Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on May 7, 2007 in Municipal Court, Justice Center, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated there are no changes to the agenda. Show Cause Hearing for Elbert Distributing Company. dba Uncle's Pizzeria, 1717 South College Avenue, Stipulation Agreement Approved Dennis Marlin, representative for Elbert Distributing Company, stated he has reviewed the Stipulation agreement. He stated he admits to the violation. Senior Assistant Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $200), with 10 days held in abeyance for 1 year for violating C.R.S.,12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Uncle's Pizzeria, 1717 South College Avenue. Show Cause Hearing for Ernest and Kristen Schmidtberger, dba City Park Liquor, 2016 West LaPorte Avenue, Order Approved Ernest Schmidtberger stated he admits to the violation. He stated he will notify Deputy City Clerk Jensen with the dates he will be closed and that he has purchased scanning software for scanning id's. May 7, 2007 Senior Assistant AttorneyAblao summarized the stipulation agreement. She stated that the Licensee has agreed to a 35 day suspension, 10 days served, with 25 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the order as presented for City Park Liquor, 2016 West LaPorte Avenue. Show Cause Hearing for Rich's Aggie Discount Liquor, On Rich's Aggie Discount Liquor, 429 Canyon Avenue, Stipulation Agreement Approved Richard Schott, representative for Rich's Aggie Discount Liquor, stated he has reviewed the stipulation agreement. He stated he admits to the violation. Senior Assistant AttomeyAblao summarized the stipulation agreement. Registration of Paul Edwards Noel as Manager of Buffalo Wild Wings, 150 East Harmony Road, Approved Paul Edwards Noel, manager applicant, briefly described his background and training. He stated he has never had a liquor code violation. Mr. Noel stated he supervises 40 employees. He stated he has a current copy of the liquor code on premise. Judge Lane approved the registration of Paul Edwards Noel as manager of Buffalo Wild Wings, 150 East Harmony Road. Registration of Thomas Loftus as Manager of Mulligan's Pub, 2439 South College Avenue, Approved Thomas Loftus, manager applicant, briefly described his background and training. He stated he is TIP's certified and will require all his employees to be TIP's certified. Mr. Loftus stated they generally do not card at the door. 2 May 7, 2007 Judge Lane approved the registration of Thomas Loftus as manager of Mulligan's Pub, 2439 South College Avenue. Registration of Miguel Santana as Manager of Los Girasoles, 4709 South Timberline Road, #103, Applicant failed to appear Deputy City Clerk Jensen stated she would contact the applicant to re -schedule the hearing. Request from Tivine, LLC, dba Island Grill to Change, Alter, or Modify the Licensed Premises at 2601 South Lemav Avenue, Approved Hal Walker, representative for Tivine, LLC, briefly described the proposed changes. He stated they will be increasing their staff. Mr. Walker stated they will be adding approximately 80 tables. He stated they should have their final inspection done by mid -June. Mr. Walker stated he received many positive comments in support of this application. Judge Lane approved the request from Tivine, LLC, dba Island Grill to change, alter, or modify the licensed premises at 2601 South Lemay Avenue. Hearing on a Change in Location Application from Fitzwig Partners, Inc., dba Eliot's Mess Sandwiches to Move a Beer and Wine License from 1005 West Stuart Street, to 210 South College Avenue, Approved Jake Fitzsimmons, representative for, was sworn. He described the new location, stating it is twice the size of the previous premise. Mr. Fitzsimmons stated alcohol sales are less than 1 %. In response to questions from the Judge, Mr. Fitzsimmons detailed the premises. He stated he is TIP's certified and that he will require all of his employees to be TIP's trained. Mr. Fitzsimmons emphasized they are primarily a restaurant. Mr. Fitzsimmons briefly described the petitioning process. He stated he received many positive comments in support of this application. Senior Assistant City Attorney Ablao reminded that a licensee can not allow a visibly intoxicated patron to loiter on the premise. Judge adopted Restolution 2007 - 06 approving the Change in Location application from Fitzwig Partners, Inc., dba Eliot's Mess Sandwiches to move a beer and wine license from 1005 West Stuart Street, to 210 South College Avenue. May 7, 2007 Hearing on a New Application from Koita Investments Group, LLC, for a Retail Liquor License at Moondance Wines & Spirits, 2601 South Lemay Avenue, Unit 46, Approved Adele Riester, attorney representing Koita Investments Group, LLC, stated the licensee is ready to proceed. Sam Lee, representative for Koita Investments Group, LLC, was sworn. He briefly described the premise. Mr. Lee stated he has a current copy of the liquor code. He stated he will require all employees to attend training. Mr. Lee stated he has scanning software to verify a patron's age. In response to a question from Ms. Riester, Mr. Lee stated the letters of reference indicate he will be a responsible owner. He stated is already signed up to attend Liquor Enforcement Officer Younger's training. Max Scott, representative for Oedipus, Inc., was sworn. In response to a question from the Judge, Mr. Scott described the results of the petitions. Judge Lane adopted Resolution 2007 - 07 approving the new application from Koita Investments Group, LLC, for a Retail Liquor Store License at Moondance Wines & Spirits, 2601 South Lemay Avenue, Suite 46. Hearing on a New Application from 1200 S Coffee, LLC, for Hotel -Restaurant Liquor License at Caf6 Vino. 1200 South College Avenue Approved Richard Taranow and Kevin Zdenek, representatives for 1200 S Coffee, LLC, were sworn. Mr. Taranow and Mr. Zdenek briefly described their backgrounds. Mr. Taranow detailed the premise and their concept for this location. In response to questions from the Judge, he stated the entire patio will be visible from inside. Mr. Taranow stated they anticipate 50% of their sales will come from the sale of full meals. He stated he is scheduled to attend Liquor Enforcement Officer Younger's training. Senior Assistant City Attorney Ablao stated she has had an opportunity to review the petitions and that she has no questions. Mr. Taranow stated he has received several positive comments in support of this application. Judge Lane adopted Resolution 2007 - 08 approving the Application from 1200 S Coffee, LLC for a Hotel -Restaurant Liquor License at Cafe Vino, 1200 South College Avenue.
