Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on August 20, 2007 in Municipal Court, Justice Center, 215 North Mason. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated the order of the agenda had changed. She detailed the changes for Judge Lane. Show Cause Hearing for 7-Eleven, Inc., dba 7-Eleven, 4543 Boardwalk Drive, Stipulation Agreement Approved Kevin Coates, attorney representing 7-Eleven, Inc., stated a representative for the licensee is present. He stated the employee that served the underage patron was immediately terminated. Mr. Coates stated all employees have been re-trained. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $200), with 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as presented for 7-Eleven, 4543 Boardwalk Drive. Show Cause Hearing for Safeway Stores #46, Inc., dba Safeway Store #1552,1426 East Harmony Road Stipulation Agreement Approved Stephen Lee, attorney representing Safeway Stores #46, Inc., stated a representative for the licensee is present. He stated all cashiers have been re-trained. Mr. Lee stated the employee that served the August 20, 2007 underage patron was suspended without pay for 2 weeks. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $422), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as presented for Safeway Store #1552, 1426 East Harmony Road. Show Cause Hearing for Integrated Capital, LLC dba Marriott Hotel - Fort Collins, 350 East Horsetooth Road, Stipulation Agreement Approved Stephen Lee, attorney representing Integrated Capital, LLC, stated a representative for the licensee is present. He stated all employees involved in the sale and service of alcohol have been TIP's trained. Mr. Lee stated the employee that served the underage patron was immediately terminated. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $886), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-90 1 (1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the findings, conclusion and order accepting the stipulation agreement as presented for Marriott Hotel - Fort Collins, 350 East Horsetooth Road. Show Cause Hearing for Dang Family, Inc., dba Dragon Gate Restaurant, 2427 South College Avenue, Order Approved David Dang, representative Dang Family, Inc., stated he admits to the violation. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $200), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the order as presented for Dragon Gate Restaurant, 2427 South College Avenue. August 20, 2007 Show Cause Hearing for Maya Cove, LLC, dba Maya Cove, 2100 West Drake Road, Unit 1, Order Approved Steve Fowler, representative for Maya Cove, LLC, stated he admits to the violation. He stated vertical id's are not accepted at the restaurant any more. Mr. Fowler stated the violating employee was immediately terminated. He stated he will attend Liquor Enforcement Younger's class. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $251.88), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-90 1 (1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the order as presented for Maya Cove, 2100 West Drake Road, Unit 1. Show Cause Hearing for Seneca Liquor, LLC, dba Seneca Liquors,1721 West Harmony, Order Approved Gurwahl Atwall, representative for Seneca Liquor, LLC, stated he admits to the violation. Mr. Atwall stated he will purchase a machine to scan id's. He stated he will attend Officer Younger's class. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $819), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the order as presented for Seneca Liquors, 1721 West Harmony. Show Cause Hearing for BS Investments, Inc., dba North College Discount Liquors, 814 North College Avenue, Order Approved Sean Dougherty and Bart Maxwell, representatives for BS Investments, Inc., stated they admit to the violation. Mr. Dougherty stated they are in the process of re-training all of their staff. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $886), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the order as presented for North College Discount Liquors, 814 North College Avenue. August 20, 2007 Show Cause Hearing for Premier Wine & Spirits, Inc., dba Premier Wine & Spirits,1414 East Harmony Road Order Approved Rick Dekdebrun, representative for Premier Wine & Spirits, Inc., admitted to the violation. He stated this employee has successfully carded underage patrons in the past. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $3631), with 10 days held in abeyance for 1 year for violating C.R. S., 12-47-901 (1)(a. 5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Registration of Edward Sickle as Manager of Hilton Fort Collins, 425 West Prospect, Approved AND Show Cause Hearing for University Park Catering Company, Inc., dba Hilton Fort Collins, 425 West Prospect, Stipulation Agreement Approved Edward Sickle, manager applicant, stated he is working with Liquor Enforcement Officer Younger to educate employees involved with the sale and service of alcohol. He briefly described the corporate training all employees are required to complete. Mr. Sickle said they have an ongoing audit program to test employees that sell alcohol. He briefly described his background. Senior Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $358.11), with 10 days held in abeyance for 1 year for violating C.R.S., 12-47-901(1)(a.5), permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved Edward Sickle as the Manager and the findings, conclusion, and order accepting the stipulation agreement as presented for Hilton Fort Collins, 425 West Prospect. Registration of Travis Wilson as Manager of La Luz Mexican Grill, 140 East Boardwalk, Suite H. Approved Travis Wilson, manager applicant, briefly described his background. He stated he will attend Liquor Enforcement Officer Younger's training. Mr. Wilson stated he does not have a current copy of the liquor code on premise. Judge Lane approved Travis Wilson as Manager of La Luz Mexican Grill, 140 East Boardwalk, Suite H. 4 August 20, 2007 Request from Sanford's Grub and Pub of Colorado, Inc., dba Uncle Fredie's Junkyard Grill to Change, Alter, or Modify the Licensed Premises at 200 West Jefferson, Approved Coreyl3loom and Steve Mutter, representatives for Sanford's Grub and Pub of Colorado, Inc., briefly described the proposed modifications. In response to questions from the Authority, Mr. Mutter detailed the patio area. He stated he received favorable responses in support of this application. Judge Lane approved the request from Sanford's Grub and Pub of Colorado, Inc., dbaUncle Fredie's Junkyard Grill to change, alter, or modify the licensed premises at 200 West Jefferson Street.
