Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on September 12, 2011 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Jenny LopezFilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Kyle Bendzsa, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated that there were no changes to the agenda. Approval of Minutes Judge Lane approved the minutes from March 21, 2011; April 4, 2011; April 18, 2011; May 16, 2011; June 6, 2011; June 20, 2011; July 11, 2011; July 18, 2011 and August 15, 2011. Show Cause Hearing for The Sports eXchange, LLC dba The Sports eXchange, 214 Linden Street, Stipulation Agreement Approved Adam Stapen, attomeyrepresentative for The Sports eXchange, LLQ stated BrittanyO'Daniel was also present. Assistant City Attorney Scurlock stated the licensee has admitted to the violations and to violating the previous stipulation agreement. She briefly reviewed the stipulation agreement and that the City is asking the licensee to serve the days suspended relatively quickly. Assistant City Attorney Scurlock stated the Licensee has agreed to a 50 day suspension, 20 days actually served and 30 days held in abeyance for 1 year. Liquor Enforcement Officer Bendzsa briefly reviewed the events of this alleged violation. Discussion ensued regarding the events of the evening. Judge Lane approved the stipulation agreement, further ordering that the Licensee must serve the 20 days by October 15, 2011 and must notifythe DeputyCityClerk bySeptember 16, 2011 which days will they have chosen to close. September 12, 2011 Registration of Aaron Van Blarcum as Manager of Sports eXchange, 214 Linden Street, Postponed This item has been postponed to October 17, 2011. Hearing on a New Application from Sluggers Corporation, for a brew pub license at Pitchers Brewery, 1100 West Drake Road, Approved Constantine Christopoulos, representative for Sluggers Corporation, stated they will be decreasing the number of seats available, but that approximately 40% of their gross sales will come from the sale of food. He stated that besides adding the brewing equipment that the premises will stay essentially the same. Mr. Constantine stated they do a `self -check twice a month, a service that comes in to do a compliance check on their employees. Ellen Just, surveyor with Aggie Agency, was swom. She briefly described the petitioning process. Ms. Just stated she received manypositive comments in support of this application. She stated many -people were familiar with the current location. Judge Lane adopted Resolution 2011-24 approving a new application from Sluggers Corporation, for a brew pub license at Pitchers Brewery, 1100 West Drake Road. Hearing on a New Application from Ingredient Ft. Collins, LLC for a beer and wine license at 101 South College Avenue, Approved Nick Wysong and Kami Tuttle, representatives for Ingredient Ft. Collins, LLCy were sworn. Ms. Tuttle stated that all patrons that order alcohol will be carded. She stated that all managers are TIP's certified. Ms. Tuttle stated that the patio is monitored. Mr. Wysong stated that several of their other locations have beer and wine licenses. He stated their alcohol sales is a verysmall percentage of their gross sales. In response to a question from the Authority, Ms. Tuttle stated employees circulated the petitions and received many comments in support of this application. Judge Lane adopted Resolution 2011-23 approving an application from Ingredient Ft. Collins, LLC, for a beer and wine license at Ingredient, 101 South College Avenue. Hearing on a New Application from Jesse A. Solomon, for a beer and wine license at The Showcase Room, 5616 South College Avenue, Approved Jesse Solomon, owner, was sworn. He stated the only bar area is on the second floor. Mr. Solomon stated he will schedule alcohol sales training in the near future. He stated that this is location is going to be more of a concert venue than a drinking establishment. Mr. Solomon stated he does not have a current copy of the liquor code on premise. He stated any employee found in violation of the liquor code will be immediately terminated. 2 September 12, 2011 Mr. Solomon stated he circulated the petitions and received positive comments for this application. Judge Lane adopted Resolution 2011-25 approving an application from Jesse A Solomon, for a beer and wine license at The Showcase Room, 5616 South College Avenue.
