Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on November 17, 2008 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: JennyLopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda as presented. Approval of Minutes Judge Lane approved the minutes from November 3, 2008. Registration of John Renz as Manager of Noodles & Company, 4733 South Timberline, Continued to December 1, 2008 John Renz, manager applicant, briefly described his background. He stated managers will be required to approve any sale of liquor. Mr. Renz briefly described the training he and all his employees receive regarding the sale and service of alcohol. He stated he has a current copyof the liquor code on premise. In response to a question from the Authority, Mr. Renz stated he will provide a letter to Deputy City Clerk Jensen regarding his background byFriday, November 21, 2008 and amend his Individual Ffiistory Record. Judge Lane continued this decision to the Consent Agenda on December 1, 2008. Registration of Kyle Villers as Manager of Rodizio Grill, 200 Jefferson Street, Continued to December 1, 2008 Kyle Villers, manager applicant, briefly described his background. He stated all employees will attend Safe Server Training prior to opening the restaurant. Mr. Villers stated anyemployee found in violation of the liquor code will be immediately terminated. In response to a question from the Authority, Mr. Villers stated he has been involved with various charitable organizations. He stated he will provide a November 17, 2008 letter to Deputy City Clerk Jensen regarding his background byFriday, November 21, 2008 and amend his Individual History Record. Judge Lane continued this decision to the Consent Agenda on December 1, 2008. Transfer o f Ownership of Romano's Macaroni Grill, 4627 South Timberline from Brinker Restaurant Corporation to Mac Acquisition, LLC, Approved Peter Osterfelt, manager, stated that patrons will not see any change to the restaurant premises. He stated he has 2 assistant managers when he is not on premise. Mr. Osterfelt stated they have internal and external shoppers checking their servers. He stated any employee found in violation of the liquor code is immediately terminated. Mr. Osterfek stated he has a current copy of the liquor code on premise. He stated he has never had a liquor code violation. Judge Lane approved the transfer of ownership of Romano's Macaroni Grill, 4627 South Timberline from Brinker Restaurant Corporation to Mac Acquisition, LLC. Hearing on a New Application from Rubio's Restaurants, Inc., for a hotel -restaurant liquor license at AND Registration of Mark Uidl as Manager of Rubio's Fresh Mexican Grill, 4709 South Timberline Road, Approved Mark Uidl, manager and representative for Rubio's Restaurants, Inc., was sworn. He stated he has never had a liquor code violation. Mr. Uidl stated he will attend liquor service training prior to serving. He stated the entire restaurant, including the patio, can be seen from the counter. Mr. Uidl stated any patron that appears to be 30 years of age or younger is carded. He stated any employee found in violation of the liquor code is immediately terminated. Assistant City Attorney LopezFilkins stated she stipulated to the petitions presented by Oedipus, Inc. Mr. Uidl noted that the results of the petitions show strong support for this application. Judge Lane adopted Resolution 2008-27 approving an application from Rubio's Restaurants, Inc., for a hotel -restaurant liquor license at Rubio's Fresh Mexican Grill, 4709 South Timberline Road and approved the registration of Mark Uidl as Manager of Rubio's Fresh Mexican Grill, 4709 South Timberline Road. 2 November 17, 2008 Hearing on a New Application from BEC Enterprises, Inc., for a hotel -restaurant liquor license at The Wild Boar, 1510 South College Avenue, Approved Brandon Curiel, representative for BEC Enterprises, Inc., was sworn. He brieflydescribed the premises and the food available to their patrons. Mr. Curiel stated he will require all employees to attend training and that he will also require his employees to review liquor laws on a regular basis. He stated The Wild Boar is primarily a restaurant. Mr. Curiel stated they will not serve alcohol on the patio until the wrought iron fencing is installed. He stated he is planning on hiring more staff. Mr. Curiel stated employees will monitor patrons. He stated any employee found in violation of the liquor code will be immediatelyterminated. Mr. Czuiel stated customers have requested that BEC Enterprises, Inc., serve alcohol. Judge Lane adopted Resolution 2008-26 approving an application from BEC Enterprises, Inc., for a hotel -restaurant liquor license at The Wild Boar, 1510 South College Avenue. Hearing on a New Application from Rhee & Suh Company, Inc., for a beer and wine license at Suh, 200 West Prospect, Approved Sung Won Suh and Aimee Marrow, representatives for Rhee & Suh Company, Inc., were swom. Mr. Suh stated he moved to Colorado and opened Suh 2 months ago. He stated his patrons have requested that beer and wine be served. Mr. Suh stated he has received training on the sale and service of alcohol. He stated he has several employees who will further educate Mr. Suh in the sale and service of alcohol. Mr. Suh stated approximately 25% of their gross sales will come from the sale of beer and wine. He stated he is primarily a restaurant. Mr. Suh stated they have indoor seating for 48 patrons. He stated the patio is enclosed by a wrought iron fence. Judge Lane adopted Resolution 2008-25 approving an application from Rhee & Suh Company, Inc., for a beer and win license at Suh, 200 West Prospect. Hearing on a New Application from LU328, Inc., for a hotel -restaurant liquor license at Fusion & Asian Bistro, 2720 Council Tree Drive, # 100, Approved Leping Zhu, attorney representing LU328, Inc., briefly described the ownership structure. Mr. Lu, representative for LU328, Inc., was swom. Mr. Lu stated he has attended TIP's training. He stated 4-5 employees will be involved in the sale and service of alcohol. Mr. Lu stated she will provide him with a current copy of the liquor code. He stated that 70% of their sales will be from the sale of meals. Mr. Lu stated the patio is visible from inside the restaurant and that staff will monitor the patrons on the patio. He stated the patio is only accessible through the restaurant. Mr. Lu stated if he is not on premise, that an assistant manager will act as manager. He stated anyemployee found in violation of the liquor code will be immediatelyterminated. Assistant City Attorney LopezFill ins stipulated to the petitions as submitted by Esquire Petitioning, November 17, 2008 LLC. Mr. Lu stated the petitions show strong support for this application.
