CITIZEN REVIEW BOARD MEETING

Chair Harry Edwards Called the meeting to order at 5:311 p.m.
Minutes:
Dennis Baker made a motion to approve the September 10, 2008 minutes. Anne
Berry seconded the motion. The motion passed 7:0.
Voice Mail Reports:
CRB Voice Mail Message Report: Harry Edwards reported he checked the voice
mailbox at 5:30 p.m. on October 7, 2008 and there were no messages.
Bias Police Voice Mail Report: Sgt. Yeager reported he checked the voice mailbox and
there were no messages.
New Business:
Name Draw for L112008.008 and schedule Subcommittee review
Names were drawn for LI12008-008 and are as follows:

2009 CRB Work Plan Discussion
Harry Edwards asked the Board to review the 2008 CRB Work Plan document. How did
they want to revise for the 2009 Plan? Dennis Baker wondered if the task "Explore
options for educating citizens about the existence and purpose of the Citizen Review
Board" should have a more deliberative action plan. Harry reported the work done on
that item in 2008 was to provide a link to the complaint from the CRB web page. He
asked Dennis to bring suggestions for an action plan to the November meeting.
Anne Berry nude a motion to approve the 2009 CRB Work Plan. Dennis Baker
seconded the motion. The motion passed 7:0.

1-112008-006 — Sgt. Yeager delivered the books to the Subcommittee members. Chair
Chris Kehler set the subcommittee review for October 15, 2008, 5:30 p.m. Lt. Dodd will
secure the room and confirm the location.
Adjournment:
Dennis Baker moved to adjourn the meeting. Anne Barry seconded the motion.
The motion was approved 7:0 and the meeting was adjourned at 5.57 p.m.

Call to
Order: The meeting was called to order at 6:04 p.m. by Ms. Berry.
Case #
L112008.005: Ms. Berry advised that, pursuant to the provisions of Sections 2-138 at seq. of the Code of the City
of Fort Collins, the Citizen Review Board Subcommittee would undertake a review of an internal
investigation conducted by the Office of Police Services, Case #LI12008-005, relating to alleged
excessive use of force by a police officer during the course of making an arrest.
Executive
Session: Mr. Strunk offered the following motion: "As authorized by City Code sections 2-71 (d)(2) and 2-31
(a)(2), I move to go into executive session for the purpose of receiving and considering evidence
relating to internal investigation number L112008-005 conducted by Police Services, and for the
purpose of meeting with the Assistant City Attorney to receive legal advice regarding the manner in
which the subcommittees actions may be affected by existing law." Mr. Edwards seconded the
motion. There was no discussion and the motion carried 3-0.
Prior to adjourning into executive session, Ms. Berry advised that no final policy decision will be
made, nor will any resolution be passed or other formal action taken by the Subcommittee while in
executive session. The Subcommittee went into executive session at 6:07 p.m. All above -named
city staff members remained to answer questions during various parts of executive session.
Regular
Session: Mr. Strunk moved to adjourn from executive session. Mr. Edwards seconded the motion. There
was no discussion and the motion carried 3-0. The Subcommittee returned to regular session at
6:58 p.m.

Mr. Strunk offered the following motion: "In regard to case L112008-005, the subcommittee finds
that the investigation with respect to violation of Fort Collins Police Services General Directives —
Expectations of Individuals & Organizational Conduct A-2 (111 D.13): Use of unnecessary force in the
performance of duty or the mental or physical abuse of any person in custody, as prepared by the Office
of Police Services was sufficient and accurate, and that we concur with the finding of Exonerated"
Mr. Edwards seconded. There was no discussion. The motion passed 3-0.
Ms. Berry asked if there was any additional discussion or any additional motions. There were none.
Mr. Edwards moved to adjourn. Mr. Strunk seconded. There was no discussion. Motion carried 3-0.
The Subcommittee adjourned at 7:01 p.m.
