Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held on November 27, 2006 in Municipal Court, Justice Center, 201 LaPorte. Judge Kathleen M. Lane presiding. Staff in attendance: Teresa Ablao, Assistant City Attorney Aimee Jensen, Deputy City Clerk Robert Younger, Liquor Enforcement Officer Aeenda Review Deputy City Clerk Jensen stated there are no changes to the agenda. Approval of Minutes Judge Lane approved the minutes from November 13, 2006. Hearing on a New Application from Suzette's, LLC, for a Beer and Wine License at Suzette's,181 North College Avenue, Approved Chris Dill, representative for Suzette's, LLC, was swom. He briefly described his background. Mr. Dill detailed the type of establishment Suzette's will be. He stated alcohol will be between 15 - 18% of gross sales. Mr. Dill stated the service bar will be used by staff only; public will not have access to it. He stated either he or his wife will be on premise and will be attending Officer Younger's training on December 8. Mr. Dill stated any patron that appears to be under the age of 30 will be carded. He stated he has a current copy of the liquor code on premise. Mr. Dill briefly described the petitioning process. He stated he received support from the surrounding businesses for this application. Judge Lane adopted Resolution 2006 - 16 approving an application from Suzette's, LLC, for a beer and wine license at Suzette's, 181 North College Avenue, contingent upon Licensee receiving training within 60 days. November 27, 2006 Hearing on a New Application from Maya Cove, LLC, for a Hotel -Restaurant Liquor License at Maya Cove, 2100 West Drake Road, Unit 1, Approved Steve Fowler, representative for Maya Cove, LLC, was sworn. He briefly described his background, stating he has been in the restaurant business for approximately 18 years. Mr. Fowler stated that while he was the manager at Bennigan's, they did not have a violation of the liquor code. He detailed the type of establishment this will be. Mr. Fowler stated anypatron that appears to be under the age of 40 will be carded. He stated any employee found in violation of the liquor code will be terminated immediately. Mr. Fowler will not offer any drink specials. He stated he will only make cosmetic changes to the establishment. Mr. Fowler stated he has a current copy of the liquor code on premise. Mr. Fowler briefly described the petitioning process. He stated he received many positive comments in support of this application. Judge Lane adopted Resolution 2006 - 18 approving an application from Maya Cove, LLC for a hotel -restaurant liquor license at Maya Cove, 2100 West Drake Road, Unit 1. Hearing on a New Application from Luscious Nectar Corp., for a Hotel -Restaurant Liquor License at Luscious Nectar, 222 Linden Street, Approved Judge Lane reminded that this hearing had been continued from October 16, 2006 to allow the Licensee to submit an updated diagram. Jeremy Kempter and Peter Andrews, representatives for Luscious Nectar, Corp., were sworn. In response to questions from the Judge, Mr. Kempter detailed the new diagram. He stated breakfast and lunch will not have wait staff. Mr. Kempter and Mr. Andrews stated that either of them will be on premise at all times. Mr. Kempter stated they will attend Officer Younger's training. He stated all patrons will be carded every time they order an alcoholic beverage. Mr. Kempter stated that after 7:00 p.m., they will card patrons at the door. He stated he has a current copy of the liquor code on premise. In response to a question from Assistant City Attorney Ablao, Mr. Kempter detailed the premises. He stated that the booths will not be permanently affixed to the floor. He stated they intend to only serve paninis and breakfast burritos. Mr. Kempter stated that their intent is to be a restaurant and not a tavern. Assistant City Attorney Ablao expressed concern with this Licensee meeting the requirement of25% of their gross sales coming from the sale of full meals. She stated this application appears to be a tavern license under the pretense of a hotel -restaurant liquor license. November 27, 2006 Judge Lane adopted Resolution 2006 - 12 approving a hotel -restaurant liquor license at Luscious Nectar, 222 Linden Street.
