Judge Kathleen M. Lane presiding. Staff in attendance: jenny LopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated the new application from The Rumbar, LLQ for a hotel -restaurant liquor license at The Rum Bar & Grill, at 221 Jefferson Street and manager registration of Lindsay Janzen has been withdrawn by the applicant. Approval of Minutes Judge Lane approved the minutes from June 21, 2010. Show -Cause Hearing for Toast of the Town, Inc., dba Toast of the Town, 417 West Magnolia Avenue, Order Approved Assistant City Attorney LopezFilkins summarized the stipulation agreement. She stated that the Licensee has failed to respond by phone or by letter. Assistant City Attorney LopezFilkins reviewed the Order to Suspend: That on or about April 11, 2010, Licensee or its agenda or employee allowed patrons to take their alcoholic beverages including wine, beer and mixed drinks outside of the designated premises in violation of C.R.S. §12-47-901(h)(I), and Colorado Code of Regulations, 1 CCR 203-2, section 47-918. 2. That the Citysent notice of its motion to revoke or suspend and request for show cause hearing to the last known address for Licensee on June 23, 2010. 3. That Aimee Jensen, Deputy City Clerk, left a voice mail for licensee regarding the July 192 2010 hearing date. 4. That Licensee failed to respond by phone or letter. 5. That Licensee failed to appear in person at the hearing on July 19, 2010. 6. The City appeared. 7. That upon information and belief provided by Officer Younger, Licensee is not currentlyoperating, and will not be operating until the re -opening of the Lincoln Center, which is currently under renovation. Judge Lane ordered that the Licensee's license be suspended for seven (7) days effective on a date to be determined when the Lincoln Center re -opens. Request from Full Pull, LLC, dba Moe's Original Bar-B-Que to Change, Alter, or Modify the Licensed Premises at 181 North College Avenue, Approved Ted Schneider, representative for Full Pull, LLC briefly described the changes, noting that he is adding a back patio. In response to a question from the Authority, Mr. Schneider stated he does not own the building. He stated he has permission from the owner of the building to extend his licensed premises to the back of the building. Mr. Schneider stated he will have staff monitoring the back patio to ensure he is in compliance with all liquor laws. Judge Lane approved the request from Full Pull, LLC, dba Moe's Original Bar-B-Que to Change, Alter, or Modify the Licensed Premises at 181 North College Avenue. Registration of Bryan Kaiser as Manager of HuHot Express, 2720 Council Tree Lane, Suite 184, Approved Bryan Kaiser, manager applicant, briefly described his background. He stated he will be responsible for training of the servers that will sell and serve alcohol. Mr. Kaiser stated he has received extensive training from the owners of HuHot Express. He stated servers are continually walking throughout the dining area. Mr. Kaiser stated he has a current copy of the liquor code on premise. Judge Lane approved the registration of Bryan Kaiser as manager of HuHot Express, 2720 Council Tree Lane, Suite 184. Hearing on a New Application from Sandoval Family Enterprise, LLC for a hotel -restaurant liquor license at Senor Camaron, 2721 South College Avenue, # 2, Approved Mariano Sandoval, representative for Sandoval Family Enterprise, LLC, was swom. He stated he and his staff have already received training regarding the sale and service of alcohol from Liquor Enforcement Officer Bob Younger. Mr. Sandoval stated this will be a sit-down restaurant, with wait staff taking orders. He stated he projects that the sale of meals will be approximately 60%. Mr. Sandoval stated all the alcohol will be stored in the bar. In response to a question from the Authority, Mr. Sandoval detailed the premises. He stated he intends to do all the training, however, he will hire a professional trainer to train employees in the sale and service of alcohol. Mr. Sandoval stated theywill check the id's of everyone that appears to be 40 years of age or younger. Pi Susan Duffy Quall, representative for Liquor Licensing Professional, was sworn. She described the petitioning process, emphasizing to her employees that they are to remain impartial when asking for a signature. Ms. Quall stated 100% of the businesses were in favor of this application, with 97% of the residences in support of this application. Parties in interest were sworn in. Michael Stolz, 2721 South College, spoke in support of this application. Mr. Mearis, owner of the Fig Leaf, 2700 South College Avenue, was in support of this application. Rob Hoffman, Everitt Companies, representative for the landlord, stated he is in support of this application and that it is very clear this is a family run operation. Dave McCloud, 260 East Horsetooth, is support of this application. Susan Schultz, 2700 Stanford, spoke in support. Jessica Yoder, 2735 Stover Street, spoke in support. Judge Lane adopted resolution 2010-08 approving an application from Sandoval Family Enterprise, LLC, for a hotel -restaurant liquor license at Senor Camaron, 2721 South College Avenue, # 2. Hearing on a New Application from Rockies Food, LLC, for a beer and wine license at Krazy Karl's Pizza, 1124 West Elizabeth Street, Approved Karl Mobley and Glen Haas, representatives for Rockies Food, LLC, were swom. In response to a question to Mr. Mobley, he stated they expect beer and wine sales to be only 10%. Karl stated he has had 30+ years in the restaurant business. He stated he will require all patrons that order alcohol to present an id. Mr. Mobley stated he has a current liquor code on premise. Mr. Mobley briefly described the petitioning process. He stated that the response over-all showed positive support for this application. Judge Lane adopted resolution 2010-07 approving an application from Rockies Food, LLC, for a beer and wine license at KrazyKarl's Pizza, 1124 West Elizabeth Street.
