Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held July 16, 2014 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Robert Fink, Assistant City Attorney Aimee Jensen, Deputy City Clerk Matt Hahn, Liquor Enforcement Officer Approval of Minutes Judge Lane approved the minutes from July 3, 2014 Consent Agenda Request from An American Bistro. Ltd.. dba Jaay's to Change, Alter, or Modify the Licensed Premises at 135 West Oak Street. Judge Lane adopted the Consent Agenda. Registration of Shawn Michael O'Shaughnessy as Manager of Sonny Lubick Steakhouse, 4633 South Timberline Road. Approved Shawn Michael O'Shaughnessy, manager applicant, briefly described his background. He stated they have a current copy of the liquor code on premise. Mr. O'Shaughnessy stated if any employee found in an intentional violation of the liquor code will be immediately terminated. He stated they have a current copy of the liquor code on premise. Judge Lane approved Shawn Michael O'Shaughnessy as manager of Sonny Lubick Steakhouse, 4633 South Timberline Road. July 16, 2014 Registration of Tyler Joseph Charles as Manager of Enzio's Italian Kitchen, 126 West Mountain Avenue, Approved Tyler Joseph Charles, manager applicant, briefly described his background. He stated he has been with these owners for several years. Mr. Charles stated they require extensive training for all employees involved with the sale and service of alcohol. He stated he has two assistant managers, of which one of them are on premises. Mr. Charles stated that he has had experience with visibly intoxicated patrons. He stated any employee found in violation of the liquor code will likely be terminated. Judge Lane approved the registration of Tyler Joseph Charles as manager of Enzio's Italian Kitchen, 126 West Mountain Avenue. Registration of Kelly Stine as Manager of The Lodge at MacKenzie Place, 4751 Pleasant Oak Drive, Approved Dan Carr, attorney representing LB-MH Oakridge, LLC, stated Kelly Stine is requesting to be registered as the manager. He stated any employee found in violation of the liquor code will likely be termianted. Mr. Carr stated their policy is to card any patron ordering alcohol that appears to be under the age of 30. Ms. Stine stated that The Lodge at MacKenzie Place is only an event venue for their own events and not open to the public. Judge Lane approved the registration of Kelly Stine as manager of The Lodge at MacKenzie Place, 4751 Pleasant Oak Drive. Request from Suite 152, Inc., dba The Rec Room @ The Yeti to Change, Alter, or Modify the Licensed Premises at Suite 152, Building 23, Old Town Square, Approved Michael Campana, representative for Suite 152, Inc., stated this requested change is to allow for private events. In response to questions from the Authority, Mr. Campana detailed the requested changes. He stated the room has windows overlooking Trimble Court and that they will have one employee stationed at the door of the private event area. Mr. Campana stated they do not receive any comments against the requested changes. Judge Lane approved the request from Suite 152, Inc., dba The Rec Room @ The Yeti to change, alter, or modify the licensed premises at Suite 152, Building 23, Old Town Square. July 16, 2014 Tastings Permit Application from Neighborhood Liquors, LLC, dba Neighborhood Liquors, 4631 South Mason Street, Unit B2, Approved Karen Lowe, representative for Neighborhood Liquors, LLC, stated they have requested to be allowed to conduct tastings approximately once a month. In response to questions from the Authority, Ms. Lowe stated that either the two owners, or the one employee will be doing the tastings. She stated if they hue another employee that they will be required to complete TIP's training. Ms. Lowe stated the petitions indicate support from the neighborhood for this application. Judge Lane approved the Tastings Permit Application from Neighborhood Liquors, LLC, dba Neighborhood Liquors, 4631 South Mason Street, Unit Bl. Transfer of Ownership of Taipan Restaurant, from East Thai, Inc., to East Thai II, Inc., 144 North Mason Street, Unit 8. Approved Jeff Hsia, representative for East Thai, Inc., stated there are no physical changes to the restaurant. He stated he is on premise approximately 80 hours and has only one employee. Mr. Hsia stated when he hires another employee, he will require them to complete training. He stated the last training he completed was in 2011. Mr. Hsia stated he has a current copy of the liquor code on premise. Judge Lane approved the transfer of ownership of Taipan Restaurant, from East Thai, Inc., to East Thai II, Inc., 144 North Mason Street, Unit 8. Hearing on a New Application from The Fox and The Crow, LLC, for a beer and wine license at The Fox and The Crow, 2601 South Lemay Avenue, Suite #21, Approved Brian Proffit, attorney representing The Fox and The Crow, LLC, introduced the applicants. Susan Duffy Schwal, representative for Liquor Petitioning Professionals, LLC and Tina M. Mooney, representative for The Fox and The Crow, LLC, were sworn. Ms. Mooney detailed the premises and stated that they are hoping to open in October. She stated all her employee as well as the two owners have completed TIP's training. Ms. Mooney stated they have a training manual and that they are members of Responsible Alcohol retailers. She stated they will also keep a flip calendar with the correct date to determine who can legally purchase alcohol. Ms. Mooney stated they anticipate 80% of their sales will be from the sale of food. Ms. Schwal, representative for Liquor Petitioning Professionals, LLC was sworn. She described the petitioning process. Ms. Schwal stated that the five individuals that signed the petition in opposition were concerned about traffic, competition and proximity to residences. She stated these petition results indicate support for this application. July 16, 2014 Judge Lane adopted Resolution 2014-17 approving an application from The Fox and The Crow, LLC, for a beer and wine license, doing business as The Fox and The Crow, at 2601 South Lemay Avenue, Suite #21.
