Colorado R0522-0590 • (97n)416-2707 Citizen Review Board Subcommittee Meeting Minutes Wednesday, October 22, 2008 Fort Collins Police Services Community Room Case # L112008-006 Present: Christopher Kahler, Subcommittee Chairman; James Dubler, Subcommittee Vice Chairman; Glenn Strunk, Subcommittee Member; Harry Edwards, Subcommittee Alternate Absent: All subcommittee members were present Staff: Greg Tempel, Assistant City Attorney; Sgt. Russ Reed, Fort Collins Police Services; Sgt. Greg Yeager, Fort Collins Police Services Public: Peter Johnson, Cheryl Johnson Call to Order: The meeting was called to order at 5:31 p.m. by Mr. Kahler. Case # L112008-007: Mr. Kahler advised that, pursuant to the provisions of Sections 2-138 at seq. of the Code of the City of Fort Collins, the Citizen Review Board Subcommittee would undertake a review of an internal investigation conducted by the Office of Police Services, Case #LI12008-006, relating to alleged police officer violation of administrative policy. Executive Session: Mr. Strunk offered the following motion: "As authorized by City Code sections 2-71 (d)(2) and 2-31 (a)(2), I move to go into executive session for the purpose of receiving and considering evidence relating to internal investigation number L112008.006 conducted by Police Services, and for the purpose of meeting with the Assistant City Attorney to receive legal advice regarding the manner in which the subcommittees actions may be affected by existing law." Mr. Dubler seconded the motion. There was no discussion and the motion carried 3-0. Prior to adjourning into executive session, Mr. Kahler advised that no final policy decision will be made, nor will any resolution be passed or other formal action taken by the Subcommittee while in executive session. The Subcommittee went into executive session at 5:34 p.m. Regular Session: Mr. Dubler moved to adjourn from executive session. Mr. Strunk seconded the motion. There was no discussion and the motion carried 3-0. The Subcommittee returned to regular session at 7:32 p.m. Mr. Kahler asked that the subcommittee consider what would be moved before any motions were considered. Mr. Dubler said that he thought that the investigation was adequate and quite extensive and well done, he was concerned about the demeanor of the officers, specifically the lead arresting officer. All subcommittee members agreed that the officers in question did not break the law or violate any Police Services General Directives. Since this is not a question particular to this case, the subcommittee thought it better to bring up at the regular monthly Citizen's Review Board meeting. Mr. Strunk will ask that it is put on the agenda for the next meeting. Mr. Dubler offered the following motion: "In regard to case L112008-006, the subcommittee finds that the investigation with respect to violation of Fort Collins Police Services General Directives — Expectations of Individuals & Organizational Conduct A-2 (III DA), (III D.6), and (III D 13) and Use of Force A-12 as prepared by the Office of Police Service was sufficient and accurate, and that we concur with the findings that the allegations are unfounded (section A-2) and exonerated (section A-12) for both subject officers." Mr. Strunk seconded. There was no discussion. The motion passed 3.0. Mr. Dubler offered the following motion: "While the officers complied with the law and Police Services General Directives, their demeanor seems to have been questionable and their actions overzealous, especially the lead arresting officer." Mr. Strunk seconded. There was no discussion. The motion passed 3-0. The subcommittee discussed the general direction of the next motion and how specific to be. A consensus decision was made to be more general. Mr Kahler offered the following motion: "The subcommittee recommends training and/or counseling for both subject officers to address the above mentioned observation" Mr. Dubler seconded. There was no discussion. The motion passed 3-0. Mr. Strunk motioned to adjourn. Mr. Kahler seconded. There was no discussion. Motion carried 3-0.
