HomeMy WebLinkAboutCitizen Review Board - Minutes - 12/10/2008E) ORIGINAL CITIZEN REVIEW BOARD MEETING CIC Room December 10, 2008 Present: Anne Berry, Jim Dubler, Harry Edwards, Dave Evans, and Glenn Strunk Excused Absence: Dennis Baker reported at the November meeting he would not be available for the December meeting. Staff: Lt. Craig Dodd, Sgt. Greg Yeager, Assistant City Attorney Greg Tempel and Angelina Sanchez -Sprague, Recorder Chair Harry Edwards called the meeting to order at 5:30 p.m. Minutes: Glenn Strunk made a motion to approve the November 12, 2008 minutes. Dave Evans seconded the motion. The motion passed 5:0. Voice Mail Reports: CRB Voice Mail Message Report: Harry Edwards reported he checked the voice mailbox at 5:12 p.m. on December 10, 2008 and there were no messages. Bias Police Voice Mail Report: Sgt. Yeager reported there were no messages at 4:00 p.m. on December 10. 2008. Public Input: The following CSU students were in attendance: Kevin Main Cole Manke Jennae Miler Kevin Wolff Shawn McGoveran Hunter Jones Paul Hamilton Lauren Schneider The following community members were in attendance: Gail Zirtzlaff David Zirtslaff Jim Saunders No one opted to speak when an invitation was extended. New Business: None. Old Business: ORIGINAL Lt. Dodd reported he'd spoken to Cable 14 staff member Mark Grant about the production of a video that could be used to educate community members about the work of the Citizen Review Board. Mark suggested he videotape the Board at one of its regular meetings and interview individual members. He'd then edit the footage with the product being a 2Yz- to 3-minute clip that would be posted on the web at the CRB's webpage(http://www.fcgov.com/cityclerk/citizen-review.php) and at the City's City Cable 14 video streaming archives (http://www.fcqov.com/cablel4/video.php). Lt. Dodd asked on what content the Board would they like the video to focus. Harry Edwards suggested Board training so the community could understand how the members prepare for the work and Dave Evans suggested how a citizen would complete a complaint packet. Lt. Dodd will move forward with production plans and said that Police Services would provide the budget. Pending Cases: L112008-008. The subcommittee will be reviewing the case after the regular meeting today. Glenn Strunk asked if any other cases were in "the hopper." Sgt. Yeager responded no. Adjournment: Anne Berry moved to adjourn the meeting. Dave Evans seconded the motion. SRO-FnnCnIinc.CnbmdnR0522-0SRO-l970)416-2707 Citizen Review Board Subcommittee Meeting Minutes Wednesday December 10, 2008 Fort Collins City Hall, CIC Room Case # L112O08-008 Present: James Dubler, Subcommittee Chairman; Anne Berry, Subcommittee Vice Chairman; Dave Evans, Subcommittee Member; Harry Edwards Subcommittee Alternate; Glenn Strunk, CRB member Staff: Greg Tempel, Assistant City Attorney; Lt. Craig Dodd, Fort Collins Police Services; Sgt. Greg Yeager, Fort Collins Police Services Public: James Saunders, complainant; eight members of a CSU class: Kevin Main, Cole Manlhe, Lauren Schneider, Jennae Miler, Kevin Wolff, Shawn McGoveran, Hunter Jones, Paul Hamilton Call to Order: The meeting was called to order at 5:53 p.m. by Mr. Dubler. Case # L112008.008: Mr. Dubler advised that he had spoken with the complainant, James Saunders, by phone on Saturday December 6t", and informed him of the subcommittee meeting. Mr. Dubler advised that, pursuant to the provisions of Sections 2-138 et seq. of the Code of the City of Fort Collins, the Citizen Review Board Subcommittee would undertake a review of an internal investigation conducted by the Office of Police Services, Case #LI12008-008, relating to alleged policy violations concerning Expectations of Individuals & Organizational Conduct, Report Procedures, and Mission and Values: Relationship with Our Community. The original name draw for this case was: Dubler, Kahler, Strunk, Berry, Evans, Edwards, Baker. Chris Kahler subsequently resigned from the board. Glenn Strunk withdrew due to a conflict of interest. Therefore the subcommittee comprised Dubler (chairman), Berry (vice chairman), Evans, and Edwards as the alternate member. Executive Session: Ms. Berry offered the following motion: "As authorized by City Code sections 2-71 (d)(2) and 2-31 (a)(2), I move to go into executive session for the purpose of receiving and considering evidence relating to internal investigation number L112008-008 conducted by Police Services, and for the purpose of meeting with the Assistant City Attorney to receive legal advice regarding the manner in which the subcommittees actions may be affected by existing law." Mr. Evans seconded the motion. There was no discussion and the motion carried 3-0. Prior to adjourning into executive session, Mr. Dubler advised that no final policy decision will be made, nor will any resolution be passed or other formal action taken by the Subcommittee while in executive session. The Subcommittee went into executive session at 6:03 p.m. James Saunders, Greg Tempel and Sgt. Yeager remained to present evidence and answer questions during various parts of executive session. Ms. Berry seconded the motion. There was no discussion and the motion carried 3-0. The Subcommittee returned to regular session at 7:37 p.m. There are seven allegations of misconduct in this case. Ms. Berry moved to address all the allegations as one question. Mr. Evans seconded the motion. There was no discussion, and the motion passed 3-0. Mr. Evans moved that regarding Ft. Collins Police Services Administrative Investigation Case # L112008-008, this subcommittee finds the investigation to be adequate and complete and that we concur with the findings, which are stated below: 1. Expectations of Individuals & Organizational Conduct A-2 (III.D.1): Failure to perform the duties of rank or assignment in the manner required by Agency policies, procedures, directives, and regulations, either willfully or through negligence, incompetence, or cowardice. UNFOUNDED 2. Expectations of Individuals & Organizational Conduct A-2 (III.D.4): Knowing departure from the truth in connection with any official duties or matters associated with Agency responsibilities. UNFOUNDED 3. Expectations of Individuals & Organizational Conduct A-2 (III.D.15): Harassment or intimidation of any person, including harassment or intimidation based on race, creed, color, sex, age, religion, national origin or ancestry, physical or mental disability, or sexual orientation. EXONERATED 4. Expectations of Individuals & Organizational Conduct A-2 (IV.A.1): Officers shall report all crime and other information of concern to the Agency that comes to their attention.... Officers shall not repress, conceal, or distort the facts of any such incident UNFOUNDED 5. Report Procedures B-10 (II.C.1): All reports shall be accurate, detailed and complete. EXONERATED 6. Report Procedures B-10 (II.C.3): It is expected that officers not only take information for the initial report, but also complete additional investigation when possible. Reports should be followed through to their logical conclusion. EXONERATED 7. Mission and Values, Relationship with Our Community: We firmly believe that citizens deserve to be treated with respect, sensitivity, and compassion, thereby maintaining their dignity. We are committed to a caring and responsive partnership with our citizens... EXONERATED The motion was seconded by Ms. Berry. There was no discussion, and the motion passed 3-0. As a point of order, Mr. Dubler noted that both he and Mr. Evans will no longer be members of the board after 31 December 2008, their terms having been fulfilled. Therefore Ms. Berry and Mr. Edwards will vote on approval of these minutes at the January 2009 business meeting. There were none. Mr. Evans moved to adjourn. Ms. Berry seconded. There was no discussion. Motion carried 3-0.
