The following members were present: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Absent: Norton. Staff Members Present: Rita Knoll Harris, City Clerk's Office Marty Heffernan, CityAttorney's Office Sandy Gibson, Police Department Consent Calendar The Consent Calendar is intended to expedite the meeting and allow the Authority to spend its time and energy on the important items on a lengthy agenda. Items on the Consent Calendar are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Calendar and considered separately. Items pulled from the Consent Calendar will be considered separately immediately following adoption of the Consent Calendar. 1. Approval of the minutes of the January 26, 1994 regular meeting. Authority member Schroeer made a motion, seconded by Authority member Cooper to adopt and approve the items on the Consent Calendar. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Consideration of an Application from Neighbor to Neighbor, Inc., for a Special Events Permit at the Opera Galleria, 123 North College Avenue, on April 7, 1994, Approved Rex Thomas, representative for Neighbor to Neighbor, Inc., described the event. He stated all proceeds will go to Neighbor to Neighbor, Inc. In response to a question from the Authority, Mr. Thomas stated Neighbor to Neighbor, Inc., provides transition housing. Mr. Thomas described their carding policies. He stated they will have security guards and trained servers checking id's at February 23, 1994 the door and at the time of service. Mr. Thomas stated their maximum capacity of 500 and that this is a family oriented event. He stated this year's event will be for adults only. Authority member Schroeer made a motion, seconded by Authority member Crowfoot to approve the application from Neighbor to Neighbor, Inc., for a Special Events Permit at the Opera Galleria, 123 North College Avenue, on April 7, 1994. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Request from MCP, Inc., dba Tangz, 1220 West Elizabeth, to Change, Alter, or Modify the Premises, Approved Zach Wilson, attorney representing MCP, Inc., stated they are resubmitting their request to modify the premises after addressing concerns the Authority had last summer. Mr. Wilson stated this request will increase their occupancy by 50-100. He stated the 10 foot chain link fence will constantly be supervised. Mick McKeon, manager, was sworn. He stated he is familiar with the neighborhood, that most of the residences are college students. Mr. McKeon stated he is not aware of any other facility that offers volleyball courts. He stated he is TIP's trained and described his duties as the manager. Mr. McKeon stated everyone is carded at the door and that they confiscate any fake id's. In response to a question from the Authority, Mr. McKeon described incidents where the Fort Collins Police Department was called. He stated the only entrance to the volleyball pit will be through the establishment and that all patrons must be 21 years of age or older. Mr. McKeon stated they will occasionally have 18 and over nights. He stated the volleyball pit will be closed at 10:00 p.m and that he will have to add lighting to the area. Mr. McKeon stated when the volleyball courts are open he will add 5 doormen to the staff. Steve Carlyle, Tangz employee, was sworn. He described the petitioning process, noting that all signatures were in support of this application. Joel Tower, Fort Collins Police Liquor Enforcement Officer, was swom. Liquor Enforcement Officer Tower described the history of this establishment, stating he has concerns about this establishment returning to a "Gator's" type of atmosphere. He stated he has had conversations with Poudre Fire Authority and Building Inspection regarding occupancy loads. Officer Tower stated there are on going problems with litter and vandalism. Timothy Johnson, representative for St. Paul's Episcopal Church, was sworn. He stated the church opposes this application, citing on -going vandalism and damage to their landscape. Tom Koulos, St. Paul's Episcopal Church member, was sworn. He stated he considers the fence around Tangz to be an eyesore and that Tangz is not a model neighbor, citing vandalism Attorney Zach Wilson requested that the Authority postpone consideration of this application to the Authority's March 23, 1994 meeting to address occupancy and vandalism issues. 2 February 23, 1994 Authority member Cooper made a motion, seconded by Authority member Crowfoot to postpone the request from MCP, Inc., dba Tangz, 1220 West Elizabeth, to change, alter, or modify the premises to March 23, 1994. Yeas: Cooper, Crowfoot, Poncelow, and Schroeer, Nays: Mael.and Wawro. THE MOTION CARRIED. Transfer of Ownership of E1 Jacalito Restaurant, 134 South College, and Trade Name Change to Bivian's, Approved Bivian Mercado, applicant, was sworn. He briefly described his plans for the establishment. Mr. Mercado stated there will table service and that alcohol will not be served after 9:30 p.m He stated he has a current copy of the liquor code and will schedule a meeting with Liquor Enforcement Officer Tower. Mr. Mercado stated this is a family business with some outside help. In response to a question from the Authority, he briefly described the patio area. Authority member Crowfoot made a motion, seconded by Authority member Mael to approve the transfer of ownership of El Jacalito Restaurant, 134 South College Avenue, from Jose Luis Fuene to Bivian Mercado and trade name change to Bivian's. Authority member Schroeer made a motion, seconded by Authority member Crowfoot to approve the application from Neighbor to Neighbor, Inc., for a Special Events Permit at the Opera Galleria, 123 North College Avenue, on April 7, 1994. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro. Nays: None. THE MOTION CARRIED. Hearing on a New Application from Hyung Bo Kim for a beer and wine license at Korean Restaurant Kim's at 400 East Olive Street, Approved Hyung Bo Kim, applicant, was swom. He stated he will be open Monday through Saturday and that he has had no liquor code violations. Mr. Kim stated this is a family run business and that they will have only a few employees. He stated they will serve alcohol at the bar only and that they will only have 2-3 tables on the patio. Nell Swiers, Market Service Associates, was sworn. He described the petitioning effort, stating that the neighborhood demonstrated support for this application. Authority member Schroeer made a motion, seconded by Authority member Crowfoot to adopt Resolution 94-02 approving an application from Hyung Bo Kim for a beer and wine license at Korean Restaurant - Kim's, 400 East Olive Street. Yeas: Cooper, Crowfoot, Mael, Poncelow, Schroeer, and Wawro.
