Regular Meeting - October 19, 2009

A regular meeting of the Liquor Licensing Authority was held on September 28, 2009 in Municipal
Court, Justice Center, 201 Laporte. Judge Kathleen M. Lane presiding.

Agenda Review
Deputy City Clerk Jensen stated that the show cause hearing for Samuel Glen, Inc., dba Steak Out
Saloon,152 West Mountain Avenue has been continued to November 2, 2009, to allow Assistant City
Attorney LopezFilkins and the licensee's attorney, David Herrera to reach a stipulation agreement.
Approval of Minutes
Judge Lane approved the minutes from September 28, 2009.
Hearing on a Change of Location application
from Luscious Nectar Corporation, to move a
hotel -restaurant liquor license from
222 Linden Street to 253 Linden Street, Approved
Jeremy Kempter, representative for Luscious Nectar Corporation, was sworn. Mr. Kempter briefly
described the new premise. He stated he will have the front patio staffed continually as well as staff
moving in and out of the restaurant. Mr. Kempter stated he is waiting for the alleyway improvements
to be finalized to finish the back patio. In response to a question from the Authority, Mr. Kempter
stated if the alleywayis busywith pedestrians he will increase staffing on the backpatio. He confirmed
that either he, a manager, security manager or assistant manager will be on premise at all times. Mr.
Kempter stated he does not have any residents living above his establishment. He stated he will not
have any outside speakers on the patio and that any `louder' music will be limited to the mezzanine. Mr.
Kempter stated any music will be kept at a level to allow patrons to converse easily.
Mr. Kempter briefly described the petitioning process. He stated he received many positive comments
in support of this application. Mr. Kempter stated that he circulated the business petitions and that any
negative comments he received he took the time to address those issues.

Al Dunton, building owner, stated he is concerned that there are so many liquor licenses on this short
block. Mr. Dunton stated he and his wife own the building right across the street. He stated the
patrons leaving Luscious Nectar have been very loud late into the evening. Mr. Dunton stated not only
do they hear the music, they can feel it too. In response to Mr. Dunton's concerns, Mr. Kempter stated
he will hang the speakers in an attempt eliminate this problem He stated that having a patio will only
make the noise issue worse. Mr. Dunton stated that manytimes patios are onlyused bypatrons to drink
and smoke. In response to a question from the Authority, Mr. Dunton stated that he has talked to the
Gty about the issuance of encroachment permits for patios, further stating that the initial intent was
only for restaurant seating.
Mr. Kempter stated he and his staff will take extra care to be sensitive to Mr. Dunton's concerns.
Liquor Enforcement Officer Younger stated that since Hamilton's and Luscious Nectar have been
closed that stretch of block has been quieter, less public urination, less activity.
Assistant City Attorney LopezFilkins requested that the Authority eliminate the back patio from
consideration and request that Mr. Kempter come back at a later date with a modification of premise
if he wishes to add that back patio in the future. She expressed concern that there are no windows to
the back patio and will be very difficult for Mr. Kempter to properly monitor occupancy loads.
Mr. Kempter stated he has submitted an application for the back patio. In response to a question from
the Authority, Mr. Kempter stated that the encroachment permit for the front patio is an easier process
to acquire. In response to Assistant City Attorney LopezFilkins, Mr. Kempter stated that he will stop
the patrons from coming in before he gets to his full occupancy.
Mr. Dunton stated that the timeline for the alley plans behind Luscious Nectar to be finalized is at least
1 year away.
Judge Lane adopted Resolution 2009-15 approving the change of location for Luscious Nectar
Corporation, dba Luscious Nectar, from 222 Linden Street to 253 Linden Street without the back patio.
Request from CooperSmith's Brewing Co., dba
:rSmith's Pub & Brewing to Change, Alter, or Modify
Dwight Hall, managing partner, and general manager, briefly described the proposed changes. In
response to a question from the Authority, Mr. Hall stated that they will staff the tent with 6-7
employees. Mr. Hall assured the Authority that they have received approval from the Poudre Fire
Authority for the tent.
Judge Lane entered the petitions as Exhibit 1.
Judge Lane approved the request from CooperSmith's Brewing Co., dba CooperSmith's Pub &Brewing
to change, alter, or modify the licensed premises at # 5 Old Town Square on November 7, 2009.

Registration of Robert Hollis as Manager of
The Armadillo Club, 543 Walnut Street, Approved
Robert Hollis, manager applicant, briefly outlined his background. He stated he has attended TIP's
training and to require himself as well as all his staff attend TIP's training. Mr. Hollis stated any patron
that appears to be 35 years of age or younger is carded. He stated any employee found in violation of
the liquor code will likely be terminated.
Judge Lane approved the registration of Robert Hollis as Manager of The Armadillo Club, 543 Walnut
Street.
Hearing on a New Application from
Suehiro of Fort Collins South, LLC, for a
hotel -restaurant liquor license at
Suehiro Japanese Restaurant, 4431 Corbett Drive, # 100, Approved
Edward and SeonAh Kendall, managing member of Suehiro of Fort Collins South, LLC, were swom.
Ms. Kendall stated that they have both been TIP's trained. In response to a question from the
Authority, Mr. Kendall stated that the patio is fully visible from inside the restaurant, however, he will
have at minimum 1 employee assigned to the patio area. He stated that only managers will have keys
to the liquor storage. Mr. Kendall stated he has been in the restaurant business since 1985 and that he
will be at the south location full-time.
Judge Lane entered the petitions into evidence as Exhibit 1.
Judge Lane adopted Resolution 09-16 approving the application from Suehiro of Fort Collins South,
LLC for a hotel -restaurant liquor license at Suehiro Japanese Restaurant, 4431 Corbett Drive, # 100.
Registration of Julie Halualani as Manager of
Suehiro Japanese Restaurant,
4431 Corbett Drive, Suite 100 Approved
Julia Halualani, manager applicant, stated she has attended Liquor Enforcement Officer Younger's
training. She stated that she will require all her employees to attend his training prior to opening. Ms.
Halualani stated that anypatron that appears to be 40 years of age or younger, will be carded. She stated
anyemployee found in violation of the liquor code will be immediatelyterminated. Ms. Halualani stated
she intends to have a current copy of the liquor code on premise when they open mid to late
November.
Judge Lane approved the registration of Julie Halualani as Manager of Suehiro Japanese Restaurant,
4431 Corbett Drive, Suite 100.

Hearing on a New Application from
Daphney Carr, for a beer and wine license at
Funky Monkey Crepe Cafe,
130 South College Avenue, Unit B, Approved
Daphney Carr was sworn. She briefly described the petitioning process and their menu offerings. Ms.
Can stated her request for a beer and wine license is 80% customer driven. She stated theyhave at least
2 employees on premise with a maximum of 7 employees. In response to a question from the
Authority, Ms. Can detailed the premises. She stated any patron ordering alcohol will be required to
show an i.d., no matter how old they look. Ms. Carr stated she intends to have a current copy of the
liquor code on premise.
Ms. Can briefly described the petitioning process, noting that the businesses on either side of their
establishment signed their petition in support of this application.
Judge Lane entered the petitions into evidence as Exhibit 1.
Judge Lane adopted Resolution 09-17 approving a new application from Daphney Carr, for a beer and
wine license at Funky Monkey Crepe Cafe, 130 South College Avenue, Unit B.
