HomeMy WebLinkAbout2009 - Zoning Board Of Appeals - Annual ReportZONING BOARD OF APPEALS 2009 ANNUAL REPORT BACKGROUND: The Zoning Board of Appeals consists of seven members. Meetings are held the second Thursday of every month in the Council Chambers at City Hall. The Board may also meet as needed in order to convene special meetings. Members who served in 2009 are Dwight Hall, David Shands, Michael Bello, Dana McBride, Alison Dickson, Ron Daggett, Jim Pisula, and Peter Bohling. Peter Bohling was appointed in July, 2009 to fill the vacancy created when David Shands moved out of the state. The annual election of officers resulted in Dwight Hall being re-elected as chairperson and Alison Dickson replacing Dana McBride as vice-chairperson. Council liaison to the Board during 2009 was Kelly Ohlson. Staff support was provided by Peter Barnes, Sue Houseal, and Paul Eckman. 2009 YEAR IN REVIEW: • During 2009, the Zoning Board of Appeals (ZBA) acted on twenty-six variance requests to the City Land Use Code, compared to thirty-eight in 2008 and twenty- seven in 2007. Twenty-four of the variance requests were approved and two were denied. Fourteen of the approved variances were granted with conditions. No decisions of the Board were appealed to City Council. • In addition to the twenty-six variance requests, the ZBA heard one appeal of a staff interpretation. Specifically, staff had determined that a wall mural that had been painted on a building constituted a sign rather than a work of art, and as such, did not comply with the sign code. The owner of the business appealed this interpretation, and after considerable discussion the ZBA upheld staff’s determination that the mural was a sign. • In addition to the variance requests and the interpretation appeal, the Board also spent time reviewing proposed Land Use Code amendments and providing staff with comments and input regarding the comprehensive code change ordinance.
