Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on October 30, 2006 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Aeenda Review Deputy City Clerk Jensen stated the show -cause hearing for Metro Oil, hic., dba Diamond Shamrock Corner Store, 4701 South Lemay Avenue has been continued to November 13, 2006. Approval of Minutes Judge Lane approved the minutes from October 16, 2006. Show -Cause Hearing for Addis Corporation, dba Kwik Stop Liquors, 1671 South College Avenue, Stipulation Agreement Accepted Stewart Olive, attorney representing the licensee, stated they have finalized a stipulation agreement with Assistant City Attorney Ablao. Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $764.23), 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as presented for Kwik Stop Liquors, 1671 South College Avenue. October 30, 2006 Show -Cause Hearing for Outback/Diner-I Limited Partners, dba Outback Steakhouse, 807 East Harmony Road, Stipulation Agreement Accepted Andrea Egly, representative for Outback/Diner-I Limited Partners, stated she has finalized a stipulation agreement with Assistant City Attorney Ablao. Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 3 days served (paid fine in lieu of suspension $701.40), 12 days held in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as presented for Outback Steakhouse, 807 East Harmony Road. Hearing on a New Application from Circle Productions, LLC, for a Beer and Wine License at Nonesuch Theater, 216 Pine Street, Approved Nick Turner, representative for Circle Productions, LLC, was sworn. He stated at any time while they are open at least 2 owners are on premise. Mr. Turner stated beer and wine service will be very limited; 30 minutes prior to a show and 15 minutes during intermission. He briefly described his background in the sale and service of alcohol. Mr. Turner stated their patrons have requested that this license be granted. He stated there will be a minimum of 2 staff in the lobby area monitoring alcohol consumption. Mr. Turner stated he does not have a current copy of the liquor code. Assistant City Attorney Ablao stated the petitions demonstrate a need and desire that this application be approved. Judge Lane adopted Resolution 06-13 approving the application from Circle Productions, LLC, for a beer and wine license at Nonesuch Theater, 216 Pine Street. Hearing on a New Application from Elbert Distributing Company, Inc., for a Hotel -Restaurant Liquor License at Uncle's Pizzeria, 1717 South College Avenue, Approved Garrett and Dennis Marlin, representatives for Elbert Distributing Company, Inc., were sworn. Garrett Marlin briefly described his background. He stated this establishment will be a family style October 30, 2006 restaurant. Mr. Marlin stated they will only be serving beer and wine at this time. He stated he anticipates that their liquor sales will only be 3% - 8% of gross sales. Mr. Garrett Marlin stated all employees and both owners will attend training. Mr. Dennis Marlin stated they will not serve any patron an alcoholic beverage if they do not order food. Mr. Garrett Marlin stated any employee found in violation of the liquor code will be immediately terminated. Max Scott, representative for Oedipus, Inc., was sworn. He briefly described the results of the survey. He stated the petitions demonstrate a need and desire that this application be approved. Judge Lane adopted Resolution 2006-14 approving the application from Elbert Distributing Company, Inc., for a hotel -restaurant liquor license at Uncle's Pizzeria,1717 South College Avenue.
