HomeMy WebLinkAboutLiquor Licensing Authority - Minutes - 07/21/2008LIQUOR LICENSING AUTHORITY MINUTES Regular Meeting - July 21, 2008 1:00 p.m Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on July 21, 2008 in Municipal Court, Justice Center, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Senior Assistant City Attorney JennyLopezfilkins, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Consent Agenda Deputy City Clerk Jensen stated that the show -cause hearing will be heard immediately following the Hilton Garden Inn. Registration of Melissa Thomas as Manager of Hilton Garden Inn, 2821 East Harmony Road, Approved Melissa, manager applicant, briefly described her background. She stated she received her TIP's certification 18 months ago. Ms. Melissa stated alcohol service is a small part of their business. She stated she meets monthly with her staff to discuss alcohol service. Ms. Melissa stated any employee found in violation of the liquor code is immediately terminated. She stated she has a current copy of the liquor code on premise. Judge Lane approved the registration of Melissa Thomas as manager of Hilton Garden Inn, 2821 East Harmony Road. Show Cause Hearing for Luscious Nectar Corporation, Senior Assistant City Attorney Ablao requested that the Authority immediately revoke the hotel - restaurant liquor license as the licensee has not appeared. Judge Lane found that: The Authority's file shows that pursuant to Section 12-47-601, C.R.S., notice of today's hearing July 21, 2008 was sent via US Mail to the Licensee at the licensed premises, 222 Linden Street, Fort Collins CO 80522, giving the Licensee notice of the time, date, and place of the hearings as well as a copy of the motion to revoke and supporting documents. Agenda materials were later sent to the same address. 2. The notice letter and Agenda were not returned by the post office. 3. The Licensee has failed to appear for the hearing. 4. The City appeared and was ready to proceed with all witnesses present. 5. The Licensee has made no contact with the Authority's secretaryor the CityAttomey's Office. 6. The Authority reviewed the factual allegations contained in the City's motion to revoke and request for show cause hearing dated June 5, 2008 and due to the Licensee's failure to appear or contest the facts described in the City's motion at the time and place of hearing on this matter, the facts as alleged in the City's motion to revoke and request for show cause hearing dated June 5, 2008 are uncontested and true. Judge Lane hereby orders: 1. Due to Licensee's failure to appear at the hearing and show cause, after given notice and opportunityto be heard, the hotel -restaurant liquor license, # 42-42193-0000 issued to Luscious Nectar Corporation, dba Luscious Nectar, 222 Linden Street, Fort Collins CO 80524 is hereby revoked effective immediately. Request from The Criterion Group, LLC, dba The Melting Pot to Change, Alter, or Modify the Licensed Premises at 334 East Mountain Avenue from August 15, 2008 to August 17 2008 Approved Ryan Houdek, representative for Criterion Group, LLC, brieflydescribed the proposed modifications. In response to a question from the Authority, Mr. Houdek stated this is essentially the same as the modifications last year. He stated he will talk to Poudre Fire Authority regarding usage of the rooftop. Judge Lane approved the request from The Criterion Group, LLC, dba The Wring Pot to change, alter, or modify the licensed premises at 334 East Mountain Avenue from August 15, 2008 to August 17, 2008, with the condition that Mr. Houdek receive approval from the Poudre Fire Authority. Hearing on a New Application from The Rustic Oven II, Inc., for a hotel -restaurant liquor license at Rustic Oven, 2350 East Harmony, Approved Todd Crisson, representative for The Rustic Oven II, Inc., was sworn. Mr. Crisson briefly described his background. He stated this establishment will be very similar to the Rustic Oven on College Avenue. Mr. Crisson stated that theywill open at 10:00 a.m. on Sundayfor brunch. He stated the patio is fullyvisible from inside the restaurant. Mr. C isson stated he will assign staff specificallyto the patio area. He stated approximately25% of their sales come from the sale of alcohol. Mr. Crisson stated they 2 July 21, 2008 are a restaurant that has a bar. Assistant CityAttorneyLopezfilkins stipulated to the petitions from Esquire Petitioning, Inc., noting that they demonstrate support of this application. Judge Lane adopted Resolution 2008-15 approving the application from The Rustic Oven II, Inc., for a hotel -restaurant liquor license at Rustic Oven, 2350 East Harmony. Registration of Telicia Peninger as Manager of Rustic Oven, 2350 East Harmon, Road, Approved Telicia Peninger, manager applicant, briefly described her background. She stated she has attended Liquor Enforcement Officer Younger's training. Ms. Telician stated she will be supervising approximately 45 employees, of which 20 will be involved with the sale and service of alcohol. She stated either she orMr. Crisson will be on premise. Ms. Telician stated that employees will be required to card any patron that looks under 35 years of age. She stated any employee found in violation of the liquor code will be immediately terminated.
