Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authoritywas held on October 18, 2010 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant CityAttorney Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated there were no changes to the agenda. Approval of Minutes Judge Lane approved the minutes from September 20, 2010. Show Cause Hearing for Fitzgerald's, LLC dba The Vault, 146 North College Avenue, Stipulation Agreement Approved Bronwyn Scurlock, Assistant City Attorney, summarized the stipulation agreement. She stated the Licensee has agreed to a 30 day suspension, 7 days served, with 23 days held in abeyance for 1 year for violating the Colorado Code of Regulations Section 47-900, conduct of establishment, bybreaking into the licensed establishment that had been seized by the State of Colorado for non-payment of taxes to sell and serve alcohol. Rick Thomas, representative for Fitzgerald's, LLC, stated he has had a chance to review and sign the stipulation agreement. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented Fitzgeral'ds, LLC, dba The Vault, 146 North College Avenue. Registration of Michael Bowles as Manager of Smashburger, 2550 East Harmony Road, # 100, Approved Michael boyles, manager applicant, briefly described his training. He stated he has 1 assistant manager and 3 supervisors who are also required to complete the same training he is required to complete. Mr. Boyles stated he reminds his staff on a weekly basis the importance of carding patrons that order an October 18, 2010 alcoholic beverage. He stated anyemployee found in violation of the liquor code could be terminated. Mr. Boyles stated he will provide a copy of the training manual to Deputy City Clerk Jensen within 2 weeks. Judge Lane approved the registration of Michael Bowles as manager of Smashburger, 2550 East Harmony Road, # 100. Registration of Angela Harper as Manager of Hilton Garden Inn, 2821 East Harmony Road, Approved Angela Harper, manager applicant, stated she has received extensive training in the sale and service of alcohol and that all her employees selling or serving alcohol is 11P's certified. She stated any employee found in violation of the liquor code could be terminated. Ms. Harper stated she has a current copy of the liquor code on premise. Judge Lane approved the registration of Angela Harper as manager of Hilton Garden Inn, 2821 East Harmony Road. Hearing on a New Application from Hunab Productions, LLC, for a beer and wine license at Falbo's Bros Pizza, 822 South College Avenue, Approved Luke Mescher, representative for Hunab Productions, Inc., was sworn. He stated he is a franchisee and that this will be more a `dine -in' style restaurant. Mr. Mescher stated he is now living permanently in Fort Collins and will be sure he is trained in the sale and service of alcohol prior to opening. He stated the point of sale system will require a manager to sell beer or wine. In response to questions from the Authority, Mr. Mescher detailed the premises. He stated when the patio is open he will have an employee stationed outside to monitor the patio. Mr. Mescher stated he will use more permanent We fencing to surround the patio area. He stated he will be open until 3:00 a.m., however the cash register will not allow alcohol sales after 1:30 a.m. Mr. Mescher stated his manager is TTP's trained. Mr. Mescher stated he and the manager circulated petitions. He stated he received many positive comments in support of this application. Judge Lane adopted Resolution 2010-11 approving the beer and wine application from Hunab Productions, LLC, dba Falbo Bro's Pizza at 822 South College Avenue. Adjournment Municipal Judge
