Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held October 2, 2014 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Josh Golden, Liquor Enforcement Officer David Lindsay, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Approval of Minutes Judge Lane approved the minutes from September 4, 2014. Show Cause Hearing for Celli, Inc., dba The East Coast, 238 Linden Street, Stipulation Agreement Approved William Chelales, representative for Celli, Inc., stated he has had an opportunity to review the stipulation agreement. Mr. Chelales stated he has talked to his staff and that they have tightened up their procedures to ensure this does not happen again. Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($550.38 fine paid in lieu of suspension), with 10 days held in abeyance for 1 year for violating Regulation 47-900 of The Colorado Liquor Rules - Conduct of Establishment, Regulation 47-910 - Time of Consumption Prohibited, and for violating Chapter 3, Article III, Section 3-81 of the Fort Collins City Code, failing to report a disturbance on the licensed premises. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Celli, Inc., dba The East Coast, 238 Linden Street. Show Cause Hearing for Titi, Inc., dba Ti Bar, 104 East Laurel Street, Stipulation Agreement Approved Titima Tongbua, representative for Titi, Inc., stated she is the registered manager. She stated the employee responsible for this violation has been terminated and that all the other employees have attended training offered at District 1. October 2, 2015 Assistant City Attorney Scrulock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served (5220 fine paid in lieu of suspension), with 10 days held in abeyance for 1 year for violating Regulation 47-900 of The Colorado Liquor Rules - Conduct of Establishment, C.R.S. 12-47-901 - Unlawful Acts (1)(a) serving a visibly intoxicated person and undue noise. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Titi, Inc., dba Ti Bar, 104 East Laurel Street. Request of 1200 South Coffee, LLC, dba Cafe Vino to Change, Alter, or Modify the Licensed Premises at 1200 South College Avenue, Approved Mark Havens, representative for 1200 South Coffee, LLC briefly described the proposed changes. He stated adding this room will allow them to host larger events. Mr. Havens stated he has received several comments in support of this proposed modification of premise. Judge Lane approved the request of 1200 South Coffee, LLC dba Cafe Vino to change, alter, or modify the licensed premises at 1200 South College Avenue. Transfer of Ownership of Jay's Bistro, from An American Bistro, Ltd., to Jay's Bistro Ft. Collins, LLC, 135 West Oak Street, Approved Norman Vogel, representative for An American Bistro, Ltd., stated he holds several liquor licenses and that he has never had a liquor violation. He stated he requires his employees to card any patron ordering alcohol appearing to be under the age of 40 to present a valid ID. Mr. Vogel stated he is including the patio on the west side of the restaurant and that he is in the process of obtaining an encroachment permit. He stated they will have essentially the same hours as the previous owners and that they do not intend to make any additional changes to the premises other than the west side patio. Mr. Vogel stated he has a current copy of the liquor code on premise and that he is familiar with it. Judge Lane approved the transfer of ownership of Jay's Bistro, from An American Bistro, Ltd., to Jay's Bistro Ft. Collins, LLC, 135 West Oak Street. Hearing on a New Application from Creations by Bradley, LLC, for a beer and wine license at Downtown Artery, 254 Linden Street, Approved Kent Bradley, representative for Creations by Bradley, LLC, was sworn. He briefly described the premises. Ms. Bradley, manager, was sworn. She stated that only employees will have access to the liquor storage and that she and all employees will be TIP's certified. Ms. Bradley stated that any employee found in violation of the liquor code will be immediately terminated and that the employee handbook states that policy. 2 October 2, 2015 Ms. Bradley described the petitioning process and that businesses and residences were in support of this application. Judge Lane adopted Resolution 2014 - 020 approving a beer and wine license application from Creations by Bradley, LLC, dba Downtown Artery, 254 Linden Street. Hearing on a New Application from Bask Salon, LLC, for a beer and wine license at Bask Salon, 153 West Mountain Avenue, Approved Brandon Grebe, Kelly Schroyer, Steve Schreyer, representatives for Bask Salon, LLC, were sworn. Mr. Grebe described the premises and the concept of the business. He stated they will not be selling alcohol; only offering one free drink with each customer. Mr. Grebe stated the public will not be able to come in to purchase an alcoholic beverage. He stated there will a Bask Salon employee on premise at all times. Mr. Grebe stated any patron ordering an alcoholic beverage is carded if they appear to be under the age of 40 and that any employee found in violation of the liquor code will be immediately terminated. Ms. Schroyer briefly described the petitioning process. She sated there was only one person who voiced opposition to this application. Judge Lane adopted Resolution 20147 - 022 approving a beer and wine license application from Bask Salon, LLC, dba Bask Salon, 153 West Mountain Avenue. Adjournment p.m. l� l� Municipal Judge
