Judge Kathleen M. Lane presiding. Staff in attendance: Jenny LopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda.. Transfer of Ownership of Albertson's Fuel Center # 814, 1660 North College Avenue from Albertson's, LLC to Valero Diamond Metro, Inc., and Trade Name Change to Valero Corner Store # 1719, Approved Adam Stapen, attorney representing Valero Diamond Metro, Inc., stated that all the Albertson Fuel Centers are being transferred to Valero Diamond Metro, Inc. Mr. Stapen stated that Valero Diamond Metro, Inc., brieflydescribed the training requirements for their employees. He stated theyimmediately terminate any employee found in violation of the liquor code. Mr. Stapen stated there will not be any change in the hours of operation or the number of employees. Judge Lane approved the transfer of ownership of Albertson's Fuel Center # 814, 1660 North College Avenue from Albertson's, LLC to Valero Diamond Metro, Inc., and Trade Name Change to Valero Corner Store # 1719. Hearing on a New Application from Smashburger Acquisition 2008-3, LLC, for hotel -restaurant liquor license at Smashburger, 2550 East Harmony Road, # 100, Approved Bob Dill, attorney representing Smashburger Acquisition 2008-3, LLC, stated this is a hotel -restaurant liquor license application. He stated theywill be open from approximately 10:00 a.m. to 10:00 p.m. Mr. Dill stated all employees will be required to be TIP's trained. He stated the petitions show support for this application. David Cannon, future manager applicant, was swom. In response to questions from Mr. Dill, he stated he has lived in Fort Collins for 14 years. Mr. Cannon stated that the registers require the cashier to verify the date of birth of any patron ordering an alcohol beverage. He stated company policy is the card any patron who appears to be under the age of 40. Mr. Cannon stated any employee found in August 18, 2008 violation of the liquor code will be immediately terminated. He stated alcohol sales will be approximately 1-2% of gross sales. In response to questions from the Authority, Mr. Cannon briefly described food and alcohol serving procedures. Max Scott, representative for Oedipus, Inc., was sworn. Mr. Scott stated that the petitions indicate support for this application. Judge Lane adopted Resolution 2008-17 approving the application from Smashburger Acquisition 2008-3, LLC, for a hotel -restaurant liquor license at Smashburger, 2550 East Harmony Road, # 100. Penalty Hearing for Shadow Bar, Inc., dba Drunken Monkey, 151 South College Avenue, Penalty Set Stewart Olive, attorney representing the Shadow Bar, Inc., submitted the training manual that has been revised since this incident. He briefly reviewed the changes. Mr. Olive detailed other jurisdiction's penalties for violations of C.C.R. Regulation 47-900, "Conduct of Establishment". Senior Assistant City Attorney Ablao argued in support of the penalty offered to the licensee. She briefly reviewed other jurisdiction's penalties for violations of C.C.R. Regulation 47-900, "Conduct of Establishment". Judge Lane found that a penaltyof 30 days, 20 days served, with 10 days held in abeyance for 1 year was sufficient. Show Cause Hearing for Slips TMT, LLC dba Sullivan's Sports Tavern, 820 City Park Avenue, Continued to September 22, 2008 Senior Assistant City Attorney requested that his show cause hearing be continued to September 22, 2008, as one of the witnesses was unable to attend. Slips TMT, LLC stated they did not object to the continuance. Judge Lane continued the show cause hearing for Slips TMT, LLC, dba Sullivan's Sports Tavern, 820 City Park Avenue to September 22, 2008.
