A regular meeting of the Liquor Licensing Authority was held on March 11, 2013 in Municipal Court,
215 North Mason. Judge Kathleen Al. Lane presiding.

Approval of Minutes
Judge Lane approved the minutes from February 25, 2013 and March 4, 2013.
Request from Wise Fly, LLC, dba
Tap and Handle to Change, Alter, or Modify the Licensed Premises at
307 South College Avenue, Approved
Jeff Willis, representative for Wise Fly, LLC, briefly described the proposed event. He stated this is an
annual fund raiser for the Poudre Fire Authority. Terry Falbo, event participant, stated he has been
involved extensively with other large scale events that serve alcohol. Mr. Willis stated he has permission
to use the parking lot and that Tap and Handle is the only business that uses this parking lot.
In response to a question from the Authority, Mr. Willis described the petitioning process. He stated
he was pleased with the positive response he received.
Judge Lane approved the request from Wise Fly, LLC, dba Tap and Handle to temporarily change, alter,
or modify the licensed premises at 307 South College Avenue on March 16, 2013.
Hearing on a New Application from Kristina Eisele Holdings, LLC dba
Souza's Smokin BBQ, 1005 West Stuart Street, Suite All, Approved
Kristina Eisele, representative for Kristina Eisele Holdings, LLC, was sworn. She stated she has been
the owner for 1 '/z years. Ms. Eisele stated she is requesting a beer and wine license due to customer
requests. She stated she intends to become TIP's trained soon. Ms. Eisele stated her staff is TIP's
trained. In response to a question from the Authority, Ms. Eisele stated that the patio will be included
with the licensed premises and that she will have staff designated to monitor the patio. She stated she
anticipates alcohol sales to be approximately 10% of gross sales. Ms. Eisele stated she has
approximately 10 employees with two managers besides herself. She stated a blatant violation of the
liquor code by an employee will result in immediate termination, otherwise, she will counsel the
employee and give them another chance.

Ms. Eisele briefly described the petitioning process. She stated overall the petitions indicate a need and
desire for this application to be granted.
Judge Lane adopted Resolution 2013-09 approving an application from Kristina Eisele Holdings, LLC,
for a beer and wine license at Souza's Smokin BBQ, 1005 West Stuart Street, Suite Al.
Hearing on a New application from whichway pizza 101, dba
Which Way Pizza 101,1335 West Elizabeth Street, Suite 135, Approved
Rex Ready, representative for whichway pizza 101, was sworn. He described the location and that he
will be involved with the day to day operations. Mr. Ready stated he is not TIP's trained, however,
Roger Burton, an employee described how he will make sure proper procedures are followed with
respect to the sale and service of alcohol. Mr. Burton stated he has had years of experience in the sale
and service of alcohol. In response to a question from the Authority, Mr. Burton stated that the patio
is fully visible from inside the restaurant. He stated alcohol sales is anticipated to be approximately 20%
of gross sales. Mr. Burton stated that any willful violation of the liquor code will result in immediate
termination, otherwise, the employee will given another chance.
David Wyatt, representative for Aggie Agency, was sworn. He briefly described the petitioning process.
Mr. Young stated there was overwhelming support of this application in the neighborhood.
Judge Lane adopted resolution 2013-10 approving an application from whichway pizza 101, for a beer
and wine license at Which Way Pizza 101, 1335 West Elizabeth Street, Suite 135.

dba Walmart Market #3177, 4625 South Mason Street, Approved
Kevin Coates, representative for Wal-Mart Stores, Inc., stated he is ready proceed. Max Scott,
representative for Oedipus, Inc., and Jeff Plumb, manager, were sworn. In response to questions from
the Authority, Mr. Scott described the petitioning process and that the designated neighborhood
indicates strong support for the issuance of this license.
Jeff Plumb, manager, described the premises. He stated he has worked with Wal-Mart for several years
and recently became the store manager for the first time. Mr. Plumb stated he has not personally had
a liquor violation, however, one of his cashiers sold 3.2% beer to an underage patron. He stated any
employee found in violation of the liquor code is immediately terminated. Mr. Plumb stated they
increased their training for alcohol sales. He stated employees are required to card any patron
purchasing alcohol at this location. Mr. Plumb stated that they expect that 3.2% beer sales will be less
than 3% and that customers expect to see this item at Wal-Mart.
Judge Lane adopted Resolution 2013-11 approving an application from Wal-Mart Stores, Inc., for a
3.2% beer - off premise license at Walmart Market #3177, 4625 South Mason Street.

for a 3.2% beer - off premise license at 7-Eleven Store 35712H,
112 West Magnolia Street, Approved
Kevin Coates, attorney representative for 7-Eleven, Inc., stated he was ready to proceed.
Carol Johnson, representative for Esquire Petitioning, LLC, and Phil Desmuke, district manager for 7-
Eleven, Inc., were sworn. In response to a question from the Authority Ms. Johnson briefly described
the petitioning process. She stated 99% of those signed were in support of this application and that this
result is typical for 7-Eleven stores.
Mr. Desmuke, district manager, described the training required for all cashiers to complete before they
are allowed to operate a cash register. He stated they must achieve a 100% on that test annually. Mr.
Desmuke stated they use a Bars program to test cashiers for carding patrons. He stated any employee
found in violation of the liquor code or fail to card a Bars `secret shopper' twice, they are immediately
terminated. Mr. Desmuke described how alcohol sales are done in the store.
Judge Lane adopted Resolution 2012-08 approving an application from 7-Eleven, inc., for a 3.2% beer -
off premise license at 7-Eleven Store 35712H, 112 West Magnolia Street.
