Council liaison: Ray Martinez II Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on March 1, 2004 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated there were no changes to the Agenda. Consent Agenda The Consent Agenda is intended to expedite the meeting and allow the Authority to spend its time and energy on the important items on a lengthy agenda. Items on the Consent Agenda are (1) routine items; and (2) those of no perceived controversy. Anyone may request that an item be "pulled" off the Consent Agenda and considered separately. Items pulled from the Consent Agenda will be considered separately immediately following adoption of the Consent Agenda. 1) Registration of Crawford Morgan as Manager of Chipper's Lanes. 217 West Horsetooth Road. 2) Adoption of 2002 Annual Report. Judge Lane adopted the Consent Agenda. Registration of Jay Feinberg as Manager of C.B. & Potts, 1415 West Elizabeth, Ayuroved Mr. Feinberg briefly spoke of his background and the training all the employees were required to attend. He stated 55-60 hours per week. He stated all employees received Barcode training on January 30, 2004. Mr. Feinberg stated all patrons are carded when an alcoholic beverage is ordered. He stated he has a current copy of the Colorado Liquor Code on premise. Judge Lane approved the registration of Jay Feinberg as Manager of C.B. & Potts,1415 West Elizabeth. March 1, 2004 Registration of Phillip Paul Catalfano as Manager of Enzio's Italian Kitchen,126 West Mountain Avenue, Approved Phillip Paul Catalfano briefly spoke of his background. He stated approximately 22 employees will be involved in the sales and service of alcohol. Mt. Catalfano stated he will be on premise 55-60 hours per week. He stated they are bringing in employees from other locations to train their employees. Mr. Catalfano stated that patrons are carded if they appear to be 40 or under. He stated there is zero tolerance for violating the liquor code. Mr. Catalfano stated he has a current copy of the Colorado Liquor Code on premise. Judge Lane approved the registration of Phillip Paul Catalfano as Manager of Enzio's Italian Kitchen, 126 West Mountain Avenue. Transfer of Ownership of Linden's Brewing Company, 214 Linden Street, from Northern Consulting Group, Inc., to Conor O'Neill's of Fort Collins, LLC and Trade Name Change to Conor O'Neill's Irish Pub, Approved Cohn O'Neill, representative for Conor O'NeiTs of Fort Collins, LLC stated he has financial interest in 2 other liquor licensed establishments. He stated they will not be making any changes to the interior. Mr. O'Neill stated they will be hiring all new staff. He briefly described the training all employees will be required to attend. Mr. O'Neill stated they will always have a manager on premise. He stated he will be the full-time onsite manager. Mr. O'Neill stated they will have a door person carding patrons 7 days a week. He stated wait staff will also be carding patrons. Mr. O'Neill stated employees will be terminated if found in violation of the liquor code. He stated they have a current copy of the Colorado Liquor Code on premise. Mr. O'Neill stated he has never had a liquor code violation. Judge Lane approved the transfer of ownership of Linden's Brewing Company, 214 Linden Street, from Northern Consulting Group, Inc., to Conor O'Neills of Fort Collins, LLC and Trade Name Change to Conor O'Neills Irish Pub. Hearing on a New Application from HK Buffet, LLC, for a Hotel -Restaurant Liquor License at Hong Kong Buffet,1611 South College Avenue, #1, Approved Jim Braggonier, representative for HK Buffet, LLC, stated they are ready to proceed. Ada Mae Chen (interpreter) and Que Guo Chen (member of HK Buffet, LLC), were sworn. Mr. Chen briefly described his background. He stated Li Zhu Zhu and Jiang Chun Yan currently own restaurants. Mr. Chen briefly described the type of restaurant they plan to open. He stated they expect food sales to be 80% of their gross sales. Mr. Chen stated an employee will always be stationed at the front desk. He stated all the alcohol will be stored in the office. Mr. Chen stated they will hire approximately 15 employees. He stated he will be on premise 7 days a week. Mr. Chen stated he will be responsible for training all the employees. He stated employees that violate the liquor code will be terminated. Mr. Chen stated he has not had a liquor code violation. He stated he has a current copy of the Colorado Liquor Code 2 March 1, 2004 on premise. Mr. Chen stated they will translate the Liquor Code into Chinese. Ms. Scott, representative for Oedipus, Inc., was sworn. She briefly described the petitioning process. 212 total, 185 in favor, 176 residents, 25 residents were in opposition to the issuance of the license. Judge Lane adopted Resolution 2004-01 approving the application from HK Buffet, I LC for a Hotel - Restaurant Liquor License at Hong Kong Buffet, 1611 South College Avenue, #1, contingent upon receipt by the City Clerk's Office proof of T.I.P.'s training or equivalent prior to opening. Hearing on a New Application from Burris Holtgrave, LLC, for a Hotel -Restaurant Liquor License at Rainwater Springs Deli & Restaurant, 140 West Oak Street, #130, Approved Chris Burris, Nicole. L. Burris, Daniel Holtgrave, members and representatives for Burris Holtgrave, LLC, were swom. Mr. Burris briefly described his background. He stated the seating capacity is 25 people. Mr. Burris stated they plan to open March 16, 2004. He stated they will not be open late in the evening. Mr. Burris stated they have training scheduled with Officer Younger. He stated they will card patrons that appear to be 35 years of age or younger. Mr. Burris stated employees that are found in violation of the liquor code will be terminated. He stated he has a current copy of the Liquor Code on premise. Ms. Scott, representative for Oedipus, Inc., was swom. She briefly described the petitioning process. She stated the petition shows support for this application. Judge Lane adopted Resolution 2004-02 approving the application from Burris Holtgrave, LLC, for a Hotel -Restaurant Liquor License at Rainwater Springs Deli & Restaurant, 140 West Oak Street, #130. Adjournment The meeting adjourned at 2:42 p.m. Municipal Judge
