HomeMy WebLinkAboutLiquor Licensing Authority - Minutes - 09/28/2009LIQUOR LICENSING AUTHORITY MINUTES Regular Meeting - September 28, 2009 1:00 p.m Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on September 28, 2009 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: JennyLopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated there are no changes to the agenda. Approval of Minutes Judge Lane approved the minutes from September 14, 2009. Registration of Sarah Savage as Manager of Chuck E. Cheese's, 105 West Prospect, Approved Sarah Savage, manager applicant, stated she has worked for Chuck E. Cheese's for several years. She stated only managers are allowed to served alcohol. Ms. Savage stated there is always a manager on duty. She stated every guest that orders alcohol is carded, are allowed only one drink per W., one drink per hour and only 2 drinks per patron. Ms. Savage stated anyemployee found in violation of the liquor code will likely be terminated. She stated she has a current copy of the liquor code on premise. Judge Lane approved the registration of Sarah Savage as manager of Chuck E. Cheese's, 105 West Prospect. Registration of Alishia Moore as Manager of Woody's Wood -Fired Tavern, 518 West Laurel Street, Approved Alishia Moore, manager applicant, stated she is a certified instructor for the Safe Sery Program She stated the last training she has received was in 2007 and has been regularlytraining waitstaff. Ms. Moore stated anypatron that orders alcohol is carded. She stated anyemployee found in violation of the liquor code is immediately terminated. September 28, 2009 Judge Lane approved Alishia Moore as manager of Woody's Wood -Fired Tavern, 518 West Laurel Street. Show -Cause Hearing for Luscious Nectar Corporation, dba Luscious Nectar, 222 Linden Street, Violation Found Assistant City Attorney LopezFilkins gave her opening arguments. Jeremy Kempter gave his opening arguments. Assistant CityAttorneyLopezFilkins called Liquor Enforcement Officer Younger. He wasswornand described how he became aware of the assembly contact written for an over occupancy violation at Luscious Nectar on August 8, 2009. Mr. Kempter did not cross-examine Liquor Enforcement Officer Younger. Assistant City Attorney LopezFilkins called Mike Wilson. Mike Wilson, Fire Inspection Coordinator with Poudre Fire Authority, was sworn. He described the evening the assemblycontact was written for Luscious Nectar. Judge Lane entered Poudre Fire Authority's assembly contact form dated August 8, 2009 as Exhibit 1. Mr. Kempter cross-examined Fire Inspection Coordinator Wilson. Assistant Cary Attorney LopezFilkins called Jeremy Kempter to testify. He was sworn. Mr. Kempter detailed the night of August 8, 2009 and stated that he believed patrons were breaking through the back door screen to enter establishment. Jeremy Kempter called Mark Thombum to testify and was sworn. He briefly discussed the stop -work order issued by building inspection. Jeremy Kempter called Assistant Fire Marshal Holger Durre and was sworn. He testified as to alterations made by Jeremy Kempter for 222 Linden Street. Assistant Fire Marshal Durre stated Mr. Kempter made the necessary changes to bring him into compliance with his requests. Assistant City Attorney LopezFilkins cross-examined Assistant Fire Marshal Durre. Mr. Kempter requested a 5 minute recess. JeremyKempter himself to testify. Judge Lane reminded Mr. Kempter that he was still under oath. Mr. Kempter briefly reviewed the events of that evening and details in response to the motion as proposed. Assistant City Attorney LopezFilkins gave her closing arguments. September 28, 2009 Mr. Kempter gave his closing arguments. Judge Lane ruled on the motion, details contained in attached written Order of Suspension. Hearing on a Change of Location Application from Luscious nectar Corporation, dba Luscious Nectar, 222 Linden Street, continued to October 19, 2009 Judge Lane continued this hearing to October 19, 2009 to allowMr. Kempterto submit a letter detailing how he will make sure a responsible employee/manager is on premise at all times.
