Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on April 13, 2009 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Jenny LopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda. Approval of Minutes Judge Lane approved the minutes from March 9, 2009. Show Cause Hearing for BS Investments, Inc., dba North College Discount Liquors, 814 North College Avenue, Approved Assistant Gty Attorney LopezFilkins stated she has reached a stipulation agreement with BS Investments, Inc. Assistant City Attorney LopezFilkins summarized the stipulation agreement. She stated that the Licensee has agreed to a 14 day suspension, 4 days served, with 10 days held in abeyance for 1 year for violating C R.S.12-47- 901(1)(a.5)(I)(permitting the sale of alcohol beverages to a person under the age of 21 years). Sean Dougherty, representative for BS Investments, Inc., stated he did not fire the employee that sold to the underage person. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for BS Investments, Inc., dba North College Discount Liquors, 814 North College Avenue. April 13, 2009 Registration of Shane Wilson as Manager of Pappy's Corner Pub, 1027 West Horsetooth Road, Suite #111, Approved Shane Wilson, manager applicant, stated he has been in the restaurant business for several years. He stated he has training scheduled for the end of May. Mr. Wilson stated he all his employees are required to be TIP's trained. He stated he has a current copy of the liquor code on premise and that any employee found in violation of the liquor code may be terminated. Judge Lane approved the registration of Shane Wilson as manager of Pappy's Corner Pub, 1027 West Horsetooth Road. Registration of Jason Higgs as Manager of Chipotle Mexican Grill 649 South College Avenue, Approved Jayson Higgs, manager applicant, stated he has been a restaurant manager for 18 months and has worked for Chipotle for over 3 years. He stated he has experience monitoring the intoxication levels of patrons. Mr. Higgs stated they card everyone ordering an alcoholic beverage at this location due to it's proximity to Colorado State University. He stated he is pursuing having all his employees TIP's certified. Mr. Higgs stated any employee found in violation of the liquor code may be terminated. He stated he has a current copy of the liquor code on premise. Judge Lane approved the registration of Jason Higgs as Manager of Chipotle Mexican Grill, 649 South College Avenue. Registration of Richard Paulson as Manager of Suite 152, Building 23, Suite 152, Approved Richard Paulson, manager applicant, stated this position requires more responsibility. He stated all employees are required to be TIP's certified. Mr. Paulson stated he is familiar with the signs of visibly intoxicated patrons. He stated he has a current copy of the liquor code on premise. Mr. Paulson stated any employee found in violation of the liquor code may be terminated. Judge Lane approved the registration of Richard Paulson as manager of Suite 152, Building 23, Suite 152. Request from Tom & Mike's Pub, LLC, dba Mulligan's Pub to Change, Alter, or Modify the Licensed Premises at 2439 South College Avenue, Approved Mike Poppenwimer, representative for Tom & Mike's Pub, LLC, stated that they are just adding the vacant space directly north of Mulligan's (formerly known as Mackey's Still and Grill). He stated he has not submitted plans to the City's department, as he wanted to get approval from the Authority prior to pursuing this change. Mr. Poppenwimer stated the surrounding business owners are in April 13) 2009 support of this application and submitted signatures showing their support. Judge Lane approved the request from Tom & Mike's Pub, LLC, dba Mulligan's Pub to change, alter, or modify the licensed premises at 2439 South College Avenue. Request from Road 34 Deli & Tavern, LLC, dba Road 34 Bike Bar to Temporarily Modify the Licensed Premises at 1213 West Elizabeth Street on May 2, 2009, Approved Will Overbaugh, representative for Road 34 Deli & Tavern, LLC, stated this event is essentially the same as last year. He stated last year they used 6 Moot high security fencing, but this year will use a shorter type of fencing to allow easier access to the event for emergency personnel. Mr. Overbaugh stated he has four full-time employees monitoring the perimeter of the fence and the crowd. He stated he will have someone at the back door as well as the front entry to ensure their occupancy load is not exceeded. Mr. Overbaugh stated most patrons are outside at the bicycle event instead of inside at the bar. He stated this type of fencing is much sturdier than then the metal fencing used last year. Judge Lane approved the request from Road 34 Deli & Tavern, LLC, dba Road 34 Bike Bar to temporarily modify the licensed premises at 1213 West Elizabeth Street on May 2, 2009. Transfer of Ownership of City Park Nine G.C., 411 South Bryan from DMAC Golf, LLC to Douglas W. Perry. Approved Doug Perry, sole proprietor of City Park Nine G.C., stated he intends to attend Liquor Enforcement Officer Younger's training on May 8, 2009. In response to questions from the Authority, Mr. Perry described the licensed premise. He stated the City has opened a snack bar in the past, but has failed and will unlikely be opened again. Mr. Perry stated during the regular season, he has 15-20 employees. He stated the previous concessionaire spent a lot of time training him and that all of last year's employees will be returning. Mr. Perry stated his employees are aware of issues with respect to visible intoxication. Judge Lane approved the transfer of ownership of City Park Nine G.C., 411 South Bryan from DMAC Golf, LLC to Douglas W. Perry. Transfer of Ownership of Manno's at Collindale, 1441 East Horsetooth Road from Braun's Bar & Grill at Collindale, LLC, to Crown Enterprises Incorporated, and Trade Name Change to The Crown Club at Collindale, Approved Michael Navey and Jeff Sword, representatives for Crown Enterprises Incorporated, stated they are also the owners and managers of The Crown Pub and that they will be involved with the day to day Apri113, 2009 operations of both The Crown Pub and The Crown Club at Collindale. Mr. Navey and Mr. Sword stated they will be hiring additional managers to help at both locations. Mr. Navey stated they will close at 10:00 p.m., every evening and that there will rarely be a reason to be open until 2:00 a.m. He stated any employee found serving an underage patron will be immediately terminated. Mr. Navey stated all patrons ordering an alcoholic beverage are carded. Mr. Sword stated he will make sure this location has a current copy of the liquor code on premise. Judge Lane approved the transfer of ownership of Manno's at Collindale, 1441 East Horsetooth Road from Braun's Bar & Grill at Collindale, LLC, to Crown Enterprises Incorporated, and trade name change to The Crown Club at Collindale. Hearing on a New Application from Tasty Harmony, LLC, for a beer and wine license at Tasty Harmony, 130 South Mason, Approved Sacha Steinhauser, representative for Tasty Harmony, LLC, was sworn. He stated many people have requested that they be served a glass of beer or wine with their meal. Mr. Steinhauser stated he has managed many aspects of the restaurant business, however, this is his first ownership role. He stated he expects beer and wine sales to not exceed 10%. Mr. Steinhauser stated they will not be open late at night as there are apartments above the restaurant. He stated the patio is visible from inside the restaurant and that he will assign one server specifically to the patio area. Mr. Steinhauser stated most of the wine and beer will be stored behind the bar, with some of it being stored in his office under lock and key. He stated any employee found in violation of the liquor code will be immediately terminated. Mr. Steinhauser stated any patron appearing to be under the age of 40 will be carded when ordering an alcoholic beverage. He stated he does not have a current copy of the liquor code on premise. Mr. Steinhauser briefly described the petitioning process. He stated he received many positive comments in support of this application. Judge Lane adopted Resolution 2009-04 approving an application from Tasty Harmony, LLC, for a beer and wine license at Tasty Harmony, 130 South Mason Street.
