Judge Kathleen M. Lane presiding. Staff in attendance: Jenny LopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Kyle Bendzsa, Liquor Enforcement Officer Mark Clitnovici, Liquor Enforcement Officer Approval of Minutes Judge Lane approved the minutes from January 9, 2012. Transfer of Ownership of Two Pairs Party Spa, 115 East Mountain Avenue, from Serenity Waters, Inc., to Lounge Unspa II, LLC, and Trade Name Change to SheShe Beauty Bar, Approved Susan Bynum, representative for Lounge Unspa II, LLC, briefly described her background. She stated she will be TIP's trained and that any -employees that will be serving alcohol will also require to be TIP's trained. Ms. Bynum stated they are only making cosmetic changes. In response to a question from the Authority, Ms. Bynum described where she stores the alcohol. She stated she has 6 employees and anticipates increasing that number to 15. Ms. Byrum stated they will not be open past 7:00 p.m. She stated if she is not on premise, then she will have an assistant manager on premise. Judge Lane approved the transfer of ownership Of Two Pairs Parry Spa, 115 East Mountain Avenue, from SerenityWaters, Inc., to Lounge Unspa II, LLC and Trade Name Change to SheShe Beauty -Bar. Transfer of Ownership of Sports eXchange, 214 Linden Street from Sports eXchange, LLC to ABD, and Trade Name Change to Wall Street Bar and Grill, Approved David Tanner, representative for ABD, briefly described his experience. He stated he has managed several different restaurants in Tempe Arizona. Mr. Tanner stated he has been on premise under the previous owner, as a potential buyer, examining the books and how it was operated. He stated he is only making decor changes. Mr. Tanner stated he will be open from 11:00 a.m. to 2:00 a.n-L and that he has approximately 10 employees. He stated the public does not have access to the second floor. Mr. Tanner stated that all his employees are TIP's trained. He stated on busy nights he will have security. Mr. Tanner stated everyone will be carded. He stated patrons must be 21 to enter and if they leave, they must show their id again. Mr. Tanner stated he has implemented a strict dress code. January 23, 2012 He stated any employee found in violation of the liquor code will be immediately terminated. Mr. Tanner stated that patrons are not allowed to order more than two drinks at a time. He stated his door personnel are required to make sure occupancy levels are within legal limits. Mr. Tanner stated he has changed and eliminated the drink "specials and that he has revised the menu. In response to questions to Assistant CityAttomeyLopezFilkins, Mr. Tanner stated Brittney O'Daniel and Aaron Von Blarcum will not have any ownership interest or be employed by ABD. Judge Lane approved the transfer of ownership of Sports eXchange, 214 Linden Street from Sports eXchange, LLC to ABD, and Trade Name Change to Wall Street Bar and Grill, contingent upon BritmeyO'Daniel and Aaron Von Blarcum are not employed and will not have any ownership interest by ABD. Hearing on a New Application from Pacific Islander, Inc., for a retail liquor store license at JB's Convenience Store, 710 East Magnolia Street, Approved Clan Chung, representative for Pacific Islander, Inc., was sworn. He stated he has been honorably discharged from the military and that he is a responsible business man. Mr. Chung stated he has been at this location for 20+ years and that his customers have frequently asked him to provide this service. In response to a question from the Authority, Mr. Chung stated Poudre Fire Authority has signed off on this premise. He stated he will have two part time employees and that he will always have two employees on premise when he is open. Mr. Chung stated he intends to be TIP's certified before he opens and that he intends to be open some time in March. He stated he will card anypatron that looks like theyare 50 years of age or younger. Mr. Chung stated anyemployee found in violation of the liquor code will be immediately terminated. He stated his wife will eventually be TIP's trained and involved in the day to day operation. Ellyn Just, petitioner, was sworn. She brieflydescribed the petitioning process and that she allowed they could sign the petitions for and against this application. Ms. Just stated many of the people she petitioned were familiar with Mr. Chung and JB's Convenience Store. Judge Lane adopted Resolution 2012-01 approving an application from Pacific Islander, Inc., fora retail liquor store license at JB's Convenience Store, 710 East Magnolia Street.
