rodizio Grill, 200 Jefferson Street, Approved Tim Downey, manager applicant, stated he has been in the restaurant business since 1992. He stated he most recently was the registered manager at The Melting Pot. Mr. Downey stated he is a certified TIP's trainer and that he is responsible for training the staff. He stated if an employee violates the liquor code they are immediately terminated. Mr. Downey stated he is on premise at least 40 hours per week. Judge Lane approved the registration of Timothy Downey as manager of Rodizio Grill, 200 Jefferson Street. Registration of Brian Lee Call as Manager of Applebee's Neighborhood Grill & Bar, 4306 South College Avenue, Approved Brian Lee Call, manager applicant, stated he has been a restaurant manager for 15 years. He stated he was previously in Greeley and Brighton and that he is ServSafe certified. Mr. Call stated he is responsible for training staff regarding the sale and service of alcohol. He stated he is on premise approximately 50 hours per week. Mr. Call stated any patron ordering an alcoholic beverage that appears to be under the age of 30 is required to provide a valid id. Judge Lane approved the registration of Brian Lee Call as manager ofApplebee's Neighborhood Grill & Bar, 4306 South College Avenue. May 7, 2015 Registration of Billy Dye as Manager of Hilton Garden Inn, 2821 East Harmony Road, Approved Billy Dye, manage applicant, stated he completed TIP's training a year ago. He stated he is responsible for training staff that will be serving alcohol. Mr. Dye stated he is on premise approximately 45 hours a week. He stated any patron ordering an alcoholic beverage is required to provide a valid id. Mr. Dye stated he has a current copy of the liquor code on premise. Judge Lane approved the registration of Billy Dye as the manager of Hilton Garden Inn, 2821 East Harmony Road. Request from The Criterion Group, LLC dba The Melting Pot to Temporarily Change, Alter, or Modify the Licensed Premises at 334 East Mountain Avenue from August 13, 2015 through August 16, 2015 for New West Fest, Approved Ryan Houdek, representative for The Criterion Group, LLC, stated this an application for a temporary permit of modification during the New West Fest and that this is configuration as previous years. He stated this is the 10th year for this event. Judge Lane approved the request from The Criterion Group, LLC dba The Melting Pot to temporarily change, alter, or modify the licensed premises at 334 East Mountain Avenue from August 13, 2015 through August 16, 2015 for New West Fest. Hearing on a Change of Location Application from Thirsty's Liquor, Inc., dba Thirsty's Liquor to move a retail liquor store license from 1007 - 1009 South Lemay to 1001 South Lemay Avenue, Approved Cindy Young Lee, representative for Thirsty's Liquor, Inc., was sworn. She briefly described why this change of location was required. Ms. Lee stated this new location is similar to the premises at 1007-1009 South Lemay. In response to questions from the Judge, Ms. Lee described the petitioning process. Judge Lane adopted Resolution 2015-009 approving a change of location application from Thirsty's Liquor, Inc., dba Thirsty's Liquor to move a retail liquor store license from 1007 - 1009 South Lemay to 1001 South Lemay Avenue. Hearing on a Change of Location Application from Celli, Inc., to move a tavern liquor license from 238 Linden Street to 223 B Linden Street, Approved William Chelalis, representative for Celli, Inc., was sworn. He stated he has held a liquor license since 1992. Mr. Chelalis stated he will only be open three days of operation a week. Mr. Chelalis stated he will open approximately 7:00 p.m., until 1:00 a.m., the latest. He stated he will not open until April 2016. Mr. Chelalis stated he will not have any amplified music outside. Al Dunton, 233-235 Linden Street, was sworn. He stated is a party in interest and that he has been a resident at this location for nearly 12 years. Judge Lane adopted Resolution 2015-010 approving a change of location application from Celli, Inc., to move a tavern liquor license from 238 Linden Street to 223 B Linden Street. May 7, 2015 Hearing on a New Application from Publick House, LLC, for a beer and wine license at Wolverine Farm Letterpress & Public House, 316 Willow Street. Approved Todd Simmons, representative for Publick House, LLC, was sworn. He stated he moved to Fort Collins in 2002 and began 501(3)c Wolverine Farm Publishing Company. Mr. Simmons stated the hope to open at the end of June, early July. He stated they will have normal cafe food, beer and wine. Mr. Simmons stated he anticipates that their clientele will be from events they host as opposed to foot traffic. He stated he recently completed TIP's training and that he has held liquor special events permits over the last 10 years. Mr. Simmons stated that he has had experience with dealing with visibly intoxicated patrons and that he has a current copy of the liquor code to keep on premise. He briefly described the petitioning process and that he encountered two individuals who were opposed but declined to sign the petition. Al Dunton, 233-235 Linden Street, was sworn. He stated is a party in interest and that he has been a resident at this location for nearly 12 years. Mr. Dunton stated amplified music creates problems for residents nearby. He requested that Mr. Simmons be aware of his impact on the neighborhood if he has outside events. Judge Lane adopted Resolution 2015-007 approving new application from Publick House, LLC, for a beer and wine license at Wolverine Farm Letterpress & Public House, 316 Willow Street.
