A special meeting of the Liquor Licensing Authority of the City of Fort Collins was held on Tuesday, August 17, 1976, at 3:00 P.M. in the Council Chambers in the City of Fort Collins City Hall. Chairman Seegmiller called the meeting to order noting the following Authority members present: Linda Renz, Ed Stoner and Carlos Seegmiller. Absent: Dell Bean and James MacNair. Staff Members Present: Officer Jeff Groves and City Clerk Verna Lewis. Also: Assistant City Attorney Ramsey Myatt. Renewal Application for Foothills Discount Liquor, Inc. Approved Chairman Seegmiller explained the purpose of the meeting was to act on an application for renewal for Foothills Discount Liquors Inc. City Clerk Verna Lewis read the following police report into the record: if On August 17, 1976, the above named corporation made application for renewal of its retail liquor store license. On the same day this officer received the application for review. A check was made with the records of the Fort Collins Police Department and the Larimer County Sheriff's Office and one violation was found. This case (FCPD #76-6276) dated May 11, 1976, involved underage sale and possession. A written warning was given to the establishment by James Barry of the Liquor Enforcement Division, State of Colorado. No other records were found on this establishment or any of its corporate officers. RECOMMENDATION: The investigation has revealed nothing derogatory and we would, therefore, recommend approval of this application." City Clerk Verna Lewis advised the Authority that this application had affixed a May 12, 1976 date, being the date the State Liquor Inspector had approved the application to be submitted to the Local Licensing Authority for action. The license is currently lapsed, having lapsed on August 12, 1976. The licenses spoke to the alleged violation and the "over- sight" in not getting the application in on time for renewal by the Authority. City Clerk Verna Lewis stated that as a courtesy, the City Clerk's staff attempts to notify licensees of the renewal date; §12-47-106 (1) (b) of the C.R.S., 1973 requires in part: "Licensing - eneral rovisions. (1) (b) Application or t e renewa of an existing license shall be made to the local licensing authority not less than forty-five days and the the state licensing authority not less than thirty days prior to the date of expiration." Chairman Seegmiller stated it was the responsibility of the licensee to comply with the renewal provisions. Authority member Renz made a motion, seconded by Authority member Stoner to approve the renewal application for Foothills Discount Liquors Incorporated. Yeas: Authority members Renz, Seegmiller and Stoner. Nays: None. Chairman Seegmiller declared the meeting adjourned. airman ATTEST: City Clerk -2-
