Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on July 10, 2006 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Agenda Review Deputy City Clerk Jensen stated there are no changes to the agenda. Show -Cause Hearing for Conor O'Neills of Ft. Collins, LLC, dba Conor O'Neill's Irish Pub, 214 Linden Street, Stipulation Agreement Approved Tim Dow, attorney representing the applicant, stated he has reviewed the stipulation agreement with his client. Assistant City Attorney Ablao summarized the stipulation agreement. She stated the Licensee has agreed to a 55 day suspension,15 days served, with 40 days held in abeyance for 1 year for violating C.R.S. 12-47-901(1)(a) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a visibly intoxicated person. Judge Lane approved the findings, conclusion, and order accepting the stipulation agreement as presented for Conor O'Neill's Irish Pub, 214 Linden Street. Show -Cause Hearing for Janette's Pharmacy, Inc., dba Park Central Liquors,1624 South Lemay Avenue, Hearing continued to July 24, 2006 Assistant City Attorney Ablao requested that this hearing be continued to July 24 to allow the attorneys to reach an agreement. Judge Lane continued the hearing for Park Central Liquors, 1624 South Lemay Avenue to July 24, 2006. July 10, 2006 Show -Cause Hearing for First Fish, LLC, dba Sullivan's Sports Tavern, 820 City Park Avenue, Stipulation Agreement Approved Bill Wawro, attorney representing the licensee, stated they are in the process of transferring the liquor license. Assistant City Attorney Ablao summarized the stipulation agreement. She stated that the Licensee has agree to a 90 day suspension, 27 days served, with 63 days held in abeyance for 1 year for violating Regulation 47-900(A), conduct of establishment. Judge lane approved the finding, conclusion, and order accepting the stipulation agreement as presented for Sullivan's Sports Tavern, 820 City Park Avenue. Request from Steak and Ale of Colorado, Inc., dba Bennigan's to Change, Alter, or Modify the Licensed Premise at 2203 South College Avenue from July 24 through July 29, 2006, Approved Steve Fowler, representative for Steak and Ale of Colorado, Inc., briefly described the proposed modifications and briefly described the petitioning process. Judge approved the request from Steak and Ale of Colorado, hic., dba Bennigan's to Change, Alter, or Modify the Licensed Premise at 2203 South College Avenue from July 24 through July 29, 2006. Hearing on a New Application from Addis Corp., for a Retail Liquor Store License at Kwik Stop Liquors, 1671 South College Avenue, Approved Stewart Olive, attorney representing the applicant, brieflyreviewed the application and the premises. Melaker Debebe, manager, was sworn. Mr. Debebe briefly described the violation he received under his ownership of Drinks Liquor located at 3615 West Colfax Avenue. He described his duties as the manager. Mr. Debebe stated he will card anyone that appears to be under 30 years of age. He stated he has attended Liquor Enforcement Officer Younger's class. Mr. Debebe stated he a current copy of the liquor code. Nigisty Victorio, representing the applicant, was sworn. Ms. Victorio stated Mr. Debebe will primarily be responsible for managing the store. She stated they intend to move to Fort Collins. Judge Lane admitted the petitions as Exhibit 1. Judge Lane adopted Resolution 2006 - 08 approving the application from Addis Corp., for a retail liquor store license at Kwik Stop Liquors, 1671 South College Avenue.
