Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held August 7, 2014 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bromvyn Scurlock, Assistant City Attorney Aimee Jensen, Deputy City Clerk Josh Golden, Liquor Enforcement Officer Stacey Aurzada, Special Prosecutor Approval of Minutes Judge Lane approved the minutes from July 16, 2014 Show Cause Hearing for Suite 152, Inc., dba The Rec Room & The Yeti, Building_23, Old Town Square, Stipulation Agreement Approved Michael Campana, representative for Suite 152, Inc., stated he has had an opportunity to review the stipulation agreement. Mr. Campana stated they have re-established a system where they use the form required by the Port Collins Police Department. Stacey Aurzada, Special Prosecutor, summarized the stipulation agreement. She stated the Licensee has agreed to a 7 day suspension, 3 days served ($1814.96 fine paid in lieu of suspension), with 4 days held in abeyance for 1 year for violating Chapter 3, Article III, Section 3-81 of the Port Collins City Code, failing to report a disturbance on the licensed premises and for violating C.R.S. 12-47-901(5)(a)(II)(A), failure to forward fraudulent proof of age to Police Services. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Suite 152, Inc., dba The Rec Room @ The Yeti, Building 23, Suite 152, Old Town Square. August 7, 2014 Request from Dreamscape, LLC dba Cheba Hut to Temporarily Change, Alter, or Modify the Licensed Premises, at 104 East Laurel Street on September 12, 2014, Approved Nick Pratt, general manager for Dreamscape, LLC, detailed the proposed temporary modification of premise. In response to a question from the Authority, Mr. Pratt stated this event will be more family friendly than previous events. He stated they have contacted a fence company to insure the proposed premises are fully contained. Judge Lane approved the request from Dreamscape, LLC dba Cheba Hut to temporarily change, alter, or modify the licensed premises at 104 East Laurel Street on September 12, 2014. Registration of Alexa Schmactenberger as Manager of Tokyo Joe's, 2519 South Shields Street, Suite C, Approved Alexa Schmactenberger, manager applicant, stated they require all patrons that order an alcoholic beverage are required to provide a valid identification. She stated each patron is only allowed two alcoholic beverages per visit. Ms. Schmactenberger stated that alcohol sale are a small percentage of their over all sales and that they have a current copy of the liquor code on premise. She stated she is on premise 50-55 hours perweek. Ms. Schmactenberger stated any employee found in violation of the liquor code is immediately terminated. Judge Lane approved the registration of Alexa Schmactenberger as manager of Tokyo Joe's, 2519 South Shields Street, Suite C. Registration of Jana Fiala as Manager of Tokyo Ioe's, 100 West Troutman Parkway, Approved Jana Fiala, manager applicant, stated she was the registered manager at the 2519 South Shields location and that Tokyo Joe's requires extensive training for all employees with respect to alcohol sales and service. She stated she is on premise 50-55 hours per week. Ms. Fiala stated any employee found in violation of the liquor code is immediately terminated. Judge Lane approved the registration of Jana Fiala as manager of Tokyo Joe's, 100 West Troutman Parkway. Transfer of Ownership of Nordy's Bar B Que & Grill, from Jada Foods, LLC, to Rocky Mountain Fishing Lodge, LLC, and Trade Name Change to The Lodge Sasquatch Kitchen at 151 North College Avenue, Approved Mike Laszlo, attorney representing, Rocky Mountain Fishing Lodge, LLC, stated he is ready to proceed. Aaron May, representative for Rocky Mountain Fishing Lodge, LLC, stated they are open 7 days a week August 7, 2014 and that there are approximately 45 employees. He described the changes that they have made to the premises since taking over from Nordy's. Mr. May stated they card anyone who orders alcohol and that after 9:00 p.m. the front door person is responsible for carding all the patrons. He stated any employee found in violation of the liquor code would likely be suspended, depending on the circumstances, otherwise, the employee would be terminated. Judge Lane approved the transfer of ownership of Nordy's Bar B Que & Grill, from Jada Foods, LLC, to Rocky Mountain Fishing Lodge, LLC, and Trade Name Change to The Lodge Sasquatch IGtchen at 151 North College Avenue. Hearing on a New Application from Las Isabeles, LLC, for a hotel -restaurant liquor license at La Buena Vida, 901 East Harmony Road. Unit 140, Approved Hugo Caballero, representative for Las Isabeles, LLC, was sworn. He stated he conducts training on the sale and service of alcohol every two weeks with his employee. Mr. Caballero stated all patrons that order an alcoholic beverages will be required to provide a valid identification. He stated approximately 80% of his gross sales come for the sale of meals. Mr. Caballero stated the patio will be fully enclosed and will be accessible only from inside the restaurant. He stated if an employee is found in violation of the liquor code they are immediately terminated. Mr. Caballero stated they received many comments in support of this application. He described how he instructed his staff to conduct the petitioning process. Judge Lane adopted Resolution 2014-15 approving a hotel -restaurant liquor license from Las Isabeles, LLC, dba La Buena Vida, 901 East Harmony Road, Unit 140. Hearing on a New Application from Uncle Vito's Too 2, LLC, for a beer and wine license at Uncle Vito's,1015 South Taft Hill Road, Unit I, Approved Richard Ochoa, representative for Uncle Vito's Too 2, LLC was sworn. He stated he is hoping to offer beer and wine at his restaurant. Mr. Ochoa stated any employee found in violation of the liquor code is immediately terminated. He stated customers have requested he serve beer and wine. Mr. Ochoa stated they offer sub sandwiches and wings in addition to pizza. He stated he expects his beer and wine sales to be approximately 10% of his gross sales. Mr. Ochoa stated any patron that orders an alcoholic beverage will be required to provide a valid id. He stated if they are presented with a fake id, then it will be confiscated. Ellyn Just, representative for Aggie Agency, was sworn. She described the petitioning process and results, stating these results indicate support for this beer and wine application. Judge Lane adopted Resolution 2014-19 approving a beer and wine license from Uncle Vito's Too 2, LLC, dba Uncle Vito's at 1015 South Taft Hill Road, Unit 1. August 7, 2014 Hearing on a New Application from Virtual Links Incorporated, for a beer and wine license at Virtual Links, 925 South Taft Hill Road, Approved Scott Smith, representative for Virtual Links Incorporated, was sworn. He briefly described the type of establishment Virtual Links will be, and emphasized that their primary business is an indoor golfing facility. In response to questions from the Authority, Mr. Smith described the premises. He stated beer and wine consumption will not be allowed in the simulators. Mr. Smith stated they are hoping to open in October. He stated he will complete TIP's training and require all his employees to be also TIP's trained. Mr. Smith stated that any patron ordering an alcoholic beverage will be required to provide a valid id. He stated an employee found in violation of the liquor code will likely be suspended for the first offense. Mr. Smith described the petitioning process. He stated they received supportive comments. Judge Lane adopted Resolution 2014-18 approving a beer and wine license from Virtual Links Incorporated, dba Virtual Links, 925 South Taft Hill Road.
