Judge Kathleen M. Lane presiding. Staff in attendance: jenny LopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda as presented. Approval of Minutes Judge Lane approved the minutes from December 1, 2008. Show Cause Hearing for Slips TMT, LLC dba Sullivan's Sports Tavern, 820 Cijy Park Avenue, Stipulation Agreement Approved Bill Wawro, attorney representing Slips TMT, LLC, stated he has reached a stipulation agreement with Assistant City Attorney LopezFilkins. Assistant City Attorney LopezFilkins summarized the stipulation agreement. She stated that the Licensee has agreed to a 45 day suspension, 25 days served, with 20 days held in abeyance for 2 years for violating Colorado Liquor Code Regulation 47-302 (modification of premise without prior approval). Assistant CityAttomeyLopezFilkins stated the Cityis concerned with Pete Borba's involvement in this establishment. AttomeyBill Wawro stated Pete Borba is the landlord and propertyowner for Sullivan's Sports Tavern. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Slips TMT, LLC, dba Sullivan's Tavern. December 15, 2008 Transfer of Ownership of The Savoy Brasserie, 1544 Oakridge Drive from JCM Enterprises, Inc., to Harmony Grill, and Trade Name Change to Harmony Grill, Approved Thomas Ryan, representative for HarmonyGrill, stated he will attend TIP's training with his employees. He stated he and his wife, Jennifer Ryan, are very`hands-on' owners. Mr. Ryan stated serving food is the primary focus for Harmony Grill. He stated he has approximately50 employees with 25 involved in the sale and service of alcohol. Mr. Ryan stated all employees are required to maintain their TIP's certification. He stated he has a current copy of the liquor code on premise and that he has not had a liquor code violation. Judge Lane approved the transfer of ownership of The SavoyBrasserie,1544 Oakridge Drive fromJCM Enterprises, Inc., to Harmony Grill and Trade Name Change to Harmony Grill. Hearing on a New Application from Hamilton's, LLC, for a Hotel -Restaurant Liquor License at Hamilton's, 214 Linden Street, Approved Crystal Hamilton and Valerie Hamilton, representatives for Hamilton's, LLC, were sworn. Ms. Valerie Hamilton stated their intent is mainly to be a restaurant and that they will be using local and Colorado grown products. She stated she is TIP's trained and will require all employees to be TIP's certified. Ms. Crystal Hamilton stated she will attend TIP's training and will provide Deputy City Clerk Jensen with proof of training within 60 days. Ms. Crystal Hamilton stated that they will open at 10:00 a.m. and will close at 1:30 a.m. every day of the week. She stated they will be selling the brewery equipment. Ms. Crystal Hamilton stated they intend to make changes to the premises in the future and are aware of the fact that they will need to apply for a modification of premise prior to making any changes. She stated she will provide an updated diagram to Deputy City Clerk Jensen including the outdoor patio area. Ms. Crystal Hamilton stated any patrons ordering alcohol will be carded. She stated they will purchase an id scanner. Ms. Crystal Hamilton stated any employee serving an underage patron will be terminated. She stated if an employee serves a visibly intoxicated patron, that she will likely give them a warning. Ms. Crystal Hamilton stated she has a current copy of the liquor code on premise. Ms. Crystal Hamilton briefly described the petitioning process, stating they had done the petitioning themselves and received many supportive continents. Al Dunton, propertyowner of 233 and 235 Linden Street, stated he is support of this application as long as it remains a family style restaurant and bar. Ms. Crystal Hamilton stated the speakers on the patio will be turned off everyevening at 10:00 p.m and that she will be living in an apartment above the bar. Judge Lane adopted Resolution 2008-28 approving the hotel -restaurant application from Hamilton's, LLC, at Hamilton's, 214 Linden Street. December 15, 2008 Hearing on a New Application from Fort Collins Lodge No. 275, Loyal Order of Moose for a Club Liquor License at 4820 South College Avenue, Approved Brad March, attomeyfor Fort Collins Lodge No. 275, stated that this organization has held a club liquor license in Larimer County for 47 years and have not had a liquor code violation. Charles Irwin, Administrator for Fort Collins Lodge No. 275, stated that their parent organization, Moose International, requires that all servers are re-trained everythree years. He described the premises and the food service that will be available. Mr. Irwin stated he has a current copy of the liquor code on premise. He briefly described the charitable organizations the Fort Collins Lodge supports. Judge Lane noted that since this was a club liquor license application, that there was no requirement to provide evidence with respect to the needs and desires of the neighborhood. Judge Lane adopted Resolution 2008-29 approving the club liquor license from the Fort Collins Lodge No. 275, Loyal Order of Moose at 4820 South College Avenue.
