(970, 416-2707 Citizen Review Board Subcommittee Meeting Minutes D ORIGINAL Case Number IA 2007.01 February 14, 2007 Council Information Center City Hall West Present: Jim Dubler, Subcommittee Chairperson; Dennis Baker, Subcommittee Vice Chairperson; Harry Edwards, Subcommittee Member; Glenn Strunk, Subcommittee Substitute Member; Chris Kahler, Citizen Review Board Member; Lieutenant Jim Broderick, Fort Collins Police Services. Call to Mr. Dubler called the meeting to order at 6:36 p.m. Order: Case No. Mr. Dubler advised that, pursuant to the provisions of Section 2-138 et seq. of the Code lA 2007-01: of the City of Fort Collins, the Citizen Review Board Subcommittee will undertake a review of an internal affairs administrative investigation conducted by the Office of Police Services, Case No. IA 2007-01, relating to misconduct and excessive use of force by police officers on the night of December 1 into the morning of December 2, 2006. Mr. Dubler asked for a volunteer to take notes. Mr. Strunk volunteered. Mr. Edwards motioned to have Mr. Kahler present at the meeting for training purposes. Mr. Baker seconded. There was no discussion. The motion passed 3-0. Mr. Dubler requested that all parties wishing to address the Subcommittee be identified and inform the Subcommittee of the form of materials to be presented and the time required for such presentations. There were no such parties present. Executive Mr. Edwards entered the following motion: "As authorized by City Code section 2-71(d)(2) Session: and 2-31(a)(2), I move to go into executive session for the purpose of receiving and considering evidence relating to internal investigation number 2007-01 conducted by Police Services. Additionally, Mr. Kahler is invited to be present for training purposes." Mr. Baker seconded the motion. There was no discussion, and the motion carried 3-0. Prior to going into executive session, Mr. Dubler advised that no final policy decision will be made, nor will any resolution be passed or other formal action taken by the Subcommittee while in executive session. The executive session commenced at 6:43 p.m. Open Mr. Dubler reconvened the open session at 7:58 p.m. Session: Findings: Mr. Baker entered the following motion: "I move that the Citizen Review Board Subcommittee for citizen complaint case #2007-01 submit a memorandum to the City Manager and Chief of Police stating that the subcommittee concurs with the Internal Affairs investigation findings of exonerated' from allegations of misconduct and excessive use of force by the officer and detective named in the complaint °' Mr. Edwards seconded the motion. After brief discussion, the motion carried 3-0. Recommen- Mr. Baker entered the following motion: "I move that the officers involved be made aware that dations: as citizens that prompt resolution of the identification issue could have reduced tension in this contact" Mr. Edwards seconded the motion. The motion was discussed. Mr. Baker amended his motion to add: "in addition, ask Police Services to consider a policy of officer identification such as `Upon request from any person, officers shall provide their names, badge numbers and unit assignments, either in writing or by presenting their business card, unless such action is likely to jeopardize the successful completion of a police assignment. Business cards are required to be provided, without being asked, to any person an officer has detained in a traffic stop if that person is not cited or arrested.' " Mr. Dubler seconded the motion. The motion and amendment were discussed. The amendment was voted on, and carried 3-0. The motion was voted on, and carried 3-0. Adjourn: Mr. Edwards moved to adjourn. Mr. Baker seconded the motion.
