Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on November 13, 2006 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Agenda Review Deputy City Clerk Jensen stated the show -cause hearing for S &A Restaurant Corp., dba Bennigan's, 2203 South College Avenue has been continued to January 8, 2007. Approval of Minutes Judge Lane approved the minutes from October 30, 2006. Show -Cause Hearing for Casa Inca, Inc., dba Inca Mexican Restaurant, 2413 South College Avenue, Stipulation Agreement Accepted Zach Wilson, attorney representing the licensee, stated they have finalized a stipulation agreement with Assistant City Attorney Ablao. Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $515), 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as presented for hica Mexican Restaurant, 2413 South College Avenue. November 13, 2006 Show -Cause Hearing for Metro Oil, Inc., dba Diamond Shamrock Corner Store, 4701 South Lemav Avenue, Stipulation Agreement Accepted Adam Stapen, attorney representing Metro Oil, Inc., dba Diamond Shamrock Corner Store, stated he has reached a stipulation agreement with Assistant City Attorney Ablao. Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 15 day suspension, 5 days served (paid fine in lieu of suspension $200), 10 days held in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as presented for Diamond Shamrock Corner Store, 4701 South Lemay Avenue. Show -Cause Hearing for Wine & Liquor Specials, Inc., dba Wine & Liquor Specials, 2439 South College Avenue, Stipulation Agreement Accepted Stu VanMeveren, attorney representing Wine & Liquor Specials, Inc., dba Wine & Liquor Specials, stated they have reached an agreement with Assistant City Attorney Ablao. Assistant City Attorney Ablao summarized the stipulation agreement and stated that the Licensee was present to answer questions. She stated that the Licensee has agreed to a 24 day suspension, 4 days served (from previous violation from February 27, 2006), 20 days held in abeyance for 1 year for violating C.R.S. 12-47-901 (a.5) of the Colorado Liquor Code, permitting the sale or service of alcohol beverages to a person under the age of 21 years. Judge Lane approved the finding, conclusion, and order accepting the stipulation agreement as presented for Wine & Liquor Specials, 2439 South College Avenue. Hearing on a New Application from Dempsey's, LLC, for a Hotel -Restaurant Liquor License at Dempsey's, 160 West Oak Street, Approved Ann Marie Christian and John Michael Pribesh, representatives for Dempsey's, LLC, were sworn. In response to a question from the Judge, Ms. Christian stated 75% of their gross sales will be from the sale of food. She stated she and Mr. Pribesh will be involved in the day to day operations of the 2 November 13, 2006 restaurant. Ms. Christian and Mr. Pribesh briefly described their background. Ms. Christian stated they will not be open after 10:00 p.m. She stated they have only made cosmetic changes to the premises. Mr. Pribesh stated they do not have a copy of the liquor code on premise. Mr. Pribesh briefly described the petitioning process. He stated he received many positive comments in support of this application. Judge Lane adopted Resolution 2006 - 15 approving the hotel -restaurant liquor license from Dempsey's, LLC, dba Dempsey's, 160 West Oak Street. The meeting adjourned at 1:35 p.m. Adjournment 3 Municipal Judge
