A Special Meeting of the Liquor Licensing Authority was head in the Office of the City Manager, 300 LaPorte Avenue, on January 8, 1975, at 7:30 P.M. for the purpose of determining whether the application of Jerry Nix, Thomas Hayes and Pamela Hayes dba Foothills Discount Liquors should be approved or denied. There were present: Absent: Elton Collins Donald Robotham Carlos Seegmiller Rudy Baldivia James MacNair Staff members present: Bean and Lewis Also City Attorney Myatt, Applicants and Counsel The Chairman restated the purpose of the meeting and called for discussion. Authority member Seegmiller stated he was bothered by the question of boundaries; adding that perhaps the City Limits should have been set, rather than the boundaries as established. Chairman Robotham stated that the Authority was working with a 40 year old Liquor Law; further there had been a tremendous growth in the City: from a population of 43,000 in the 1970 census to an estimated 87,000 in �t 1974 based on figures provided by the City Planning Office. He had also questioned the fact that there were no protestants to the application at the Riverside Avenue location. Authority member Robotham also stated the ap- plicant has substantiated a need in the neighborhood and he felt favorable toward granting the license. Authority member Collins stated he was opposed to discount outlets; he further felt there were sufficient outlets already and that there is no need for another one. Chairman Robotham stated he felt the applicants had produced evidence that the neighborhood would sustain an outlet of this kind. City Attorney Myatt stated the Authority had heard evidence from persons not in the neighborhood; the building would have to be constructed before the license was issued and that the Authority, legally, had two criteria on which to base their determination; (1) the needs of the neighborhood and (2) the 0 2 desires of the inhabitants within that neighborhood. Authority member Seegmiller made a motion seconded by Elton Collins to approve the application of Jerry Nix, Thomas Hayes and Pamela Hayes dba Foothills Discount Liquors for a retail liquor store license. The Chairman put the motion with the following vote: yeas, Seegmiller and Robotham; nays, Collins. Authority member Seegmiller made a motion seconded by Elton Collins to adjourn the meeting.
