Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held February 6, 2014 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Aimee Jensen, Deputy City Clerk Mark Climovici, Liquor Enforcement Officer Josh Golden, Liquor Enforcement Officer Approval of Minutes Judge Lane approved the minutes from January 15, 2014, December 16, 2013 and November 4, 2013. Consideration of Resolution 2014-04 Repealing the Local Licensing Authority's Rules of Procedures in their entirety, Adopted Judge Lane adopted Resolution 2014-04 Repealing the Local Licensing Authority's Rules of procedures in their entirety. Annual Report for 2013 Judge Lane approved the 2013 Annual Report. Show Cause Hearing for Stump and Lump, Inc., dba Luc4Joe's Sidewalk Saloon, 25 Old Town Square, Stipulation Agreement Approved Tim Dow, attorney representing Stump and Lump, Inc., stated he has had an opportunity to review the stipulation agreement with the licensee and that they are ready to proceed. Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 14 day suspension, 5 days served ($1373.46 fine paid in lieu of suspension), with 9 days held in abeyance for 1 year for violating City Code 3-81, failing to report a disturbance on the licensed premises. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Stump and Lump, Inc., dba Lucky Joe's Sidewalk Saloon, 25 Old Town Square. February G, 2014 Registration of Kevin A. McDevitt as Manager of Serious Texas Bar-B-Q, 1820 North College Avenue, Unit 180, Approved Kevin Devitt, manager applicant, stated he has been working for this company for 7 years. He stated the last training he received was approximately 2 years ago and is similar to TIP's training. Mr. Devitt stated he supervises 20 employees and that 90% of them are involved with the sale and service of alcohol. He stated any patron ordering an alcoholic beverage that appears below the age of 40 are required to present a valid id. Mr. Devitt stated any employee found in violation of the liquor code is immediately terminated. In response to a question from the Liquor Enforcement Officer, Mr. Devitt briefly described the training they are required to complete on an annual basis. Judge Lane approved the registration of Kevin A. McDevitt as Manager of Serious Texas Bar-B-Q,1820 North College Avenue, Unit 180. Hearing on a New Application Pour Bros, LLC, for a hotel -restaurant liquor license at Pour Brothers, 220 Linden Street, Approved Aria Khosravi and Alan Blue, representatives for Pour Bros, LLC, were sworn. Mr.Khosravi stated that he and Mr. Blue stated that they intend to be on premise full-time. He detailed the operation and hours of their proposed business. Mr. Khosravi stated any employee found in violation of the liquor code will be immediately terminated if found in violation of the liquor code. He stated he will review liquor laws with their staff at monthly meetings. Mr. Khosravi stated they intend to employ 8-10 employees and that the patio is easily visible from inside the restaurant. He stated the patio will be closed at 10:00 p.m. per their lease. Mr. Khosravi stated they will have a door person checking id's in the evenings and that they will not accept any vertical id's. He stated any patron ordering an alcoholic beverage that appears to be under the age of 40 must present a valid id. Max Scott, representative for Oedipus, Inc., was sworn. He briefly described the petitioning process. Mr. Scott stated he was asked to concentrate canvassing in the downtown area. He detailed the results of the petition. Mr. Scott stated this result is common along the Front Range. Al Dunton, party in interest, was sworn, stated he resides and operates a business at 233-235 Linden Street. He stated that within a one block area there are 18 liquor licenses. Judge Lane approved Resolution 14-03 approving an application from Pour Bros, LLC for a hotel - restaurant liquor license at Pour Brothers, 220 Linden Street. February G, 2014 Hearing on a New Application from Empire Dim Sum Seafood Restaurant, LLC, for a beer and wine license at Empire Palace, 2721 South College Avenue, #413, Approved Chun Yan Jiang, representative for Empire Dim Sum Seafood Restaurant, LLC, and Telelanguage Interpreter was sworn. Ms. Jiang stated she has had alcohol service training through the Loveland Police Department two years ago and that she has been in the restaurant business for 10 years. She stated customers have requested that she have beer and wine available and that she expects most of her revenue to still come from the sale of meals. Ms. Jiang stated her hours of operation are Monday through Thursday 11:00 a.m. to 10:00 p.m., Friday, Saturday and Sunday 11:00 a.m. through 11:00 p.m. She stated she may remain open later if business increases. In response to a question from the Authority, Mr. Jiang detailed the premises and stated that she does not have an outdoor patio. Ms. Jian stated she has approximately 8 employees and that when she is not on premise, her husband is. She stated he has not completed alcohol service training and that two of her employees have attended Liquor Enforcement Officer Clitnovici's training. Mr. Jiang stated any patron ordering an alcoholic beverage will be required to provide a valid id. She stated she has a current copy of the liquor code on premise and that she understands she will need to attend training prior to serving alcohol. Ms. Jiang stated that everyone she petitioned was in support of this application. She stated she did the second set of petitions herself. Judge Lane adopted Resolution 2014-02 approving an application from Empire Dim Sum Seafood Restaurant, LLC, for a beer and wine license at Empire Palace, 2721 South College Avenue.
