Council Liaison: Ray Martinez Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on August 9, 2004 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Bob Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk stated that the request from FirstFish, LLC, dba Sullivan's to change, alter, or modify the licensed premises at 820 City Park Avenue will be considered under Other Business. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time and energy on the important items on a lengthy agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered separately immediately following adoption of the Consent Agenda. a. Transfer of Ownership of Everyday Store #5708, 949 South Taft Hill Road, from Recuperos, LLC, to Super America, LLC, and Trade Name Change to Super America. Judge Lane adopted the Consent Agenda. Registration of Erin Beach as Manager of HuHot Moneolian Grill, 259 South College Avenue Approved Erin Beach, manager applicant, briefly reviewed her background. She stated she will attend Liquor Enforcement Officer Younger's class. Ms. Beach stated each patron ordering alcohol is carded. She stated she has terminated an employee in the past for serving an underage patron. Ms. Beach stated she has a current copy of the liquor code on premise. Judge Lane approved the registration of Erin Beach as manager of HuHot Mongolian Grill, 259 South College Avenue. August 9, 2004 Registration of Kristine Keller as Manager of Woody's Wood -Fired Pizza, 518 West Laurel Street, Approved Kristine Keller, manager applicant, briefly described her background. She stated that patrons are monitored regularly for intoxication levels. Ms. Keller stated that any employee found in violation of the liquor code is terminated. She stated abiding by the liquor code their priority. Judge Lane approved the registration of Kristine Keller as manager of Woody's Wood -Fired Pizza, 518 West Laurel Street. Registration of Robert M. Dressel as Manager of Diamond Billiards & Pub,1213 West Elizabeth Approved Robert M. Dressel, manager applicant, briefly described his background. He stated he has attended several training classes given by Liquor Enforcement Officer Younger. Mr. Dressel stated after 8:00 p.m. all patrons are carded. He stated any employee found in violation of the liquor code is immediately terminated. Mr. Dressel stated he has a current copy of the liquor code on premise. Judge Lane approved the registration of Robert M. Dressel as manager of Diamond Billiards & Pub, 1213 West Elizabeth. Hearing on a New Application from Versacorp, Inc., for a Tavern Liquor License at The Avenue,151 South College Avenue #1 Approved Farshad Nojoumi, representive for Versacorp, hic., briefly described his background. He stated food sales has increased. Mr. Nojoumi stated they will continue to serve full meals; patrons will not see any changes. He stated they are able to monitor the patio area from inside the restaurant. In response to a question from Assistant City Attorney Ablao, Mr. Nojoumi stated the fence is 40 inches tall. He stated that after 9:00 p.m., all patrons are carded. Mr. Nojoumi stated that any employee found in violation of the liquor code is terminated. He stated they regularly ask patrons to leave that are intoxicated. Mr. Nojoumi briefly described the petitioning process. He stated several people refused to sign the petition. Mr. Nojoumi stated he did not receive many negative responses to this application. Judge Lane adopted Resolution 2004-10 approving the new application from Versacorp, Inc., for a tavern liquor license at The Avenue,151 South College Avenue, #1, contingent upon the patio being enclosed. Hearing on a New Application from The Mt. Everest Caf6, LLC, for a Beer and Wine License at The Mt. Everest Cafe, 1113 West Drake Road, Suite D54, Approved 2 August 9, 2004 Sharon Lowe, Dawa Sherpa and Lhakpa Sherpa, representatives for The Mt. Everest Cafe, LLC, were sworn. Ms. Lowe stated their primary focus will be on serving full meals, that alcohol is considered a compliment to the meal. She stated she will require their employee attend Liquor Enforcement Officer Younger's training. Ms. Lowe stated that only family members will be working in the restaurant. Ms. Lowe briefly described the petitioning process. She stated they received many positive responses in support of this application. Judge Lane adopted Resolution 2004-13 approving a new application from The Mt. Everest Caf6, LLC for a beer and wine license at The Mt. Everest Caf6, 1113 West Drake Road, Suite D54, contingent upon completion of training from Officer Younger. Show Cause Hearing for Bowl Fort Collins, LLC dba Chippers' Lanes, 830 North College Avenue Stipulation Agreement Approved Matt Hoeven, representative for Bowl Fort Collins, LLC, stated the changes made are to cater more to families. Senior Assistant AttomeyAblao summarized the stipulation agreement. She stated that the Licensee has agreed to a 1 day suspension, 1 day served (paid fine in lieu of suspension $200) for violating Regulation 47-302 of the Colorado Liquor Code, failing to obtain the written consent of the local and state licensing authorities prior to changing, altering or modifying the licensed premise. Judge Lane approved the stipulation agreement as presented. Request from Bowl Fort Collins, LLC, dba Chipper's Lanes to Change, Alter, or Modify the Licensed Premises at 830 North College Avenue Approved W1I Request from Bowl Fort Collins, LLC, dba Chippers Lanes to Change, Alter or Modify the Licensed Premises at 217 West Horsetooth Road Approved Matt Hoeven, representative for Bowl Fort Collins, LLC, briefly described the changes. He stated they have eliminated the smoking lounge and opened up the tavern area for the location at 830 North College Avenue. Mr. Hoeven stated changes at the 217 West Horsetooth location are a remodel of the interior and an addition of an outdoor patio, approximately 600 square feet. Judge Lane approved the request from Bowl Fort Collins, LLC, dba Chipper's Lanes to change, alter, August 9, 2004 or modify the licensed premises at 830 North College Avenue and 217 West Horsetooth Road. Other Business Request from First Fish, LLC, dba Sullivan's to Change, Alter, or Modify the Licensed Premises at 820 City Park Avenue, Approved Pete Borba, representative for First Fish, LLC, briefly described the proposed changes. He stated they are proposing to add an additional 276 square feet to their patio. Mr. Borba briefly described the petitioning process, stating they received many positive comments for this application. Judge Lane approved the request from First Fish, LLC, dba Sullivan's to change, alter, or modify the licensed premises at 820 City Park Avenue.
