Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was on August 24, 2009 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Jenny LopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda. Approval of Minutes Judge Lane postponed the approval of the August 10, 2009 minutes to the September 14, 2009 meeting. Request from Yum Yum, Inc., dba Yum Yum Restaurant to Change Alter, or Modify the Licensed Premises, Approved Denise Hakim, representative for Yum Yum, Inc., briefly described the proposed premises. She stated that they are increasing the square footage by approximately 2000 square feet. Ms. Hakim stated this will be for increased sit down dining. She stated her seating capacity will go from 95 to 120. Ms. Hakim stated she is increasing her staff by approximately 10 employees. She stated the entire front of the restaurant is windows, which will enable staff to properly monitor the patio area. Ms. Hakim stated that she has all the necessary approvals from other City departments. Ms. Hakim stated that many people were in favor of this modification of premise application. Judge Lane approved the request from Yum Yum, Inc., dba Yum Yum Restaurant to change, alter, or modify the licensed premises. August 24, 2009 Hearing on a New Application from Front Range BBQ, Inc., for a hotel -restaurant liquor license at Famous Dave's Bar-B-Oue, 2880 East Harmony Road, Approved William Ferguson, representative for Front Range BBQ, Inc., was sworn. Steve Svendson, manager applicant, was sworn. Mr. Ferguson stated he has held a liquor license in Colorado for 21 years. Mr. Svendson stated he has been in the liquor business for several years. Mr. Ferguson stated he has received extensive in the sale and service of alcohol. He stated their alcohol sales are less than 10% of their gross sales. Mr. Ferguson stated they will be serving lunch and dinner only. He stated the diagram submitted is an exact depiction of what the restaurant premise will look like. Mr. Ferguson stated that the patio is very visible from inside the restaurant. In response to questions from the Authority, Mr. Ferguson detailed the diagram. He stated the occupancy is approximately 200. Mr. Ferguson stated they have a current copy of the liquor code on premise. Mr. Ferguson described the petitioning process, noting that all the businesses within the neighborhood were in support of this application. Judge Lane adopted Resolution 2009-10 approving a new application from Front Range BBQ, Inc., for a hotel -restaurant liquor license at Famous Dave's Bar-B-Que, 2880 East Harmony Road. Registration of Steve M. Svendson as Manager of Famous Dave's Bar-B-Que, 2880 East Harmony Road, Approved Steve M. Svendson, manager applicant, stated he has attended Liquor Enforcement Younger's class and has received other liquor training within the last 3 years. He stated he has not had a liquor code violation. Mr. Svendson stated he will have approximately 60 employees involved in the sale and service of alcohol. He stated patrons ordering alcohol that appear to be 40 years of age or younger is carded. Mr. Svendson stated any employee found in violation of the liquor code is terminated. Judge Lane approved the registration of Steve M. Svendson as manager of Famous Dave's Bar-B- Que, 2880 East Harmony Road. New Application from Toasty Mountain ,LLC, for a beer and wine application at Cheba Hut Toasted Subs, 925 South Taft Hill Road, #6, Approved Scott Jennings, representative for Toasty Mountain, LLC, was sworn. He stated he currently has a beer and wine license at his Laurel Street location. Mr. Jennings stated this location is a little smaller. He stated his beer and wine sales are approximately 10% of his gross sales. Mr. Jennings stated he is familiar with what is necessary in monitoring patrons that consume alcohol and that he will only be offering beer. He stated there is always a manager on duty that will be involved with August 24, 2009 checking id's and serving the beer. Mr. Jennings stated he has received training and is TIP's certified and that he will require his managers to also be TIP's trained. He stated he is on premise of both locations nearly every day. Mr. Jennings stated he has a current copy of the liquor code on premise. Mr. Jennings briefly described the petitioning process. He stated that the neighborhood was in support of this application. Judge Lane adopted Resolution 09-12 approving a new application from Toasty Mountain, LLC, for a beer and wine license at Cheba Hut Toasted Subs, 925 South Taft Hill Road, #6. New Application from Croissants de France, Inc., for a beer and wine license at La Creperie of Fort Collins, 163 West Mountain Avenue, Approved Carole Lucas and Jean Claude Lucas, representatives for Croissants de France, Inc., were sworn. Ms. Lucas stated this request is mostly customer driven. Mr. Lucas stated that their percentage of beer and wine will be less than 20% of gross sales. In response to questions from the Authority, Mr. Lucas detailed the diagram. He stated their occupancy is approximately 27 people. Ms. Lucas has attended Liquor Enforcement Officer Younger's liquor training class. She stated all her employees are experienced in the sales and service of alcohol. Ms. Lucas stated any employee found in violation of the liquor code will immediately be terminated. She stated patrons requesting alcohol that appear to be 40 years of age or younger will be carded. Ms. Lucas stated that they have a current copy of the liquor code on premise. Mr. Lucas stated that he circulated the business petitions and received overwhelming support. Judge Lane noted the residential petitions showed strong support in favor of this application. Judge Lane adopted Resolution 2009 - 11 for a new application from Croissants de France, Inc., for a beer and wine license at La Creperie of Fort Collins, 163 West Mountain Avenue.
