A regular meeting of the Liquor Licensing Authority was on June 22, 2009 in Municipal Court, 215
North Mason. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated that there were no changes to the agenda.
Approval of Minutes
Judge Lane approved the minutes from June 15, 2009.
Hearing on a New Application from Donoho Beer and Spirits, LLC,
for a retail liquor store license at Donoho Beer and Spirits,
4562 Denrose Court, Approved
Aaron Donoho, representative for Donoho Beer and Spirits, LLC, was sworn. He stated he lives in
the area and saw a need for a retail liquor store for this neighborhood. Mr. Donoho stated all his
employees will be trained. He stated any employee found in violation of the liquor code will be
immediately terminated. Mr. Donoho stated he has hired individuals that have had extensive
experience in the sale and service of alcohol. He stated he has a current copy of the liquor code on
premise.
Carol Johnson, representative for Esquire Petitioning, LLC, was sworn. She briefly described the
petitioning process. Ms. Johnson stated this is a high result for a retail liquor store license
application.
Judge Lane adopted Resolution 09-05 approving a new application from Donoho Beer and Spirits,
LLC, for a retail liquor store license at Donoho Beer and Spirits, 4562 Denrose Court.

Hearing on a New Application from Zuba, Inc.,
for a beer and wine license at Deja Vu Coffeehouse,
4562 Denrose Court, Approved
Noha Abraham, representative for Zuba, hic., was sworn. She stated her background is as a scientist
and plans on becoming TIP's trained. Ms. Abraham stated her customers have requested beer and
wine to be served. She stated she will likely not be open past 10:00 p.m. on the weekends. In
response to a question from the Authority, Ms. Abraham described the premises and stated she has
installed security cameras on the back patio. She stated she will be on premise every evening if the
license is granted. Ms. Abraham stated she has informed her employees that everyone is carded and
that all her employees will be required to attend training prior to serving. She stated that she will
acquire a current copy of the liquor code to be maintained on premise. Ms. Abraham briefly
described the petitioning process, that she received comments in support of this application.
Judge Lane adopted Resolution 09-08 the application from Zuba, Inc., for a beer and wine license
at Deja Vu Coffeehouse, 646 South College Avenue.
Consideration of an Application from
Diamond Peaks Mountain Bike Patrol
for a Special Events Permit at the Oxbow Property, 418 Linden Street, Approved
Barb Allen, representative for Diamond Peaks Mountain Bike Patrol, briefly described the Tour de
Fat event. She stated this year they will end beer sales at 4:00 p.m. Ms. Allen stated the fencing they
are using this year will prevent beer from being passed off the enclosed premise. She stated they are
increasing the amount of security staff and number of port -a -potties. Ms. Allen stated that they have
staff specifically assigned to taking decibel readings every 15 minutes. She detailed security
assignments, specifically addressing keeping traffic out ofthe Buckingham neighborhood. Ms. Allen
stated this was also in place last year.
Judge Lane read several letters in support of this application.
In response to Assistant City Attorney LopezFilkins, Ms. Allen stated volunteers measuring the
decibel levels will report back to the soundboard if there needs to be an adjustment throughout the
event.
David Kemp, City Bicycle Coordinator, was swom. He presented a document endorsed by the City
Council to promote bicycling from the community perspective.
Alicia Cepaitis, resident of 220 151 Street, was sworn. She stated she has lived at this address for 5
years and supports this application.
Betty Aragon-Mitotes, president of the Buckingham Neighborhood, was sworn. She stated she is
not here to oppose this event, however, she is expressing concern at how large this event has become.

Ms. Aragon-Mitotes inquired how much larger will this event become before it is moved to another
location. She stated she wants to make sure that the residents in opposition to this application in the
Buckingham Neighborhood are heard and asked the Authority to take their concerns into
consideration. Ms. Aragon-Mitotes acknowledged that they have received complaints regarding their
event held May 29, 2009, stating that they will be moving the event in the future. She stated she has
a petition with 32 signatures from the Buckingham Neighborhood opposing this application.
Gloria Gomez, 215 2nd Street, was sworn. She stated she had problems with parking in her
neighborhood during this event.
Elaine Bueno, 216 2"d Street, was sworn. She stated she has had many problems with intoxicated
bicyclists, traffic through the Buckingham Neighborhood, and lewd costumes.
Norberto Valdez, professor at CSU, was sworn. He stated he is interested in gentrification of this
neighborhood and sustainable development. Mr. Valdez stated he is in opposition to this application.
Kim Jordan, CEO of New Belgium, was sworn. She detailed the extensive efforts her company has
made in being respectful of the Buckingham Neighborhood. Ms. Jordan described the impact the
4"' of July celebration has on her City Park neighborhood.
Diana Vaca, 228 1" Street, was sworn. She stated she has had problems with intoxicated bicyclists
and trash in her yard.
Robert Younger, Liquor Enforcement Officer, was sworn. He stated many ofhis concerns have been
adequately addressed. Liquor Enforcement Younger stated New Belgium has bent over backwards
in responding to his concerns. He stated he and New Belgium staff will address individual issues
as they arise the day of the event. Liquor Enforcement Younger stated on -duty officers will be
working closely with New Belgium staff and security.
Ms. Allen stated she will have nearly 400 volunteers helping with this event in addition to the
security staff. She stated all volunteers and security staff will be wearing identifiable vests. Ms.
Allen stated the staff that sells the beer tokens, engage people in discussion to gauge the level of their
intoxication.
Judge Lane approved the application from Diamond Peaks Mountain Bike Patrol for a Special
Events Permit at the Oxbow Propert, 418 Linden Street on September 5, 2009 and asked that Liquor
Enforcement Office Younger and the event coordinators meet directly after the event once they have
talked to the Buckingham neighborhood to discuss the event. Judge Lane stated a memo stating the
how the event went with feedback from the Buckingham Neighborhood be made part of their file
for review for future applications.
