Staff Liaison: Aimec Jensen A regular meeting of the Liquor Licensing Authority was held on January 7, 2013 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bromvyn Scurlock, Assistant City Attorney Aimee Jensen, Deputy City Clerk Mark Climovici, Liquor Enforcement Officer Approval of Minutes Judge Lane approved the minutes from December 17, 2012. Consent Agenda a. Request from Mountain Creole, Inc., dba Lucile's to Change, Alter or Modify the License Premises at 400 South Meldrum. b. Request form M.H. Mall, Inc., dba Avogadro's Number to Change, Alter, or Modify the Licensed Premises at 605 South Mason. Judge Lane approved the request from Mountain Creole, Inc., dba Lucile's to change, alter or modify the licensed premises at 400 South 1Dfeldrum and the request from M.H. Mall, Inc., dba Avogadro's Number to change, alter, or modify the licensed premises at 605 South Mason. Show Cause Hearing for Young's Cafe, LTD., dba Young's Cafe, 3307 South College Avenue, #114 Stipulation Agreement Approved Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($269.55 fine paid in lieu of suspension), with 10 days held in abeyance for 1 vear for violating C.R.S. 12-47-901(1)(a.5)(I), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Brad March, attorney representing Young's Caf6, LTD., stated he and his client have had an opportunity to review the stipulation agreement. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Young's Cafe, LTD., dba Young's Cafe, 3307 South College Avenue, #114. January 7, 2013 Show Cause Hearing for Hunab Productions, LLC, dba Falbo's Bros Pizza, 822 South College Avenue, Stipulation Agreement Approved Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension), with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a.5)(I),permitting the sale or service of alcohol beverages to a person under the age of 21 years. Luke Mescher, representative for Hunab Productions, LLC, stated the employee that sold to the underage operative was immediately terminated. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Hunab Productions, LLC, Falbo's Bros Pizza, 822 South College Avenue. Show Cause Hearing for South China Restaurant II, LLC dba South China Restaurant, 4613 South Mason Street, Stipulation Agreement Approved Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension) with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a.5)(I), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Damon Searles, representative for South China Restaurant II, LLC, stated this employee has been with the restaurant for many years and has been disciplined. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for South China Restaurant, LLC, dba South China Restaurant, 4613 South Mason Street. Show Cause Hearing for American Pizza Partners, LP, dba Pizza Hut Restaurant, 4643 South Mason Street, Stipulation Agreement Approved Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served (5200 fine paid in Geu of suspension) with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a.5)(1), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Chance Fiala, representative for American Pizza Partners, LLC, stated the employee that sold to the underage operative was immediately terminated. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for American Pizza Partners, LP dba Pizza Hut Restaurant, 4643 South Mason Street. January 7, 2013 Show Cause Hearing for Jimmy C's, LLC dba Jimmy C's Traditional British Fish & Chips, 2722 South College Avenue, Stipulation Agreement Approved Assistant City Attorney Scurlock summarized the stipulation agreement. She stated the Licensee has agreed to a 15 day suspension, 5 days served ($200 fine paid in lieu of suspension) with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a.5)(I), permitting the sale or service of alcohol beverages to a person under the age of 21 years. James Comer, representative for Jimmy C's, LLC, stated the employee that sold to the underage operative was immediately terminated. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Jimmy C's, LLC, dba Jimmy C's Traditional British Fish & Chips, 2722 South College Avenue. Registration of John Renz as Manager of Noodles & Company, 4733 South Timberline Road, Suite 104, Approved John Renz, manager applicant, stated he has been the manager at this location in the past. He stated he has completed ServSafe training within the last two years. Mr. Renz stated that Noodles has comprehensive training for all employees that are involved with the sales and service of alcohol. He stated all patrons ordering an alcohol beverage are required to present a valid id. Mr. Renz stated any employee found in violation of the liquor code is immediately terminated. He stated they have a current copy of the liquor code on premise. Judge Lane approved the registration of John Renz as manager of Noodles & Company, 4733 South Timberline Road, Suite 104. Hearing on a New Application from Liquor Kabinet, Ltd., for a retail liquor store license at Liquor Kabinet, 3035 West Prospect Road, Approved Woodrow Saunders and Jennifer Dartez, representatives for Liquor Kabinet, Ltd., was sworn. Mr. Saunders stated he has been the manager at Saddle Up Liquors for 19 years. Ms. Dartez stated she will be TIP's certified by the time they open the store. Mr. Saunders stated he has never had a liquor code violation while working at Saddle Up Liquors. He is hoping they can open by February 1, 2013. In response to a question from the Authority, Mr. Saunders described the premises. He stated he cards everyone that appears to be 40 years of age and younger. Ms. Dartez stated she will be carding every patron as she does not have the experience with carding patrons as Mr. Saunders. Mr. Saunders stated they will have a current copy of the liquor code on premise when they open. Mr. Saunders briefly described the petitioning process. He stated he encouraged individuals who were against this application to sign the petition indicating their desires. Mr. Saunders stated they received many comments in support of this application. Judge Lane adopted Resolution 2013 - 01 approving a new application from Liquor Kabinet, Ltd., for a retail liquor store license at Liquor Kabinet, 3035 West Prospect Road. e Adjournment Municipal Judge January 7, 2013
