HomeMy WebLinkAboutLiquor Licensing Authority - Minutes - 04/18/2011LIQUOR LICENSING AUTHORITY MINUTES Regular Meeting - April 18, 2011 1:00 p.m. Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on April 18, 2011 in Municipal Court, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated that the stipulation agreements for the show cause hearings will be heard first. Show Cause Hearing for Armadillo Club, Inc., dba Assistant City Attorney Scurlock summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 daysuspension, 5 days served ($257.16 paid fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating C.RS., 12-47-901(1)(a.5), prohibiting the sale of an alcohol beverage to a person under the age of twenty-one years. Chris Vogel, manager, stated the employee was immediately terminated. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Armadillo Club, Inc., dba The Armadillo Restaurant, 354 Walnut Street. Show Cause Hearing for Zahakis, Inc., dba Pizza Casbah, 126 West Laurel Street, Stipulation Agreement Approved Assistant City Attorney Scurlock summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 daysuspension, 5 days served ($200 paid fine in lieu of suspension), with 10 days held in abeyance for 1 year forviolating C.R.S.,12-47-901(1) (a.5), prohibiting the sale of an alcohol beverage to a person under the age of twenty-one years. Konstantinos Zahakis, representative for Zahakis, Inc., stated he terminated the employee that sold to the underage person. He stated the remaining employees have been required to be retrained. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Zahakis, Inc., dba Pizza Casbah, 126 West Laurel Street. April 18, 2011 Show Cause Hearing for McCurnin Family Enterprises, Inc., dba Ram Liquors, 1119 West Drake Road, # G34, Stipulation Agreement Approved Assistant City Attorney Scurlock summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served ($1267.78 paid fine paid in lieu of suspension), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901 (1) (a.5), prohibiting the sale of an alcohol beverage to a person under the age of twenty-one years. MichaelMcCurnin, representative forMcCumin FamilyEnterprises, Inc., stated he has purchased a card swiping machine to check all id's. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for McCurnin Family Enterprises, Inc. Show Cause Hearing for Friedlan Enterprises, Inc., dba Saddle Up Liquors, 1015 South Taft Hill Road, Stipulation Agreement Approved Assistant City Attorney Scurlock summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 daysuspension, 5 days served ($4098.55 paid fine in -lieu of suspension), with 10 days held in abeyance for 1 year for violating C.RS., 12-47-901 (1) (a.5), prohibiting the sale of an alcohol beverage to a person under the age of twenty-one years. Larry Friedland, representative for Friedlan Enterprises, Inc., stated that all employees will be required to be TIP's certified. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Friedlan Enterprises, Inc. Transfer of Ownership of Wall}'s Restaurant & Lounge, 6324 South College Avenue, from Ruffles 3, LLC to Fox Bar, LLC, and Trade Name Change to Fox Bar, Approved Miguel Gomez, Jr., representative forFox Bar, LLC, stated theyare primarily making cosmetic changes. He stated theywill continue to have dining on the right side of the building, with the lounge area on the left. Mr. Gomez, stated they will have a 6 foot fence on the patio. He stated he will card all patrons when they host 18 years old and up evenings. Mr. Gomez stated he has a current copy of the liquor code on premise. Judge Lane approved the transfer of ownership of Wally's Restaurant & Lounge, 6324 South College Avenue, 6324 South College Avenue, from Ruffles 3, LLC to Fox Bar, LLC and trade name change to Fox Bar. April 18, 2011 Hearing on a Change of Location and Tastings Permit Application from Bullfrog Wine & Spirits, Inc., to move a Retail Liquor Store License from 1642 North College Avenue to 1820 North College Avenue, Approved Charles Carlson, general manager, stated the new store is moving into the new King Soopers development. He stated the new store will be twice the size of the current store and will always have at least 2 people in the store. Mr. Carlson stated theywill be open the same hours as theyare currently. In response to questions from the Authority, Mr. Carlson described how tastings permits will be conducted. He stated all employees will be required to be TIP's certified. He described the petitioning process and that they received many comments in support of this application. Judge Lane adopted Resolution 2011-08 approving a change in location application fromBullfrog Wine and Spirits, Inc., dba Bullfrog Wine and Spirits to move a retail liquor store license from 1642 North College Avenue to 1820 North College Avenue. Hearing on a New Application from Common Culture, LLC for a beer and wine license at Cranknstein, 215 North College Avenue, Unit 2, Approved Evan Rau and Susan H. Price, representatives for Common Culture, LLC, were sworn. Mr. Rau stated they will be a beer and wine bar, as well as a coffee and bike shop. He stated they will have 5 employees. Ms. Price stated they will be involved in the day to day operations until the foreseeable future. She stated they will card all patrons. Ms. Price stated if someone purchases two drinks they must have two id's. Al Dunton, party in interest, expressed his support for this application. Mr. Rau briefly -reviewed the petitioning process. He stated he received manysupportive continents for this application. Judge Lane adopted Resolution 2011-12 approving an application from Common Culture, LLC for beer and wine license at Cranknstein, 215 North College Avenue. April 18, 2011 Hearing on a New application from The Mayor, LLC, for a hotel -restaurant liquor license at The Mayor of Old Town, 632 South Mason Street, Approved Tim Dow, attorney representing The Mayor, LL(h stated they were ready to proceed. Kevin Bolin, representative for The Mayor, LLC, was sworn. He described his background, stating that he is familiar with the liquor code and has a current copy of the code on premise. Mr. Bolin stated he has worked in restaurants for numerous years. He stated this location will focus on craft beer, high end liquors and wines. Max Scott, representative for Oedipus, Inc., was swom. In response to a question from the Authority, Mr. Scott described the petitioning process. He stated the owners have completed their training. Judge Lane adopted Resolution 2011713 approving an application from the Mayor, LLC, for a hotel - restaurant liquor license at The Mayor of Old Town, 632 South Mason Street. Registration of Michelle Lynne Peth as Manager of The Mayor of Old Town, 632 South Mason Street, Approved Michelle Lynne Peth, manager applicant, stated she has been in the restaurant business for several years and that she is TIP's certified. She stated she will be living in the house adjacent to the restaurant and that she will be on premise most days and if she is not, one of the owners will be on premise. Judge Lane approved the registration of Michelle Lynne Peth as manager of The Mayor of Old Town, 632 South Mason Street. Adjournment Municipal Judg 4
